FREEDOM OF SPEECH / FREEDOM OF EXPRESSION

Freedom of speech is the freedom to speak without censorship and/or limitation. The synonymous term freedom of expression is sometimes used to indicate not only freedom of verbal speech but any act of seeking, receiving and imparting information or ideas, regardless of the medium used [United Nations, 1966, 1976]. The right to freedom of speech is recognized as a human right under Article 19 of the Universal Declaration of Human Rights and recognized in international human rights law in the International Covenant on Civil and Political Rights (ICCPR). The ICCPR recognizes the right to freedom of speech as "the right to hold opinions without interference. Everyone shall have the right to freedom of expression". Furthermore freedom of speech is recognized in European, inter-American and African regional human rights law [United Nations, 1966, 1967]. Freedom of speech, or the freedom of expression, is recognized in international and regional human rights law. The right is enshrined in Article 19 of the International Covenant on Civil and Political Rights, Article 10 of the European Convention on Human Rights, Article 13 of the American Convention on Human Rights and Article 9 of the African Charter on Human and Peoples' Rights [Andrew Puddephatt & Hodder Arnold, 2005; Kumar, Ambika, 2006].

In Islamic ethics freedom of speech was first declared in the Rashidun period by the caliph Umar in the 7th century. In the Abbasid Caliphate period, freedom of speech was also declared by al-Hashimi (a cousin of Caliph al-Ma'mun) in a letter to one of the religious opponents he was attempting to convert through reason.

According to George Makdisi and Hugh Goddard, "the idea of academic freedom" in universities was "modelled on Islamic custom" as practiced in the medieval Madrasah system from the 9th century. Islamic influence was "certainly discernible in the foundation of the first deliberately-planned university" in Europe [Boisard, Marcel A., 1980].

KUALA LUMPUR, April 15 — A total of 14,922 individuals have been detained to date for flouting the movement control order (MCO) enforced nationwide since last month.
Federal Criminal Investigations Department director Commissioner Datuk Huzir Mohamed said the arrests comprised those during phase one of the MCO from March 18 until March 31 and phase two of the MCO from April 1 until April 14.
“A total of 3,627 people were picked up during phase one, while 11,295 people were nabbed during phase two.
“Of the total arrested, 5,830 people have been prosecuted in court,” he said during a press conference at Bukit Aman here.
He also revealed that from the total arrested, six individuals were repeat offenders.
Huzir also stressed that the police will not compromise anymore during the third phase of the MCO, which took effect from today, as there are still those who continue to disregard the MCO.
“We will not hesitate to take action during the third phase of the MCO. We will arrest and charge (you) in court. We will open an investigation paper and charge the offenders.
“No more compounds. No more compounds, I repeat,” he said.
According to Huzir, many of those arrested were unable to provide a reasonable excuse as to why they had left their homes during the MCO.
“The order is perfectly clear, only those who have permission and within the essential service or emergencies are allowed to move around.
“Stern action during the third phase will be enforced. This is to break the Covid-19 chain of infection as quickly as possible,” he said.
This follows the announcement made by Senior Minister Datuk Seri Ismail Sabri Yaakob yesterday, saying the police will be focusing less on issuing compound notices to flouters of the MCO and will now book them to be brought straight to court, seeing how many are still defying the MCO.
Ismail Sabri said the decision to charge violators directly instead of issuing compounds was due to the burden the latter added to the enforcement of the MCO.
On April 8, Federal Internal Security and Public Order Department (KDNKA) director Datuk Seri Acryl Sani Abdullah Sani said that MCO violations would automatically result in a fixed RM1,000 compound instead of arrest and prosecution.
Acryl explained that the move was to address concerns that custodial sentences for MCO violations created the risk of exposing the prison population to Covid-19.
Malaysia entered its third phase of the MCO beginning today for a period of two weeks until April 28.

