FREEDOM OF SPEECH / FREEDOM OF EXPRESSION

Freedom of speech is the freedom to speak without censorship and/or limitation. The synonymous term freedom of expression is sometimes used to indicate not only freedom of verbal speech but any act of seeking, receiving and imparting information or ideas, regardless of the medium used [United Nations, 1966, 1976]. The right to freedom of speech is recognized as a human right under Article 19 of the Universal Declaration of Human Rights and recognized in international human rights law in the International Covenant on Civil and Political Rights (ICCPR). The ICCPR recognizes the right to freedom of speech as "the right to hold opinions without interference. Everyone shall have the right to freedom of expression". Furthermore freedom of speech is recognized in European, inter-American and African regional human rights law [United Nations, 1966, 1967]. Freedom of speech, or the freedom of expression, is recognized in international and regional human rights law. The right is enshrined in Article 19 of the International Covenant on Civil and Political Rights, Article 10 of the European Convention on Human Rights, Article 13 of the American Convention on Human Rights and Article 9 of the African Charter on Human and Peoples' Rights [Andrew Puddephatt & Hodder Arnold, 2005; Kumar, Ambika, 2006].

In Islamic ethics freedom of speech was first declared in the Rashidun period by the caliph Umar in the 7th century. In the Abbasid Caliphate period, freedom of speech was also declared by al-Hashimi (a cousin of Caliph al-Ma'mun) in a letter to one of the religious opponents he was attempting to convert through reason.

According to George Makdisi and Hugh Goddard, "the idea of academic freedom" in universities was "modelled on Islamic custom" as practiced in the medieval Madrasah system from the 9th century. Islamic influence was "certainly discernible in the foundation of the first deliberately-planned university" in Europe [Boisard, Marcel A., 1980].

KUCHING, Dec 28 — Tongues are wagging over Sarawak federal minister Datuk Joseph Entulu Belaun’s recent marriage to a woman 34 years his junior, after photos of their wedding were posted on social media.
A number of Sarawakians across several social media platforms were generally supportive and congratulated the 61-year-old minister in the Prime Minister’s Department over his marriage last Saturday to 27-year old Jacklyne Anthony, but others found their match incredulous.
“We can only wish them a happy marriage. Maybe, they have their first baby next year,” said Facebook user Michael Moh.

Loti Kong said the age gap is no barrier to a happy married life while Eldric Wong remarked that Entulu is still strong in performing his duties as a husband.
Tiffany Myra remarked that Entulu is old enough to be Jacklyne’s “apai” (father) while Mark Kadir reckoned that the minister’s new mother-in-law could be far younger than him.
“She can call him uncle,” Kadir said in jest.
This is Entulu’s third marriage, after his earlier two ended in divorce. According to a close friend of the family who declined to be named, Entulu has two sons and a daughter from his first marriage.
According to the same friend, Entulu divorced from his second wife earlier this year. His current wife, Jacklyne is understood to work in a kindergarten and this is her first marriage.
The Selangau MP who is also Parti Rakyat Sarawak (PRS) deputy president tied the knot with Jacklyne in a garden ceremony witnessed by family members, relatives and close friends which was followed by a dinner reception at a hotel in Mukah.
Among those present at the wedding dinner were Sarawak Assistant Minister of Native Adat and Penan Affairs Datuk John Sikie, political secretary to Sarawak Chief Minister, Dr Richard Will Uban, political secretary in the Prime Minister’s Department Adriana Chumang Nyambong.
Another notable Sarawak political personality in a May-December marriage is former chief minister-turned-Governor Tun Abdul Taib Mahmud, who at 74 years old, married 30-year old Syrian Ragad Waleed Al -Kurdi, in 2010.

Datuk Seri Mahmud Abu Bekir Abdul Taib's lawyer today questioned the basis for the businessman's ex-wife, Shahnaz Majid, seeking a RM100 million muta'ah (conciliatory payment) claim.
The lawyer, Datuk Seri Zainul Rijal Abu Bakar told the Shariah High Court this was because Shahnaz was the one that had chosen to live separately for 10 years, away from Mahmud Bekir.
He said Shahnaz, as a plaintiff, could have filed for divorce once she started living separately in 1999.
"Living apart for 10 years is also 'contributory' by the plaintiff herself.
He said the plaintiff had instead waited for 10 years and only now had sought conciliatory payment.
Zainul also disputed the amount of RM100 million as claimed by Shahnaz.
"What is the justification that the RM100 million is fair and in accordance with Islamic law?
"The mechanism and method of calculation was not given specifically to the court," he said before Judge Mohammed Abdul Karim Wahab.
Shahnaz's lawyer, Akbardin Abdul Kader during trial on November 17, had said that the amount is not strange because Mahmud Bekir is worth between RM916 million and RM1.334 billion.
He said Mahmud Bekir's expenses reaches hundreds of thousands of ringgit per month.
The judge later set the trial to resume on January 28 next year to hear the response from Shahnaz's lawyer.
He also announced that the decision for this case will be presented on March 10.
On May 11, 2011, the Shariah High Court confirmed the divorce between Mahmud and Shahnaz.
The couple were married on January 9, 1992 and have a son named Raden Murya.
The RM100 million conciliatory payment suit by Shahnaz, who is the elder sister of singer Datuk Sheila Majid, has attracted attention as it is expected to expose former Sarawak chief minister Tun Abdul Taib Mahmud's wealth. – December 22, 2015.

