FREEDOM OF SPEECH / FREEDOM OF EXPRESSION

FREEDOM OF SPEECH / FREEDOM OF EXPRESSION

Freedom of speech is the freedom to speak without censorship and/or limitation. The synonymous term freedom of expression is sometimes used to indicate not only freedom of verbal speech but any act of seeking, receiving and imparting information or ideas, regardless of the medium used [United Nations, 1966, 1976]. The right to freedom of speech is recognized as a human right under Article 19 of the Universal Declaration of Human Rights and recognized in international human rights law in the International Covenant on Civil and Political Rights (ICCPR). The ICCPR recognizes the right to freedom of speech as "the right to hold opinions without interference. Everyone shall have the right to freedom of expression". Furthermore freedom of speech is recognized in European, inter-American and African regional human rights law [United Nations, 1966, 1967]. Freedom of speech, or the freedom of expression, is recognized in international and regional human rights law. The right is enshrined in Article 19 of the International Covenant on Civil and Political Rights, Article 10 of the European Convention on Human Rights, Article 13 of the American Convention on Human Rights and Article 9 of the African Charter on Human and Peoples' Rights [Andrew Puddephatt & Hodder Arnold, 2005; Kumar, Ambika, 2006].

In Islamic ethics freedom of speech was first declared in the Rashidun period by the caliph Umar in the 7th century. In the Abbasid Caliphate period, freedom of speech was also declared by al-Hashimi (a cousin of Caliph al-Ma'mun) in a letter to one of the religious opponents he was attempting to convert through reason.

According to George Makdisi and Hugh Goddard, "the idea of academic freedom" in universities was "modelled on Islamic custom" as practiced in the medieval Madrasah system from the 9th century. Islamic influence was "certainly discernible in the foundation of the first deliberately-planned university" in Europe [Boisard, Marcel A., 1980].

Police must arrested ALL illegal Loan Sharks and fined them, and put them in jail. Their illegal money earned must be confiscated.

This is to deter other Loan Sharks from offering their illegal services to the public in the future!

Police reel in 2 loan sharks offering services in Pahang

By T. N. ALAGESH - March 1, 2017  -

KUANTAN: Police nabbed two men believed to be loan sharks in front of a fast food outlet near Taman Tasik Abu Bakar in Pekan here last week.
State Commercial Crime Investigation Department chief Superintendent Mohd Wazir Mohd Yusof said the suspects aged 22 and 24 years old respectively, were nabbed by a team of policemen at about 11.45am on Feb 23 for behaving suspiciously.
“We have been monitoring their activities and checks in their car led to the discovery of banners, handphones, chains and padlocks. They have been operating since early this year and offer services at four districts in Pahang.
“The men led police to a house in Bukit Setongkol here where we seized some 15,000 banners, which is meant to be displayed to promote their activities,” he told reporters during a press conference today.
Wazir said investigations revealed the men usually target customers with fixed monthly income and offer weekly interest up to 30 per cent for each deal.

Dr Zakir Naik a Security Threat ?!

COMMENTS:

How is Dr Zakir Naik a security threat ?

1-    Because he has fire-arms in his possession? No, he has no fire-arms.

2- Because he is a world martial artist in self-defense? No, he does not know any Kungfu.

3-    Because he is a great scholar? Because he is a huffaz and learn the Quran by heart? That is no crime for that.

4-    Because he know more of the Hindu texts than any great Hindu preacher? So what is wrong with that.

5-    Because he know more of the Bible texts than any great Christian preacher? So what is wrong with that.

6-    Because in his talk, a few Hindus and Christians and non-believers converted to Islam?  So what, have you ever heard of the concept “Freedom of Religion”. That means any person can convert to any religion he/she wants.

7-    Don’t be a sole loser and opportunist, and rid a great scholar (Dr Zakir Naik) – just because you are a no body). Just admitted it that Dr Zakir Naik is a great scholar !!