KUALA LUMPUR, April 11 — Police detained 1,095 individuals for defying the movement control order (MCO) yesterday, Senior Minister Datuk Seri Ismail Sabri Yaakob said.
In a press conference today, Ismail Sabri said that the MCO compliance rate remains unchanged at around 97 per cent.
“The Royal Malaysia Police (RMP) yesterday detained 1,095 individuals because they violated the MCO, whereby 815 individuals were issued compounds, 242 remanded and 38 were given police bail.
“The total cumulative detentions for MCO violations from March 18 till April 10, 2020 are 7,759 individuals,” Ismail said, adding that 373 people have been charged in court to date, for violating the order.
He said yesterday the police and the Armed Forces held 779 roadblocks nationwide, with checks done on 490,249 vehicles, in addition to 47,900 sudden checks.
About 5,028 premises were also checked by the authorities yesterday.

JANGKITAN Covid-19 boleh berlaku daripada manusia kepada haiwan namun kebarangkalian terjadinya kejadian seumpama amat rendah.
Dekan Fakulti Perubatan Veterinar Universiti Putra Malaysia Profesor Dr Abdul Rahman Omar berkata, banyak faktor berkaitan manusia, haiwan dan persekitaran memainkan peranan dalam hal ini.
“Boleh berlaku kemungkinan virus Covid-19 daripada manusia dipindahkan ke haiwan peliharaan seperti anjing dan kucing. Bagaimanapun kemungkinan untuk ini berlaku adalah sangat-sangat rendah.
“Haiwan yang dijangkiti mungkin tidak menunjukkan tanda jangkitan atau mengalami tanda jangkitan yang rendah.
“Apa yang penting risiko untuk haiwan yang dijangkiti bagi menyebarkan virus berkenaan kepada manusia adalah sangat-sangat rendah,” katanya ketika dihubungi menerusi WhatsApp, hari ini.
Justeru, katanya, orang ramai tidak perlu risau tetapi adalah penting mengambil langkah berjaga-jaga sekiranya disahkan positif Covid-19 iaitu perlu mengasingkan diri daripada orang lain termasuk haiwan pelihara mereka.
Media antarabangsa melaporkan pihak berkuasa kesihatan Belgium melaporkan terdapat satu kes Covid-19 membabitkan seekor kucing yang dijangkiti daripada tuannya yang juga seorang wanita.
Kes berkenaan adalah pertama seumpamanya dilaporkan membabitkan kucing dan Ketua Bahagian Penyakit Berjangkit Institut Kesihatan Belgium Steven van Gucht berkata, ia disifatkan kes terpencil.
Terdahulu, pihak berkuasa Hong Kong dilaporkan berkata, dua anjing dikesan positif Covid-19 di negara berkenaan

‘Stop sending MCO violators to jail’ !!


COMMENTS:

Police officers in their zeal to enforced the laws, sometimes simply catch everyone they see on the roads, including teenagers and young people, who naturally go out for sunshine and walk... Wrong time and wrong place, so they were caught and charge in courts?! Fine of RM1000 and imprisonment up to 6 months? (more than the MCO or restriction movement control periods of 14 to 28 days?).

AND/OR a fine of RM1000, whereas even a RM200-300 fine would be a lot for the B40 group. These police officers can simply give verbal warnings to scare them off, UNLESS its a repeat offenders or 'hardcore' offenders. I naturally do NOT believed in 'harsh' punishment for the PKP/MCO offenders.

The Human Rights NGOs should ensure that the police/ATM do not 'abused' or 'mis-used' their power! And the courts to use their discretion power to imposed a lesser sentences or DISMISSED the cases (if the so-called offenders have valid reasons - which was previously ignored by the police) !!

