FREEDOM OF SPEECH / FREEDOM OF EXPRESSION

Freedom of speech is the freedom to speak without censorship and/or limitation. The synonymous term freedom of expression is sometimes used to indicate not only freedom of verbal speech but any act of seeking, receiving and imparting information or ideas, regardless of the medium used [United Nations, 1966, 1976]. The right to freedom of speech is recognized as a human right under Article 19 of the Universal Declaration of Human Rights and recognized in international human rights law in the International Covenant on Civil and Political Rights (ICCPR). The ICCPR recognizes the right to freedom of speech as "the right to hold opinions without interference. Everyone shall have the right to freedom of expression". Furthermore freedom of speech is recognized in European, inter-American and African regional human rights law [United Nations, 1966, 1967]. Freedom of speech, or the freedom of expression, is recognized in international and regional human rights law. The right is enshrined in Article 19 of the International Covenant on Civil and Political Rights, Article 10 of the European Convention on Human Rights, Article 13 of the American Convention on Human Rights and Article 9 of the African Charter on Human and Peoples' Rights [Andrew Puddephatt & Hodder Arnold, 2005; Kumar, Ambika, 2006].

In Islamic ethics freedom of speech was first declared in the Rashidun period by the caliph Umar in the 7th century. In the Abbasid Caliphate period, freedom of speech was also declared by al-Hashimi (a cousin of Caliph al-Ma'mun) in a letter to one of the religious opponents he was attempting to convert through reason.

According to George Makdisi and Hugh Goddard, "the idea of academic freedom" in universities was "modelled on Islamic custom" as practiced in the medieval Madrasah system from the 9th century. Islamic influence was "certainly discernible in the foundation of the first deliberately-planned university" in Europe [Boisard, Marcel A., 1980].

Royal Emirates Group Buy Spanish Football Club !

IS this good investment, or just throwing money around, since when the Royal Emirates Group don’t know where to put their overload money into ?! Talking about buying a 'struggling' Spanish Football Club Getafe (sounds more like ‘Get Affairs’).

Few Muslim have loads of money, and they don’t know where to spend it on, while many other ordinary Muslim suffer from poverty, illiteracy and unequal development, at the hands of their own leaders/head of states (where the so-called 'check and balance', transparency, and leadership accountability are seldom questioned).


[Note: But lately, in the Arab world, there is a glimpse of hope, where some intellectual young Arabs doing the good thing of bringing the spirit of 'democracy' and asked that the dictator leaderships to step down - thats what we call a 'paradigm shift' of thinking and action!].

I would rather spent the richness that I have on purchasing shop lots, and turn them into Halal Shops in Western countries. This will help other Muslim in the Western countries to enjoy the halal food and other items that are hard to come by, also this would directly allows job opportunity for the Muslim communities. Thats what we call contribution to the society!

Commonwealth karate gold medallist Nastenka Sureshar said she will be returning the money she has crowd-funded to finance her education after the National Sports Council of Malaysia (NSCM) stepped in.
"While I would like to sincerely thank everyone who had contributed to me through the Skolafund crowd-funding platform, I wish to announce that I will not accept the public donations that have been collected.
"This is because through the national back-up programme, there would be no more need for this fund as most of my expenditure would have been taken care of," she said in an open letter yesterday.
Nastenka said the NSCM last year made her an offer to join the programme but she had made a hasty decision not to accept it, which had then put her in a difficult position.
"After receiving overwhelming attention to my request for financial aid by various parties, I decided to meet again with the NSCM officials to obtain more information on the training package which was offered to me last year to be an athlete under the national back-up programme.
"At that time, I rejected the offer, and I have now realised that it was an unwise decision as I was very stressed out with my final examinations at the time," she said.
Nastenka said the offer would allow her to train full-time and at the same time, study at Universiti Tenaga Nasional (Uniten) without worrying about lodging, food, transport, and medical care. She will also receive a monthly allowance.
"I have now decided to reverse my decision (and) to accept the offer and I would like to appeal to Malaysia Karate Federation (Makaf) and the NSCM for me to be reconsidered to be allowed to train full-time in Bukit Jalil.
"When I met the NSC officials today (Thursday), I was also very happy that they assured that they still had room to accept my application," she said.
Ministry not to be blamed
Nastenka also apologised to Makaf, the Youth and Sports Ministry (KBS) and NSCM for causing "unnecessary misunderstanding".
"I would like to stress again that I do not blame Makaf, KBS and NSCM over the matter as they have contributed much to my training and competitions and that my decision to use Skolafund was merely to supplement my own pocket money.
"Once again, I'd like to appeal that this matter not be prolonged as I would like to devote my full concentration to my practice, to achieve my goal to be an athlete who will bring continuous honour to Malaysia in future," she said.
Last Sunday, Malaysiakini highlighted Nastenka's bid to crowd-fund RM6,350 to cover her meals, accommodation, and transport for six months at Uniten.
Her plight gained much attention and by Wednesday, she had raised RM6,995.80 through the platform while MIC Wanita also offered her a monthly allowance of RM1,000 for six months.
Nastenka said she had relied on crowd-funding after failing to secure a scholarship from KBS, which assessed her before her gold medal outing at the 2015 Commonwealth Karate Championships.

