FREEDOM OF SPEECH / FREEDOM OF EXPRESSION

Freedom of speech is the freedom to speak without censorship and/or limitation. The synonymous term freedom of expression is sometimes used to indicate not only freedom of verbal speech but any act of seeking, receiving and imparting information or ideas, regardless of the medium used [United Nations, 1966, 1976]. The right to freedom of speech is recognized as a human right under Article 19 of the Universal Declaration of Human Rights and recognized in international human rights law in the International Covenant on Civil and Political Rights (ICCPR). The ICCPR recognizes the right to freedom of speech as "the right to hold opinions without interference. Everyone shall have the right to freedom of expression". Furthermore freedom of speech is recognized in European, inter-American and African regional human rights law [United Nations, 1966, 1967]. Freedom of speech, or the freedom of expression, is recognized in international and regional human rights law. The right is enshrined in Article 19 of the International Covenant on Civil and Political Rights, Article 10 of the European Convention on Human Rights, Article 13 of the American Convention on Human Rights and Article 9 of the African Charter on Human and Peoples' Rights [Andrew Puddephatt & Hodder Arnold, 2005; Kumar, Ambika, 2006].

In Islamic ethics freedom of speech was first declared in the Rashidun period by the caliph Umar in the 7th century. In the Abbasid Caliphate period, freedom of speech was also declared by al-Hashimi (a cousin of Caliph al-Ma'mun) in a letter to one of the religious opponents he was attempting to convert through reason.

According to George Makdisi and Hugh Goddard, "the idea of academic freedom" in universities was "modelled on Islamic custom" as practiced in the medieval Madrasah system from the 9th century. Islamic influence was "certainly discernible in the foundation of the first deliberately-planned university" in Europe [Boisard, Marcel A., 1980].

KUALA LUMPUR, May 20 — The attorney general (AG) will be mounting a lawsuit to compel the National Feedlot Corporation Sdn Bhd (NFCorp) to cough up RM253,618,455.03 which it owes the federal government, Finance Minister Lim Guan Eng said today.
Details of this latest development, however, will only be made available at a later date.
In a statement today, Lim said that the NFCorp had received a loan on January 9, 2008 to the tune of RM250 million from the federal government at an interest rate of 2 per cent, under a 20-year loan repayment three-year grace period.
The minister said that the loan was secured by a debenture, which was signed along with the loan agreement on December 6, 2007
“Based on the due diligence report by the accounting firm PwC, the Board of Directors of NFCorp for the period between December 6, 2007 and December 31, 2011 consisted of Datuk Mohamad Salleh Ismail and his children, Izran Salleh, Izmir Salleh, Izzana Salleh, as well as representatives from the federal and state governments.
Mohamad Salleh is the husband to former Umno Wanita head and former women, family and community development minister, Tan Sri Shahrizat Abdul Jalil.
“However, the latest Companies Commission of Malaysia (CCM) search conducted as of May 17, 2019 only listed Datuk Salleh Ismail as the sole director of NFCorp, and two company secretaries.
“Based on the Complete Statement of Federal Government Loans as of 30 April 2019 from the Accountant-General’s Department of Malaysia, the outstanding loan amount by NFCorp to the federal government is RM253,618,455.03, which includes interest and late interest charges as of April 30, 2019,” Lim said.
He explained that of the said sum, RM110,840,854.28 is the amount due for repayment to the federal government as of April 30, 2019, consisting of loan principal arrears of RM81,987,629.65, loan interest of RM22,967,131.55 and late interest charges of RM5,886,093.08.
Lim added that on September 4, 2014, a Notice of Declaration of Event of Default in accordance with Clause 14 of the Loan Agreement between the government and NFCorp was issued to the company.
“The Ministry of Finance has decided to seek full repayment of the loan to NFCorp and this matter was referred to the Attorney General’s Chambers on August 29, 2018 for further action. The Attorney General’s Chambers is currently looking into the matter, and will announce the latest development when available,” he added.
In July 2013, then second finance minister Datuk Seri Ahmad Husni Hanadzlah said the government had received RM79.9 million from the sum loaned to NFCorp for its NFC project, through the Anti-Money Laundering and Anti-Terrorism Financing Act 2001.
He said the government also sealed NFCorp’s assets worth RM23.3 million, namely two pieces of land in Putrajaya, two units of real estate in Menerung Township Villa and three plots of land in Gemas.
NFCorp was formed in 2007 with its subsidiary, National Feedlot Centre, to monitor, guide and train contract farmers to expand the local beef industry and move away from the government’s dependency on imported meat.
NFCorp took out a RM250 million loan from the Finance Ministry as capital to start its operations aimed at satisfying 30 per cent of the local demand for beef.
Following its formation, NFCorp found itself embroiled in a scandal, after Mohamad Salleh was charged with two counts of criminal breach of trust involving some RM49.7 million.
But in November 2015, he was acquitted.

Pogba berada kota suci itu bersama beberapa rakan termasuk Kurt Zouma yang beraksi bersamanya dalam skuad Perancis.
Ini bukan kali pertama Pogba berkunjung ke Makkah sebaliknya pernah melakukannya pada dua musim sebelum ini.
Pemain yang dilaporkan bakal meninggalkan Old Trafford itu turut memuat naik dua keping gambar dalam akaun sosial media Instagram miliknya.
"Jangan lupakan perkara penting dalam hidup," katanya menerusi gambar yang dimuatnaik.
United menamatkan musim ini dengan kekecewaan selepas tunduk 0-2 kepada Cardiff City untuk menamatkan saingan musim ini di tangga keenam serta terlepas slot ke Liga Juara-Juara musim depan.