ETALING JAYA: Ketua Hakim Negara Tengku Maimun Tuan Mat menyeru hakim mahkamah menggunakan budi bicara dalam mengenakan hukuman terhadap pesalah yang melanggar Perintah Kawalan Pergerakan (PKP) dengan mengambil kira risiko penularan Covid-19 di penjara.
Pejabat Ketua Pendaftar Mahkamah Persekutuan memaklumkan semua majistret dan hakim Mahkamah Sesyen perlu mempertimbangkan masalah kesesakan di dalam penjara.
“Di samping mengambil kira peruntukan hukuman berdasarkan undang-undang yang sedia ada, masalah berkenaan risiko penularan wabak covid-19 yang bakal dihadapi oleh penjara-penjara di Malaysia boleh juga diambil pertimbangan,” kata pejabat itu dalam satu kenyataan.
Kenyataan itu juga mengesahkan badan kehakiman menerima surat daripada Ketua Pengarah Penjara Zulkifli Omar, yang mencadangkan supaya hakim menggunakan Akta Perintah Kehadiran Wajib Pesalah-Pesalah 1954 untuk memerintahkan pesalah MCO melakukan khidmat masyarakat wajib, bukannya menghantar mereka ke penjara.
Zulkifli, dalam satu surat kepada Ketua Pendaftar Mahkamah Persekutuan, Ahmad Terrirudin Mohd Salleh, berkata langkah itu bagi mengelakkan sebarang kemungkinan virus itu tersebar dalam kalangan penghuni dan kakitangan penjara.
Beliau berkata tahanan baru akan menambahkan lagi kesesakan dalam penjara dan jabatan itu juga bimbang virus itu merebak kerana status kesihatan pendatang baru tidak diketahui.
Beliau berkata penjarakkan sosial tidak dapat dikuat kuasakan dan ini memberi ancaman kepada penghuni dan kakitangan penjara sedia ada.
Melanggar PKP boleh dihukum sehingga 6 bulan penjara, atau denda sehingga RM1,000, atau kedua-duanya.
Sementara itu, Presiden Majlis Peguam Salim Bashir berkata peringatan Tengku Maimun kepada kakitangan bawahannya tepat pada masanya kerana hakim perbicaraan mempunyai budi bicara untuk menjalankan hukuman, berdasarkan undang-undang yang ada.
Salim berkata mahkamah boleh mengenakan denda minimum, penjara sehari atau mengikat mereka untuk menunjukkan tingkah laku yang baik.

‘Stop sending MCO violators to jail’


KUALA LUMPUR: The judiciary has been asked to stop jailing violators of the movement control order (MCO) to avoid overcrowding in prisons, which could lead to the spread of the coronavirus.

Chief Registrar’s Office corporate communications unit director Suzarika Sahak confirmed that Federal Court Chief Registrar Ahmad Terrirudin Mohd Salleh had received a letter from the Prisons Department regarding the matter.

For now, she said the Chief Registrar’s Office had taken note of the letter.

Prisons Department director-general Datuk Seri Zulkifli Omar is said to have signed the letter, saying social distancing was “impossible” in prisons due to overcrowding.

In the letter, Zulkifli said 378 people had been sent to prison as of April 1 for violating the MCO.

“Apart from adding on to the already crowded prisons, the Prisons Department is concerned that they could become the source of Covid-19 outbreaks there as their health status is not known.

“The Prisons Department is of the opinion that it will become a major issue if there is a Covid-19 outbreak in prison as social distancing is impossible there and could spread uncontrollably, threatening the lives of prisoners and prison staff,” the department was quoted as saying by a news portal.

Zulkifli reportedly recommended that the courts mete out community service punishments under the Offenders Compulsory Attendance Act.

The MCO has been in effect since March 18 in a bid to curb the spread of Covid-19.

Under Rule 3(1) of the Prevention and Control of Infectious Diseases (Measures Within the Infected Local Areas) Regulations 2020, a person caught and convicted of violating the MCO could be fined up to RM1,000 or jailed up to six months.

When contacted, Malaysian Bar president Salim Bashir Bhaskaran said the Prisons Department had made a “valid concern and request”.

“Space constraint and the internal mechanisms that inevitably expose one to be in close contact with each other will lead to a strong likelihood of infections. Any infection among inmates will be an unimaginable catastrophe in prisons,” he added.