Taib's Daughter-in-law's Divorce Case Gets April 11, 2011 Date

KUALA LUMPUR: The Lower Syariah Court here Thursday set April 11 for the re-mention of the divorce petition filed by Datin Seri Shahnaz Abdul Majid, 48, the daughter-in-law of Sarawak Chief Ministrer Tan Sri Abdul Taib Mahmud. Judge Mohd Amirul Adam Ahmad set the date after syariah lawyer Saadiah Din, who is representing the defendant, Datuk Seri Mahmud Abu Bekir Abdul Taib, informed the court that her client had initiated divorce proceedings on Feb 14. She said the case had come up for mention on March 3 and had been set for re-mention on April 11. "My client's divorce proceedings were initiated before the petition filed by the plaintiff," she said. Earlier, she had told the court that her client was not able to be present in court because he was having health problems and was receiving treatment. Syariah lawyer Dr Mohd Rafie Mohd Shafie, who is representing Shahnaz, then asked the court to have both cases heard together as they involved the same issues.

However, judge Mohd Amirul Adam said the court could not accede to this as it was beyond his jurisdiction and furthermore, a divorce petition took a long time, up to a year and perhaps even more. He said the court was giving the same re-mention dates for both the cases and would first looking into the husband's case, and if this was settled, it would apply to the petition as well. Shahnaz, 48, who is also the sister of Malaysian jazz queen Datuk Sheila Majid, had filed the petition on Feb 22 citing grounds that her husband had failed to discharge his marital duties since 2001. She is seeking RM100 million for 'mutaah' [alimony; financial support to ex-spouse: maintenance paid to a former spouse. Penis Purification Plan in Adelaide !

Nut head! to the justice system and the (Indian) wife... So the wife suffered years of hardship under the husband, so that gives her the rights to 'burn him (or his penis)’ in exchange for the years of hardship (due to her stupidity in the first place)?!


HOW would the court react IF the husband was the one that burnt the private parts of the wife or set her on fire?! … I know, the court system has a ‘double standard’ one for the woman, and the other for the man! CRAB!


Note: The woman should be smart and brave enough to voice out her discontent years back, before it accumulated and got worst… Ignorance of the law (or one's right) has never been a good defence these days! (Least you a woman ?!)

SOUTH AUSTRALIA (SA) - HUSBAND Burner Gets Suspended Sentence !

An Adelaide woman who killed her cheating husband by setting him on fire has walked from court with a suspended sentence. Rajini Narayan, 46, ONLY PLANNED to burn her husband's penis a little, to bind him to her by leaving a red mark like the one on her forehead. She was distressed and muddled after suffering more than two decades of physical and psychological abuse only to discover that Satish, 47, was having an affair and might leave her. She told him of her illogical penis purifying plan and showed him a cup of petrol and a candle.


BUT he turned his back on her saying: "No, you won't. You bitch." (Note: Oh yes, the husband suppose to say, 'Ok, yes, quickly burn my penis!' ... What a load of crab!) Narayan told her Supreme Court murder trial, which found her guilty of the lesser charge of manslaughter, she had snapped and thrown the candle and petrol on his back. Her husband later died of the burns.


Justice John Sulan sentenced Narayan on Wednesday to six years in jail. He set a non-parole period of three years and took the unusual step of suspending the sentence, saying Narayan had suffered already and sending her to jail may punish others more. "For the first time in your life you had confronted your husband, had found the courage to be assertive to the person who had mistreated you for 20 years," he said. "His response was to treat you with disdain, dismiss you."