8-    Millions of people (Muslims and non-Muslims) supported him, and are big fans of Dr Zakir Naik – So do not banned him just because a few people are sole losers and jealous !!!  The courts and government must NOT listen and entertain this kind of few people.

Activists file civil suit demanding Zakir Naik’s arrest

BY ZURAIRI AR

KUALA LUMPUR, March 1 — A group of 19 human rights activists filed a civil suit against the Malaysian government today, accusing it of failing to protect the country from controversial televangelist Dr Zakir Naik.
The suit, among others, sought a government declaration that Dr Zakir was a threat to national security, called for a ban to prevent him from entering the country, and for him to be arrested and deported immediately.
The group, comprising plaintiffs from different religious and ethnic backgrounds, said Dr Zakir was an "undesirable person" and "a preacher of hate" who was currently roaming free in Malaysia.
“This application is not meant to insult or question the teachings of Islam and/or insult the feelings of any parties whether Muslim or not, Zakir Naik’s fans, or observers of his speeches,” the group’s spokesman, P. Waytha Moorthy, read to the press from an affidavit.
“There’s nothing on Islam, we’re strictly going on the issue of national security. Strictly on that,” added Waytha Moorthy, who is also chairman of the Hindu Rights Action Force, or Hindraf.
Besides Waytha Moorthy, the 19 plaintiffs included academic Dr Lim Teck Ghee, Sabah lawmaker Datuk Dr Jeffrey Kitingan, lawyers Siti Kassim and Asiah Abd Jalil, and Sarawak activist Peter John Jaban.
Other reliefs sought by the plaintiffs include a declaration that Dr Zakir is a threat to country’s security, unity as well as the peaceful and harmonious co-existence of its various faiths and races.
Among the evidence the group included to support its case was the involvement of three Bangladeshi students involved in the July 2016 Dhaka bombings, who were students of Monash University between 2012 and 2015.
At least two of the five attackers had publicly said they were inspired by Dr Zakir’s teachings, and the group pointed out that the preacher had conducted eight public speeches in Malaysia between 2012 and 2016.
Although the application called for an order for Dr Zakir to be arrested and deported, the group did not provide any proof that the preacher is currently residing in Malaysia, save for his recent public appearances such as in Shah Alam and Perlis.
The four defendants named in the suit were Deputy Prime Minister and Home Minister Datuk Seri Ahmad Zahid Hamidi, the Immigration Department director-general, the National Registration Department director-general, and the Government of Malaysia.
Although a fugitive in India, Deputy Home Minister Datuk Nur Jazlan Mohamed said the controversial Islamic preacher is free to travel in Malaysia because he is not on any security watch list here.

King Salman’s Asia tour is so significant in the Face of USA uncertain Foreign Policy & Discrimination

Why King Salman’s Asia tour is so significant

There was no mistaking the arrival of King Salman of Saudi Arabia and his entourage in Malaysia on Sunday morning. Traffic stood still for 30 minutes as we waited for the 600-strong royal party to make their way from the airport to the centre of Kuala Lumpur – a near endless stream of limos, lorries, outliers and ambulances, sirens screaming.
This is King Salman’s first trip to South East Asia and the region since ascending the throne in 2015. As the destination for umrah and the Haj, his country has a very special place in the hearts of the Muslim-majority countries he will be visiting, which also include Indonesia, Brunei and the Maldives. But the king’s actual presence is something different – something rare, momentous and significant in a number of ways.

On a practical and quantifiable level, the Asian tour is about trade. In Kuala Lumpur on Tuesday, Malaysia’s Petronas signed a deal for Saudi Aramco to invest $7 billion (Dh25 bn) into an oil and petrochemical refinery in the southern state of Johor. Other agreements and opportunities for businesses in both countries will also be announced, and Malaysia’s prime minister Najib Razak has already used this to hit back at critics who accused him of "selling" the country by securing massive investment from China on his visit to Beijing in November.