He said the court should be proactive and take into account the circumstances surrounding the facts of the cases in sentencing.

For instance, Salim said, community services imposed on the wrongdoers would essentially serve the purpose of the punishment, which is to teach them to be responsible and obey the law.

Alternatively, he said the court could also mete out bound-over sentences for offenders who breached the MCO.

Compounding the offence is also a viable option to prevent one from being sent to prison,” he said.

Salim noted that since the breach of MCO is not an offence involving violence, the court should exercise its judicial discretion in imposing sentences that are suitable in this period of time.

Senior criminal lawyer and author Datuk Baljit Singh Sidhu said the department made the right decision in making the request as the police and court staff were exposed to unnecessary risks with the arrests.

“The MCO offences are not a serious offence and there are other ways to deal with it. It will be total chaos if Covid-19 is spread in the prison cells,” he said.

Criminal lawyer Amer Hamzah Arshad echoed the concern over the possibility of a contagion in prisons.

“Logistics-wise, would the department be able to cope with a sudden increase of inmates and in the worst case scenario, with the spreading of the virus in prisons?” he asked.

Amer said the frontliners would be overwhelmed if such a spread happened in prisons.

“We are dealing with an unprecedented situation, so whatever sentence the court wishes to mete out, it must take this into consideration too,” he added.

513 tangkapan dalam lima hari

SEBANYAK 513 tangkapan dilakukan polis Selangor dalam tempoh lima hari pertama Perintah Kawalan Pergerakan (PKP) fasa kedua yang bermula pada 1 April lalu.
Jumlah berkenaan meningkat secara mendadak berbanding hanya tiga kes pada tempoh sama ketika PKP fasa pertama dijalankan bermula 18 hingga 22 Mac.
Jurucakap khas Op Covid-19 Selangor, Asisten Komisioner Mohd Ismail Muslim berkata, tangkapan lebih banyak dilakukan pada fasa kedua PKP kerana ia fasa lebih tegas susulan kadar pematuhan sangat rendah dalam kalangan masyarakat.
“Fasa pertama lebih kepada nasihat serta peringatan kepada masyarakat, justeru hanya tiga tangkapan dilakukan, tetapi fasa kedua kita lebih tegas.
“Kita perlu tegas untuk mengekang masyarakat daripada melakukan pergerakan tanpa alasan munasabah seterusnya menyumbang kepada peningkatan kes Covid-19,” katanya pada sidang media di Ibu Pejabat Polis Kontinjen (IPK) Selangor di Shah Alam, hari ini.
Beliau berkata, secara kumulatif sebanyak 1,225 kes tangkapan dilakukan polis Selangor sepanjang tempoh PKP yang membabitkan 1,154 lelaki serta 71 wanita.
Katanya, 57 daripada keseluruhan kes berkenaan sudah dituduh mengikut Seksyen 186 Kanun Keseksaan dan Peraturan 11 (1) Peraturan-Peraturan Pengawalan Penyakit Berjangkit (Langkah-Langkah Di Dalam Kawasan Tempatan Jangkitan) 2020.
“Dalam aspek pematuhan pula, kesedaran masyarakat meningkat apabila tahap pematuhan terhadap PKP berada pada tahan 93 peratus.
“Kesungguhan polis Selangor mengekang penularan wabak Covid-19 jelas apabila lebih 90 sekatan jalan raya diadakan selama 24 jam di seluruh negeri.
“Sekatan dijalankan di kawasan tumpuan umum serta pintu masuk lebuh raya dan laluan alternatif,” katanya.
Beliau berkata, peningkatan sekatan itu dilihat berjaya mengekang pergerakan orang ramai.

Tak perlu hukum individu langgar PKP -HAKAM !!