Her husband's family had called for the maximum punishment for the death of the man they described as talented and loving. But his children told the court that while they grieved for their abusive father, the atmosphere at home was no longer angry and hostile. "It is clear from your children's evidence that you are the linchpin of the family," Justice Sulan said.

8 Pegawai Imigresen Didakwa Oleh NOOR AZMAH IBRAHIM

SHAH ALAM 7 April - Lapan pegawai Jabatan Imigresen dihadapkan ke Mahkamah Sesyen di sini hari ini atas 83 tuduhan menerima rasuah daripada pemandu feri dan orang perantara membabitkan jumlah keseluruhan sebanyak RM122,140 dalam tempoh antara April dan September tahun lalu. Kesemua tertuduh yang merupakan penguatkuasa di Bahagian Perkapalan, Pelabuhan Selatan, Pelabuhan Klang didakwa memperoleh wang suapan itu yang dimasukkan ke dalam akaun mereka atau individu lain sebagai upah bagi memudahkan urusan kemasukan penumpang warga Indonesia ke negara ini tanpa perlu mematuhi syarat yang ditetapkan.

Md. Shahrizal Che Dan, 26, Mohd. Khairul Haqimie Kamarudin, 26, Ahmad Zahed Abd. Alim, 28, Azmir Mahadi, 28, Mohd. Hafiz Zakaria, 27, Nor Shahazlina Sulaiman, 25, Mohamad Huzzail Ahmad, 31, dan Mohamad Izuwanshah Samsuri, 25, masing-masing mengaku tidak bersalah selepas pertuduhan dibaca secara berasingan.

Md. Shahrizal menghadapi 31 pertuduhan memperoleh wang tunai berjumlah RM51,760 melalui 31 transaksi di beberapa buah cawangan Public Bank, manakala Nor Shahazlina didakwa menerima suapan sebanyak RM2,900 melalui akaun milik Abdul Razak Khaidir di Maybank Cawangan Pandamaran. Sementara itu di mahkamah berasingan, Mohamad Izuwanshah didakwa atas 25 pertuduhan memperoleh wang tunai sebanyak RM31,690, manakala Mohamad Huzzail didakwa memperoleh suapan RM500 di hadapan sebuah rumah di Persiaran Seraya, Taman Palm Grove, Klang.

Di sebuah lagi mahkamah, Ahmad Zahed didakwa atas 12 pertuduhan memperoleh wang tunai sebanyak RM13,590, manakala Azmir Mahadi pula didakwa atas enam pertuduhan memperoleh RM5,710. Mohd. Hafiz pula didakwa atas empat pertuduhan memperoleh suapan RM8,640 dan Mohd. Khairul Haqimie yang sedang menyambung pelajaran pula menghadapi tiga pertuduhan memperoleh RM7,350.

Tiga hakim iaitu Asmadi Hussain, M. Bakri Abd. Majid dan Mat Ghani Abdullah yang mendengar kes itu secara berasingan membenarkan setiap tertuduh diikat jamin antara RM4,000 dan RM10,000. Mat Ghani menetapkan esok untuk sebutan kes terhadap Ahmad Zahed, Azmir, Mohd. Hafiz dan Mohd. Khairul Haqimie bagi memutuskan sama ada mereka akan dibicara bersama atau sebaliknya, manakala dua hakim lain menetapkan sebutan kes pada 5 Mei dan 27 April ini. Bagi setiap pertuduhan, mereka didakwa mengikut Seksyen 17(a) Akta Suruhanjaya Pencegahan Rasuah Malaysia 2009 dan boleh dihukum di bawah Seksyen 24 akta sama yang memperuntukkan hukuman penjara maksimum 20 tahun dan denda lima kali ganda nilai suapan atau RM10,000 atau mana yang lebih tinggi.

Pada Ogos tahun lalu, sebuah akhbar melaporkan kes kakitangan Imigresen di Jeti Pulau Ketam, Pelabuhan Klang menerima suapan sehingga RM60,000 sebulan sebagai habuan bagi memudahkan urusan keluar masuk pendatang haram serta melepaskan warga asing dengan pasport yang mempunyai cop palsu atau tiada dokumen. Tindakan tersebut menyebabkan pintu masuk negara melalui pelabuhan itu mudah dibolosi pendatang haram dari Indonesia.