Russia's Putin signs law allowing to overthrow human rights court verdicts





MOSCOW (Reuters) - Russian President Vladimir Putin has signed a law allowing the Constitutional Court of Russia to decide whether to fulfil or not the decisions of international human rights courts.
The law, published on Tuesday on the official government portal of legislative information, enables the Russian high court to overthrow decisions of the Strasbourg-based European Court of Human Rights (ECHR).

WASHINGTON (AP) — Boxing legend Muhammad Ali on Wednesday criticized Republican presidential front-runner Donald Trump's proposal to ban Muslims from entering the United States, calling on Muslims "to stand up to those who use Islam to advance their own personal agenda."
Ali, one of the most famous Muslims in the world, issued a statement saying, "True Muslims know that the ruthless violence of so called Islamic Jihadists goes against the very tenets of our religion."
He added, "I believe that our political leaders should use their position to bring understanding (and not create more chaos, or perplexity for their own selfish political agenda)  about the religion of Islam and clarify that these misguided murderers have perverted people's views on what Islam really is."
Ali's statement Wednesday, first reported by NBC News, did not identify Trump by name but was directed at "presidential candidates proposing to ban Muslim immigration to the United States."
"They have alienated many from learning about Islam," Ali wrote.
President Barack Obama, in a televised address to the nation Sunday night, called on Americans to reject discrimination, saying, "Muslim Americans are our friends and our neighbors, our co-workers, our sports heroes."
On Twitter early Monday, Trump asked, "What sport is he talking about, and who?" — even though Trump has met Ali several times, and even received an award named after the former heavyweight champion in 2007.
The 73-year-old Ali, who was born Cassius Clay, converted to Islam and changed his name in 1964.
Another Muslim sports icon, basketball Hall of Famer Kareem Abdul-Jabbar, weighed in Wednesday with an essay on Time.com. He described Trump as the Islamic State group's "greatest triumph," a candidate who "preys on the fears of the public, doing ISIS's job for them."
Abdul-Jabbar wrote that Trump's claims "have elevated him to the level of a James Bond super-villain. And like those villains, he is doomed to failure."
Also Wednesday, Detroit Lions running back Ameer Abdullah, who is Muslim, spoke with reporters about Trump's proposal.
"When you have someone like him say some things — he has a very large following — it's kind of disappointing from my perspective," Abdullah said. "I just encourage everyone to educate yourself before you take a stance on something that you may not really know about."

KUALA LUMPUR 6 Dis. - Selepas mencadangkan pemansuhan Jabatan Kemajuan Islam Malaysia (Jakim), kumpulan bekas penjawat awam, G25 pula mahu penubuhan sebuah jawatankuasa perunding bagi membincangkan untuk meminda atau memansuhkan beberapa undang-undang syariah.

Antara yang dicadang untuk dimansuhkan ialah hukuman terhadap perbuatan berkhalwat yang didakwa melanggar hak kebebasan seseorang seperti termaktub di dalam Perlembagaan.
Jurucakap G25, Datuk Noor Farida Ariffin berkata, dengan berpandukan pada prinsip Perlembagaan, kumpulan tersebut menentang sebarang hukuman terhadap perbuatan khalwat jika dilakukan di rumah persendirian kerana itu adalah hak dan privasi setiap individu.
Menurutnya, perbuatan khalwat di tempat peribadi adalah dosa peribadi antara pelakunya dengan Allah kecuali jika dilakukan di kawasan awam, namun Malaysia adalah satu-satunya negara yang menjatuhkan hukuman terhadap kesalahan itu.

“Ini bertentangan dengan Islam. Apa orang buat di dalam rumah sendiri, anda tidak boleh ketuk pintu pada pukul 3 pagi dan menahan mereka, ini bertentangan dengan prinsip perundangan Islam, dosa peribadi adalah antara diri sendiri dengan Allah.