COMMENTS:

1- Putting these people in JAIL will result in them having Criminal Records for life.
2- With fines up to RM1000?!  (Even if fines RM300 is considered a lot for the B40 group)!
3- AND jail 6 months?! (Even if jail 1 month is MORE than the 14 days Restriction Order)
4- Why such a "heavy" punishment, just because you saw someone outside his/her house, you got angry, and quickly caught them, and charged them under Section 7(1) ?!

5- Its TIMELY that the NGOs and general public disapproved of the usage of Section 7(1) by the authority for punishing the general public.

6- Mere verbal warning is enough for First Time Offenders and the under-aged should be considered when the authority carried out their duties!


SUGGESTIONS:

1- Fines of RM200-300 should be adequate and depending on cases, and Hardcore Offenders can be fined more.
2- Simple Reminders or verbal warning should be adequate for First Time Offenders and the under-aged individuals.

Persatuan Hak Asasi Manusia Kebangsaan (Hakam) menyatakan kebimbangan dengan layanan terhadap individu yang ditangkap kerana melanggar perintah gerakan kawalan (PKP).


Presiden Hakam, Gurdial Singh Nijar, berkata mereka yang ditahan bukanlah penjenayah melainkan ahli awam biasa yang didakwa melanggar perintah itu.

"Minggu lalu, beberapa orang telah dimasukkan dalam van polis. Semuanya digari.

"Kemudian mereka ditahan reman di lokap polis dan seterusnya, didakwa di mahkamah.

"Mereka ini bukanlah penjenayah berprofil tinggi.

"Mereka adalah orang awam biasa yang ditemui di luar tempat tinggal mereka semasa PKP," katanya dalam satu kenyataan.

Gurdial menyebut contoh seorang wanita yang ditangkap, dan disita barangan peribadi, sebelum dihantar ke lokap selama beberapa hari tanpa ada yang datang untuk menjaminnya kerana tiada sesiapa yang dibenarkan untuk melawat semasa PKP.

Wanita itu dikatakan akan didenda.

"Ini adalah layanan yang keterlaluan. Saya faham ada pandangan yang yang mahu situasi kita sekarang ini berakhir dengan cepat: atas pelbagai sebab.

"Dan para ahli politik turut memberi respons kepada pandangan ini. Dan ramai yang mungkin menyokong tindakan yang keras terhadap rakyat.

"Tetapi kita tidak boleh kehilangan nilai-nilai kemanusiaan kita.

"Ada risiko nilai-nilai hak asasi kita akan semakin terhakis," katanya.

Gurdial mengulangi bahawa orang ramai masih belum terbiasa dengan PKP, justeru, menurutnya, pelaksanaan harus dilakukan dengan cara yang membantu.

"Pelaksanaan oleh pihak berkuasa harus dilihat sebagai menggalakkan agar orang ramai menerhadkan pergerakan mereka hanya untuk keperluan penting.

"Orang ramai akan berdepan kesukaran dengan sekatan ini dalam rutin hidup mereka.

"Secara ringkasnya, peraturan yang baru ini perlu dilaksanakan dengan bersifat membantu dan bukannya cara yang bersifat menghukum. Kecuali mungkin terhadap individu yang betul-betul suka melanggar perintah," katanya.

PKP yang telah berkuat kuasa sejak 18 Mac dijadual berakhir pada 14 April.

PERTUBUHAN Kebajikan Kemanusiaan Antarabangsa (Peka) menyarankan hukuman perintah khidmat masyarakat dikenakan ke atas pesalah muda yang melanggar Perintah Kawalan Pergerakan (PKP) sebagai pengajaran kepada golongan terbabit.
Presidennya, Datuk Zuhairi Ab Kadir berkata, hukuman itu dilihat lebih sesuai berbanding penjara kerana ia akan memberi kesan seumur hidup kepada pesalah juvana yang mempunyai rekod jenayah.
Menurutnya, golongan terbabit perlu diberi peluang kedua supaya tidak mengulangi kesalahan lalu dengan cara melakukan kebaikan kepada orang lain dalam tempoh tertentu.