Pegawai Kanan Kastam dibebaskan

PEGAWAI kanan Kastam Diraja Malaysia yang direman lapan hari sejak minggu lalu berhubung siasatan kes rasuah dilepas tanpa syarat oleh Mahkamah Majistret di Kuantan, semalam. KUANTAN 4 April - Seorang pegawai kanan Jabatan Kastam Diraja Malaysia (JKDM) yang ditahan reman sejak Isnin lalu bagi membantu siasatan berhubung pembongkaran pelbagai aktiviti mencurigakan membabitkan pegawai pasukan penguat kuasa itu, dilepaskan hari ini tanpa syarat.

Majistret Nordiana Abdul Aziz memerintahkan demikian semasa pegawai kanan bergelar Datuk yang berumur dalam lingkungan 50-an itu dibawa ke Mahkamah Majistret di sini. Peguam yang mewakili pegawai kanan tersebut, Mohamad Sazali Abdul Aziz ketika ditemui di pekarangan mahkamah berkata, siasatan yang dilakukan oleh pihak Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) juga telah selesai.

Rabu lalu, akhbar melaporkan dua pegawai kanan KDRM yang juga merupakan pasangan suami isteri ditahan SPRM dalam satu operasi besar-besaran di kawasan pantai timur, Pulau Pinang, Selangor, Kuala Lumpur dan Johor. Dalam serbuan pada 28 Mac lalu, anggota SPRM dilaporkan menjumpai sejumlah wang bernilai ratusan ribu ringgit berselerakan di rumah pasangan pegawai kanan tersebut yang kemudiannya ditahan untuk siasatan.

Mahkamah Majistret di sini pada Jumaat lalu bagaimanapun membebaskan isteri pegawai kanan tersebut tanpa syarat manakala pegawai kanan JKDM terbabit ditahan reman sehingga hari ini. .

Laporan Kematian Sarbani diserah kepada AG

KUALA LUMPUR 25 April - Polis sudah menyerahkan kertas siasatan kes kematian pegawai kastam, Ahmad Sarbani Mohamed di bangunan pejabat Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) Wilayah Persekutuan di Jalan Cochrane pada 6 April lalu ke pejabat Peguam Negara (AG). Ketua Polis Kuala Lumpur, Datuk Zulkifli Abdullah berkata, kertas siasatan tersebut diserahkan pada Jumaat lalu iaitu sebaik sahaja ia selesai dilengkapkan. "Kini terpulanglah kepada AG untuk mengambil tindakan lanjut terhadap kes tersebut," katanya kepada Utusan Malaysia ketika dihubungi di sini hari ini.


Zulkifli yang enggan mengulas lanjut mengenai kertas siasatan yang sudah siap itu berkata, seperti dimaklumkan sebelum ini, siasatan kes tersebut ditumpukan kepada laporan kematian mengejut. Ahmad Sarbani, 56, yang juga Penolong Pengarah Kastam Selangor ditemui mati di gelanggang badminton tingkat satu pejabat SPRM setelah ditinggalkan bersendirian oleh pegawai suruhanjaya itu. Kes kematian beliau menjadi perhatian kerana SPRM ketika itu giat menjalankan Operasi 3B terhadap Jabatan Kastam Diraja Malaysia (JKDM) atas kesalahan rasuah, pengubahan wang haram dan pelbagai lagi, yang melibatkan kerugian pendapatan negara berbilion ringgit.

Pegawai Kastam Mati Jatuh Bangunan SPRM KUALA LUMPUR: Seorang pegawai kastam yang membantu siasatan kes rasuah membabitkan cukai tidak dibayar, ditemui mati dipercayai jatuh dari tingkat tiga bangunan Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) di Jalan Cochrane, di sini pagi ini. Mayat beliau ditemui di tingkat bawah bangunan itu pada jam 10.15 pagi. Difahamkan, mangsa yang dibebaskan dengan ikat jamin kelmarin, adalah seorang pegawai kanan Kastam Selangor.