The Saudi deals show the level of confidence other countries such as the kingdom have in Malaysia, he has said. Indonesia’s president Joko Widodo will make a similar claim if, as expected, $25 billion worth of Saudi investment in his country is unveiled when the touring party moves on to Jakarta.
The king’s visit and the huge amount of new trade being generated around it are also very public votes of confidence in the economic reform programmes in the two South East Asian nations.

Both have undertaken measures to improve long-term resilience and competitiveness, such as the rationalisation or removal of subsidies. Malaysia has also introduced a goods and services tax to widen the tax base. But neither of these moves have been popular – who likes paying more for anything? – and opponents have been quick to try to exploit discontent at their impact.
The arrival of King Salman draws attention to the fact that his government has been undertaking almost the exact same reforms, removing or cutting key subsidies last year, and agreeing in January to impose a new 5 per cent value added tax – in essence, the same as GST. If Saudi Arabia now deems it wise to emulate the reforms of the Malaysian and Indonesian governments, that is an even greater vindication than the plaudits of the IMF and World Bank officials who have already commended the moves.

It is also an acknowledgement that the "new normal" of lower growth and a need to broaden sources of revenue affect a wide range of countries, Saudi Arabia as well as Malaysia, Indonesia and China, which King Salman is also to visit.
At a time when the United States has been sending mixed – and sometimes distinctly unfriendly – signals to many countries, including allies, the Saudi King’s tour also suggests that links in Asia need to be strengthened and may prove more reliable than with the "America First" of Donald Trump.

Militarily, Saudi Arabia’s Muslim counterterrorism coalition may well receive a boost, with several countries likely to offer more concrete participation than thus far. All states on the tour have vested interests in sharing domestic and international counter-radicalisation and deradicalisation programmes, in which Saudi Arabia and Malaysia have particular expertise.

The Killing of Kim Jong Nam at KLIA

North Korean delegation arrives in Malaysia to get body of Kim Jong-nam

KUALA LUMPUR // A high-level North Korean delegation arrived in Kuala Lumpur on Tuesday seeking the body of leader’s Kim Jong-un’s half brother, the victim of a nerve-agent attack that many suspect Pyongyang itself of orchestrating.
The body of Kim Jong-nam, killed on February 13 at Kuala Lumpur’s airport, is at the centre of a diplomatic battle between North Korea and Malaysia. Pyongyang had opposed Malaysian officials to conduct an autopsy, while Malaysia has resisted giving up the body without getting DNA samples and confirmation from next of kin.

The delegation includes Ri Tong-il, the former North Korean deputy ambassador to the United Nations, who said outside the North Korean Embassy on Tuesday that the diplomats were in Malaysia to seek the retrieval of the body and the release of a North Korean arrested in the case. He said the delegation also seeks the "development of friendly relationships" between North Korea and Malaysia.
Malaysia has confirmed that the victim of the attack is Kim Jong-nam, half brother of North Korean leader Kim Jong-un. North Korea, however, has identified the victim only as a North Korean national with a diplomatic passport.

The killing of Kim Jong-nam took place amid crowds of travellers at Kuala Lumpur airport and appeared to be a well-planned hit. Malaysian authorities say North Koreans put the deadly nerve agent VX on the hands of two women who then placed the toxin on Kim’s face. Kim died on the way to a hospital, within about 20 minutes of the attack.
Malaysian attorney general Mohamed Apandi Ali said that the two women accused of killing Kim — Indonesian Siti Aisyah and Vietnamese Doan Thi Huong — will be charged with murder Wednesday and would face a mandatory death sentence if convicted.

Two other suspects in the killing have been arrested: a Malaysian who is out on bail and a North Korean who remains in custody. Asked if the North Korean will be charged, Mr Apandi said it depends on the outcome of the investigations.
Authorities are seeking another seven North Korean suspects, including four who fled the country the day of Kim’s death and are believed to be back in North Korea.

The two women are only the small fish, who are tricked into killing of Kim Jong Nam. The United Nations and International Court of Justice (ICOJ) must charged and trial Kim Jong Un for the death of Kim Jong Nam if new evidences emerged.