“Saya berpendapat penjara bukanlah penyelesaian yang sesuai bagi setiap individu kerana individu terbabit mungkin menjadi harapan keluarga dan ada yang gagal membayar denda disebabkan keluarga miskin.
“Jadi pihak berkuasa sewajarnya memandang serius kesan seumur hidup kepada mereka selepas mempunyai rekod banduan kerana insiden terbabit,” katanya, hari ini.
Beliau berkata, kini jumlah mereka yang didakwa di mahkamah kerana melanggar PKP semakin meningkat, ramai pesalah muda dikenakan hukuman penjara kerana gagal menjelaskan denda.
Zuhairi berkata, mereka didakwa mengikut Peraturan 7(1) Peraturan-Peraturan Pencegahan dan Pengawalan Penyakit Berjangkit (Langkah-Langkah Di Dalam Kawasan Tempatan Jangkitan) 2020, yang memperuntukkan hukuman denda maksimum RM1,000 atau penjara tidak melebihi enam bulan atau kedua-duanya, jika sabit kesalahan.
Katanya, Rabu lalu, Jabatan Penjara Malaysia dalam satu kenyataan menyatakan seramai 378 individu kini menjalani hukuman penjara kerana melanggar PKP.
Menurutnya, tindakan meletakkan pesalah muda dalam penjara akan menjarakkan mereka dengan masyarakat dan boleh membawa impak yang negatif kepada pesalah dari segi psikologi sepanjang menjalani hukuman itu.
“Kesalahan dilakukan golongan remaja masih dianggap kecil jika dibandingkan dengan kesalahan jenayah lain yang lebih berat, saya berharap supaya mahkamah menyemak semula hukuman yang dikenakan kerana masih ada alternatif selain memenjara bagi memberi kesedaran kepada golongan terbabit.
“Bukanlah asing dalam sistem keadilan jenayah tanah air perintah khidmat masyarakat, tetapi ia perlu diperluaskan kepada pesalah lain mengikut kesesuaian.
“Hukuman berkenaan juga dapat mewujudkan ruang bagi pesalah muda membuat pemulihan akhlak sekali gus memberi faedah kepada masyarakat,” katanya.

COVID-19: 23 mengaku bersalah langgar PKP









KOTA TINGGI: Seramai 23 individu termasuk tujuh remaja bawah umur mengaku bersalah di Mahkamah Majistret di sini atas pertuduhan ingkar Perintah Kawalan Pergerakan (PKP).
Kesemua tertuduh berusia antara 15 hingga 37 tahun membuat pengakuan bersalah selepas pertuduhan dibacakan secara berasingan di hadapan Majistret Mazanah Sinin.
Mengikut kertas pertuduhan, kesemua tertuduh ditahan dalam Ops COVID-19 antara 26 hingga 28 Mac lalu.
Mereka didakwa mengikut Peraturan 7(1) Peraturan-Peraturan Pencegahan dan Pengawalan Penyakit Berjangkit (Langkah-Langkah Di Dalam Kawasan Tempatan Jangkitan) 2020, yang memperuntukkan hukuman denda maksimum RM1,000 atau penjara tidak melebihi enam bulan atau kedua-duanya, jika sabit kesalahan.
Mahkamah mengarahkan 16 daripada tertuduh membayar denda sebanyak RM1,000 dan boleh dikenakan penjara selama 15 hari sekiranya gagal membayar denda.
Bagi kes tujuh remaja bawah umur, mahkamah membenarkan jaminan RM1,000 bagi setiap seorang dan perlu membuat laporan akhlak dengan Jabatan Kebajikan Masyarakat (JKM).
Prosiding bagi kumpulan kanak-kanak itu akan dijalankan 11 Mei yang tertakluk di bawah bidang kuasa Mahkamah Kanak-Kanak.
Pendakwaan dilakukan Timbalan Pendakwa Raya Muhammad Qaiyyum Ramlan dan Putera Amirool Faez Suhasi.