Pengarah Penyiasatan SPRM, Datuk Mustafar Ali, dilaporkan berkata pegawai Kastam berkenaan ke pejabat suruhanjaya itu hari ini untuk menemui pegawai penyiasat. Katanya, pegawai penyiasat meminta pegawai Kastam berkenaan menunggu sementara pergi mengambil fail kes. Bagaimanapun, katanya, apabila kembali semula pegawai penyiasat berkenaan mendapati pegawai Kastam terbabit sudah tiada.

Pastor Terry Jones: 'Burning the Quran' !

One way to be really famous in a very short time, is to do or say something very controversy, and Pastor Terry Jones (the so called brain-intelligent-civilized Christian) did just that, ‘by burning the Quran in public.’ Good way to promote Christianity to the world too… ALL religion teach peace and to ‘respect’ other religion, I Guess Pastor Terry Jones has his way of showing ‘respect’ to other religion and respect other races.

Worst attack on U.N. in Afghanistan kills at least 7 staff

MAZAR-I-SHARIF, Afghanistan (Reuters) - Afghans protesting against the burning of a Koran by an obscure U.S. pastor over-ran a United Nations compound on Friday and killed at least seven international staff in the deadliest ever attack on the UN in Afghanistan. Thousands of demonstrators flooded into the streets after Friday prayers and headed for the UN mission in usually peaceful Mazar-i-Sharif, a city slated as safe enough to be in the vanguard of a crucial security transition. The governor of Balkh province said insurgents had used the march as cover to attack the compound, in a battle that raged for several hours and raises serious questions about plans to make the city a pilot for security transfer to national forces. The UN Security Council called an emergency meeting for later on Friday to discuss the attack. The attackers overwhelmed security guards, burned parts of the compound and climbed up blast walls to topple a guard tower. Five protesters were also killed and around 20 wounded, some after trying to take weapons off the UN security guards. "The insurgents have taken advantage of the situation to attack the UN compound," said Governor Ata Mohammad Noor. He told a news conference that many in the crowd of protesters had been carrying guns. Some 27 people have already been detained over the attack, he added.


DEADLIEST ATTACK... The attack is the deadliest ever on the United Nations in Afghanistan, and one of the worst on the organization for years. "It is the worst incident ever for UN staff in Afghanistan. Mazar mobs were active in the 1990s, repeatedly ransacking UN offices...but so far as I remember they never actually killed anyone," a former UN staff member in Afghanistan told Reuters.

2010 Qur'an-Burning Controversy


The 2010 Book-burning controversy arose when pastor Terry Jones of the small, non-denominational Christian Dove World Outreach Center in Gainesville, Florida, United States, announced plans to conduct book burnings of the Qur'an on the ninth anniversary of the September 11, 2001 attacks, which he dubbed International Burn a Koran Day. The planned Qur'an desecration event was widely condemned by politicians and religious groups. At one point, Jones declared the book-burning cancelled and announced his intention to fly to New York to meet with the imam of Park51, Feisal Abdul Rauf, but later stated that the burning was suspended, not cancelled. The proposal to burn Qur'ans began with a series of Twitter messages on July 12, and/or a related discussion on the now-removed Facebook group "Islam is of the Devil", named after Terry Jones' book. Jones invited Christians to burn the Muslim holy book to remember all 9/11 victims. It was to be held from 6 p.m. to 9 p.m CNN News. The idea initially had little support and considerable opposition, but Religion News Service ran a story describing Jones' claim that he had received Qur'ans to burn. CAIR refused to respond, but other religious organizations did.


On July 25 Jones posted a YouTube video in which he held up a Qur'an and said "This is the book that is responsible for 9/11. No, to me it looks like the religion of the devil CNN News" which garnered substantial media attention. On August 3, Gainsville mayor Craig Lowe asked the world's media to ignore Jones' church as a "tiny fringe group and an embarrassment to our community", but coverage continued to increase. In early August, Sunni scholars at al-Azhar University in Cairo issued a statement warning of "dangerous consequences" if Qur'ans were burned. U.S. President Obama condemned the plan saying it would endanger the lives of U.S. troops abroad. American Muslims responded by saying they would celebrate September 11, 2010 as 'love Jesus day' emphasizing the fact that Jesus is believed to be a messenger of God in Islam. 'Freedom of Religion' does not necessitate an individual to assault, despise or hate other religion... Isn't there a law in US or Britain that prohibits that? And why wasn't Terry Jones arrested and prosecuted??