Court slaps engineer with RM550,000 fine, jail for wildlife possession without permit
                  BY RAHMAT KHAIRULRIJAL - 16 FEBRUARY 2017

KAJANG: A 51-year-old engineer was sentenced to four months in prison and fined RM550,000 in default four years imprisonment to nine charges of keeping wildlife without permit. Mohd Taha Abd Wahab, pleaded guilty when the charges were read before Judge Noridah Adam at the Sessions Court here today. Noridah also ordered Taha to serve the sentence from the date of his arrest on Oct 19, 2016.

The father of four was served with two charges of keeping a female Malayan tiger and a leopard cat at his house at Kampung Gahal Jaya, Hulu Langat here at 12.30pm on Oct 19. The remaining nine charges were for keeping a Brahminy kite prey bird, a mountain hawk eagle, two white crowned Shama birds, a Schneider’s dwarf caiman crocodile, a mousedeer, a hill myna bird and a white rumped Shama bird at the same place and time.

The animals and birds are protected under the First Schedule of the Wildlife Conservation Act 2010 (Act 716). The first charge under Section 70(2) of the Act carries a maximum fine of RM500,000 and five years’ jail upon conviction. The second charge under Section 70(1) of the same Act carries a maximum fine of RM300,000 or 10 years’ jail or both.

Four charges under Section 60(1)(a) of the Act carry a maximum of RM50,000 to two years’ jail or both, and three charges under Section 68(1)(a) of the Act carry a maximum fine of RM100,000 or three years’ jail or both. Deputy Public Prosecutor Ainul Mardiyah Mohd Ali said apt punishment must be handed down as this case involved a public interest.

“This case involved various protected animals and could bring a huge impact to its ecosystems. “The public can keep wildlife but it must be done through a proper channel by applying for permit with the National Park and Wildlife Department (Perhilitan),” she said. Taha’s lawyer Zaflee Pakwanteh said his client had suffered a heart attack and underwent several heart surgeries few years ago. “My client loves exotic animals and keeping these animals serves as therapy for his illness.

“This is also his first offence and he promised not to repeat this (keeping wildlife without permit) again,” he said. According to the facts of the case, a team of Perhilitan officers raided Taha’s bungalow and upon inspection, found various wildlife were kept near the premises. The raiding party had confiscated the animals and arrested Taha after he failed to produce valid documents for keeping the wildlife

26 schools in Kedah at 'high risk' for drug-related cases, Nada to keep watch

                  New Straits Times

ALOR STAR: A total of 26 schools in Kedah will now be kept under the watchful eye of the National Anti Drug Agency (Nada) due to high potential of involvement in drug-related cases.
Its director-general Datuk Dr Abd Halim Mohd Hussin said the schools involved, located throughout the state, consist of 13 secondary and 13 primary schools.
"Nada will organise a pilot programme called, Anak Wawasan Negara, which will give focus to these 26 high risk schools.
"The programme, which is a prevention effort, will involve students from Year 1 up to Form Five," he told reporters at Wisma Darul Aman here today after attending a state-level Action Councils on Drug Eradication (MTMD) meeting.
Also present at the meeting were Menteri Besar Datuk Seri Ahmad Bashah Md Hanipah as the MTMD chairman, state police chief Datuk Asri Yusoff and state Nada director Mohammad Nazer Mustafa.
Halim added that among the methods to be implimented under the programme include individual and group councelling and other treatment and recovery programmes for the affected students.
Nada will also be educating the teachers and staff of the schools as well as the parents through various courses and talks, he said.
It was reported that Kedah recorded the highest number of people under supervision in the country last year with a total of 6,442 people as compared to over 5,000 people in 2015.
The number of students identified as drug abusers also showed an increase; 118 students in 2009, 123 in 2010, 152 in 2012 and 205 in 2013.
It was also reported that while the number of students identified have slightly dropped to 344 in 2016 compared to 374 in 2015, the number of those taking methamphetamine have gone up to about 10 percent last year.