Despite the prime minister claiming that some civil servants are out to undermine Pakatan Harapan, one of his closest advisers has called on the government to trust them if it wished to ensure political longevity.
In an interview with the South China Morning Post, Daim Zainuddin went so far as to state that the government would be "dead" if it did not begin working with the country's more than 1.6 million civil servants.
"Now you are in government. When you are in government, you have to deliver. You cannot deliver by yourself. The civil servants are the implementers, not you.
"You plan policies, then you say (to the civil servants), take over. 
(When) you don’t trust them, they just sit down," he was quoted as saying in the interview published today.
The former chairperson of the Council of Eminent Persons claimed that many civil servants have expressed their unhappiness over the extent of political appointments in ministries.


While not dismissing Putrajaya's claims of sabotage, including by Prime Minister Dr Mahathir Mohamad, Daim noted the trust deficit must be worked on.
Civil servants, he believes, are likely to back the government of the day, even if they had only served one government all this while.
"That I don’t know (sabotage claims). But you have to work with (the civil service). Without them... you are dead.
"The civil servants have been coming to see me. They say 'Oh, minister doesn’t trust me...' and they (the political appointees) run the ministry," he said.
"How can they run the ministry? They are outsiders. I have been telling the ministers the civil servants have been there since the British. When the British came here, they brought the civil service.
"And you try now to discard them? You cannot."
'Civil servants also voters'
Daim, who served as finance minister during Mahathir’s first tenure, pointed out that civil servants and their families are also voters.


“I have been telling them, whether you like it or not, there are 1.6 million civil servants. And we are paying them every day. 
"Can you imagine? One, plus a wife. Plus one child. (There are votes there, so get them on your side or) you are in trouble. You know?” he was quoted as saying.

Daim's remarks come just two days after Mahathir said that certain quarters, including those in the civil service, are unhappy with the Harapan administration due to its efforts to combat corruption.
"There are some who feel the government is not as good as the previous one because this government does not allow bribes," he had said.
"There are some who feel this government should not continue, but (the country) should go back to being a corrupt government which benefits them."
Mahathir had previously claimed that a culture of sabotage existed among civil servants in explaining the government's move to "clean up" its agencies and departments.
In March, his deputy Dr Wan Azizah Wan Ismail also reminded civil servants of different political affiliations not to sabotage the government, but serve the people.

KUALA LUMPUR - Impian bekas Timbalan Perdana Menteri, Datuk Seri Ahmad Zahid Hamidi menunaikan umrah lebur apabila Mahkamah Tinggi Kuala Lumpur hari ini menolak permohonannya untuk mendapatkan pasport antarabangsa miliknya.


Keputusan itu dibuat Hakim Collin Lawrence Sequerah selepas mendengar hujahan permohonan dan pihak pendakwaan.

Dalam penghakimannya, Collin memberi alasan permohonan Zahid ditolak memandangkan Ahli Parlimen Bagan Datuk itu berdepan kesalahan serius.


"Walaupun ibadah itu dituntut bagi umat Islam semasa bulan puasa tetapi ia bukanlah perkara wajib untuk ditunaikan. Lagipun, tiada keperluan mendesak untuk pemohon mengerjakan umrah," katanya.

Terdahulu, peguam Hisham Teh Poh Teik berhujah, anak guamnya dijadualkan berangkat ke Tanah Suci pada 9 Mei sehingga 3 Jun dan akan menyerahkan kembali pasport tersebut keesokan harinya.

Peguam, Datuk Ahmad Zaidi Zainal yang turut mewakili Ahmad Zahid berkata, adalah menjadi kebiasaan bagi anak guamnya mengerjakan umrah pada bulan Ramadan sejak 30 tahun lalu.

Timbalan Pendakwa Raya, Ahmad Sazilee Khairi membantah permohonan tersebut dengan alasan tertuduh berisiko untuk melarikan diri. Pada prosiding itu, mahkamah turut menetapkan 18 hingga 22 November, 2 hingga 6 Disember dan 9 hingga 13 Disember sebagai tarikh perbicaraan melibatkan 47 pertuduhan yang dihadapi Ahmad Zahid

COMMENTS: 


Policemen have been known to abuse their power and positions, some even ask for bribery and extortion. And they are some who even sit lazily at traffic light junctions to look for easy targets to fulfill their KPIs (Key Performance Indicators), instead of catching gangsters and hooligans. Its long overdue that the IPCMC (Independent Police Complaints and Misconduct Commission) be setup to discipline and punished the few irresponsible cops!

KUALA LUMPUR 28 Julai - Ketua Polis Daerah (KPD) Gombak, Asisten Komisioner Ali Ahmad hari ini diarah bertukar serta merta ke Pusat Latihan Polis (Pulapol) Air Hitam, Jempol, Negeri Sembilan sebagai Komandan.
Difahamkan, arahan pertukaran itu dipercayai ada kaitan dengan operasi membanteras judi haram di 10 premis yang menjalankan kegiatan perjudian di Jalan Bandar Rawang 3, Bandar Baru Rawang dekat sini malam tadi.
Operasi yang diketuai sendiri Ketua Polis Negara, Tan Sri Mohamad Fuzi Harun itu turut me­lakukan rampasan peralatan perjudian bernilai jutaan ringgit selain menahan 113 individu dewasa yang terdiri daripada penjaga premis dan pelanggan serta seorang kanak-kanak perempuan berusia 10 tahun.
Turut bersama dalam operasi tersebut Pengarah Jabatan Siasatan Jenayah Bukit Aman, Datuk Seri Wan Ahmad Najmuddin Mohd dan Ketua Polis Selangor, Datuk Mazlan Mansor.
Dalam pada itu, tempat Ali akan diisi Komandan Pulapol Air Hitam, Asisten Komisioner Samsor Maarof.
Mohamad Fuzi gagal dihubungi bagi mendapatkan penjelasan me­ngenai pertukaran tersebut .