“Anda boleh masuk neraka atau tidak, atau apa sahaja tetapi bukan urusan undang-undang menghukum anda ke dalam penjara kerana melakukannya secara privasi di rumah, bukan taman awam,” tegasnya dalam sidang akhbar selepas Forum Islam Dalam Demokrasi Berparlimen di bangunan Persatuan Alumni Universiti Malaya (PAUM) hari ini.

Yang turut hadir, Penasihat G25, Tan Sri Mohd. Sheriff Mohd. Kassim dan Pengerusi Jawatankuasa Penganjur Forum, Datuk M. Redzuan Kushairi.
Noor Farida berkata, pelaksanaan undang-undang syariah menjadi masalah apabila ia melanggar Perlembagaan sehingga menjadikan dosa peribadi seseorang sebagai satu kesalahan jenayah.
“Bidang kuasa jawatankuasa perunding ini adalah untuk melihat jika sesungguhnya undang-undang itu melanggar Perlembagaan, mereka akan mencadangkan ia dimansuhkan atau dipinda,” tegasnya.

Tambahnya, G25 akan mendapatkan kerjasama dan penglibatan daripada semua NGO dalam membincangkan perkara tersebut termasuk kemungkinan memohon dana kerajaan untuk memudahkan pergerakan mereka. Sementara itu, M. Redzuan berkata, jawatankuasa tersebut akan melakukan kajian menyeluruh untuk ‘memperbetulkan’ beberapa perkara di dalam undang-undang syariah yang telah melangkaui sempadan Perlembagaan.

“Ini akan melibatkan masyarakat dan orang ramai, mereka akan mengkaji undang-undang syariah dan sivil untuk melihat di mana bahagian yang pelaksanaan syariah ini melampaui Perlembagaan,” jelasnya.

Timbalan Menteri di Jabatan Perdana Menteri, Datuk Dr. Asyraf Wajdi Dusuki menyifatkan tuduhan kumpulan tersebut tidak berasas tanpa meneliti laporan yang dikeluarkan oleh Jabatan Audit Negara.
Katanya, sehubungan itu, pihaknya bersedia sedia mengadakan pertemuan dan bermuzakarah dengan mana-mana pihak yang tidak berpuas hati dalam segala isu berkenaan agensi tersebut demi pembangunan Islam di negara ini.
“Jakim memerlukan penglibatan pelbagai pihak bagi mengadakan perbincangan secara terbuka untuk mengetahui segala kelemahan dan penambahbaikan yang perlu dilakukan oleh agensi berkenaan.
“Kami tidak mengatakan kami sempurna dan tiada cacat cela. Jika mereka ikhlas mereka harus tampil dan beritahulah masalah atau sebarang isu secara terbuka. Jangan pula kebencian kepada rakyat de­ngan melemparkan pelbagai tuduhan dan tohmahan yang akhirnya akan merosakkan institusi yang berperanan memartabatkan Islam,” katanya.
Beliau berkata demikian ketika ditemui selepas merasmikan majlis perasmian Wacana Eksekutif Indeks Syariah Malaysia di sini hari ini.
Yang turut hadir Yang Dipertua Yayasan Dakwah Islamiah (Yadim), Dr. Yusri Mohamad; Timbalan Pengarah Institut Pengurusan dan Penyelidikan Fatwa Sedunia (INFAD), Universiti Sains Islam Malaysia (USIM) Dr. Ahmad Wifaq Mokhtar dan Rektor Universiti Islam Antarabangsa Malaysia (UIAM), Datuk Seri Dr. Zaleha Kamaruddin.
Sementara itu, Asyraf Wajdi menegaskan, peruntukan yang diterima oleh Jakim telah digunakan bagi membangunkan serta memperkasa institusi Islam di negara ini.


“Kita memperuntukkan hampir RM700 juta untuk diberikan kepada imam, guru agama serta institusi pendidikan Islam setiap tahun. Jumlah tersebut sepatutnya perlu ditambah memandangkan kos sara hidup yang semakin tinggi.
“Selain itu, kita gunakan peruntukan yang telah diberikan oleh kerajaan untuk mengurus dan menjaga hal ehwal Islam dalam pelbagai aspek termasuk isu halal. Ia masih dikira tidak mencukupi kerana kita hanya mempunyai 100 pegawai untuk membuat pemantauan di seluruh negara,” katanya.

Dalam pada itu kata Asyraf Wajdi, pihaknya kini sedang giat menjalankan kajian berhubung indeks syariah di negara ini bersama beberapa universiti di negara ini. Katanya, pihaknya turut menggiatkan pelbagai usaha untuk memberi penjelasan berkaitan pendekatan, implikasi dan kesan pelaksanaannya dalam konteks pembangunan Islam.
