FREEDOM OF SPEECH / FREEDOM OF EXPRESSION

Freedom of speech is the freedom to speak without censorship and/or limitation. The synonymous term freedom of expression is sometimes used to indicate not only freedom of verbal speech but any act of seeking, receiving and imparting information or ideas, regardless of the medium used [United Nations, 1966, 1976]. The right to freedom of speech is recognized as a human right under Article 19 of the Universal Declaration of Human Rights and recognized in international human rights law in the International Covenant on Civil and Political Rights (ICCPR). The ICCPR recognizes the right to freedom of speech as "the right to hold opinions without interference. Everyone shall have the right to freedom of expression". Furthermore freedom of speech is recognized in European, inter-American and African regional human rights law [United Nations, 1966, 1967]. Freedom of speech, or the freedom of expression, is recognized in international and regional human rights law. The right is enshrined in Article 19 of the International Covenant on Civil and Political Rights, Article 10 of the European Convention on Human Rights, Article 13 of the American Convention on Human Rights and Article 9 of the African Charter on Human and Peoples' Rights [Andrew Puddephatt & Hodder Arnold, 2005; Kumar, Ambika, 2006].

In Islamic ethics freedom of speech was first declared in the Rashidun period by the caliph Umar in the 7th century. In the Abbasid Caliphate period, freedom of speech was also declared by al-Hashimi (a cousin of Caliph al-Ma'mun) in a letter to one of the religious opponents he was attempting to convert through reason.

According to George Makdisi and Hugh Goddard, "the idea of academic freedom" in universities was "modelled on Islamic custom" as practiced in the medieval Madrasah system from the 9th century. Islamic influence was "certainly discernible in the foundation of the first deliberately-planned university" in Europe [Boisard, Marcel A., 1980].

Norway, Islam and the threat of the West

Dismissing this murderous act as the work of "a lone madman" ignores a more detailed study of the killer's motivation - Ibrahim Hewitt, Last Modified: 23 July 2011 14:52

After Oslo was rocked by a deadly explosion and a shooting massacre killed dozens on Utoya Island, initial speculation blamed 'Islamic terror groups' - revealing fears and prejudices inherent to many in the West [REUTERS]

A few years ago, the respected Cambridge scholar T J Winter, also known by his Muslim name of Abdal Hakim Murad, gave a fascinating lecture to Humanities staff and students at the University of Leicester. The title was "Islam and the threat of the West", turning on its head the more usual - then and now - "Islam and the threat to the West".

It was a novel approach which, in a nutshell, illustrated that, historically, aggression has been directed more from Europe to the Muslim world than the other way round. His evidence for such a view was impeccably sourced.

I thought about Abdal Hakim's talk this morning as I read the reports coming in of the dreadful bombing and shooting in Norway wherein, of course, there was speculation that these two events were "Islamic-terror related". No doubt we will learn more over the coming days, but the early signs are, in fact, that the perpetrator was a "blond, blue-eyed Norwegian" with "political traits towards the right, and anti-Muslim views". Not surprisingly, the man's intentions were neither linked to these "traits", nor to his postings on "websites with Christian fundamentalist tendencies". Any influence "remains to be seen"; echoes of Oklahoma 1995.

Interestingly, this criminal is described by one unnamed Norwegian official as a "madman". He may well be, but this is one way that the motivations for heinous crimes can be airbrushed out of the story before they have the chance to take hold in the popular imagination.

Closing the book

In 1969, for example, an Australian Jew who set fire to Al-Aqsa Mosque in Jerusalem was dismissed as a "madman" and sent for psychiatric treatment; end of story. The right-wing Jewish fundamentalists plotting to destroy the mosque, and the nearby Dome of the Rock, lived to fight another day. I suspect that that is what will happen with the Norwegian bomber/shooter; his right-wing links and Christian fundamentalist contacts will be dismissed as irrelevant. This, we will be told, was the work of a "deranged" person "acting independently". Ergo, the only organised "terror threats" to civilisation are still "Islamic-related" and the focus of anti-terror legislation and efforts must remain in the Muslim world and on Muslim communities in Europe and the USA.

If we allow this to happen, we will be doing the world a great disservice, not least because the new right is on the rise across the West - and Oklahoma was proof that its followers are capable of immense destruction.

Neo-Nazi immigrants from Eastern Europe have even been active in Israel where the government, while deploring such far-right activity in its midst is actually edging ever more to the far-right on a daily basis. Ministers advocate the ethnic cleansing of Palestinians in order to purify Israel as a "Jewish state"; precious human rights for which the world has struggled are overridden in the name of "state security"; criminals in uniform are allowed to get away, quite literally, with murder.

All of this takes place with the collusion of Western governments which are themselves showing right-wing tendencies towards double-speak on matters of respect and tolerance for minorities. If you are even remotely "different" in Europe today, especially if you are a Muslim, you are eyed with suspicion and must go out of your way to "prove" your loyalty to a state which, if the truth was made known, would get rid of you if only it had the guts to pass the necessary legislation to do so. In some cases, such legislation is virtually in place in the guise of "anti-terror" measures.

All of this is backed by a vociferous and influential right-wing media which supports Israel right or wrong - and a pro-Israel lobby which acts as if it is untouchable. Given the political context across the West, it probably is.

Attacks against the left

It is significant that the target of the Norwegian 'madman' appears to have been the left-leaning Labour Party, both in Oslo and on the island where the shootings took place. Across Europe, the left has been forming alliances with Muslim groups to fight fascism and racism of all kinds, and it cannot be a coincidence that The politics of multiculturalism in the new Europe, a collection of essays from across the continent, published in 1997, concluded almost without exception that "the challenge" facing Europe was the presence of large Muslim communities in "our" midst. Anyone who claims therefore, that the perpetrator's "right-wing traits" and "anti-Muslim views", or even links with "Christian fundamentalist" websites are irrelevant is trying to draw a veil over the unacceptable truths of such "traits" and expecting us to believe that right-wing ideology is incapable of prompting someone towards such criminality.

Of course, that idea is nonsensical. Right-wing ideology was behind the Holocaust; it has been behind most anti-Semitism and other racism around the world; the notion of Europe's and Europeans' racial superiority - giving cultural credibility to the far-right - gave rise to the slave trade and the scramble for Africa leading to untold atrocities against "the Other"; ditto in the Middle and Far East. Ironically, it is also far-right Zionism - far from the socialist myths of Zionist pioneers in the 1930s and before - which has been behind the ethnic cleansing of Palestine throughout the 20th century, right up to today, as a specific policy to be pursued - by military means if necessary.

This is well-documented and yet ignored by our political masters. In the context of the latest apparently far-right atrocities in Norway, it is equally ironic that the word in English for a traitor who collaborates with an enemy power stems from Major Vidkun Quisling who ruled Norway on behalf of Nazi Germany during the Second World War.

We dismiss this "madman" as a one-off "not linked to any international terrorist organisations" at our peril. If nothing else, history has shown us that such ideologies are trans-national across and beyond the West, with catastrophic effects on the rest of the world. We have been warned.

History Supreme – The World’s Most Expensive Yacht

If the story about this yacht built for a mystery Malaysian businessman for a stunning £3 billion ($4.8 billion) is true, it will truly be the epitome of Malaysia Boleh!! Tongues have been wagging as to the identity of this mysterious Malaysian. Is he Robert Kuok, the richest man in Malaysia? Or Ananda Krishnan, the second richest Malaysian? However it is highly unlikely to be either of them as they are both shrewd businessmen who won’t splash such a substantial portion of their wealth on a single toy.

Hmmm…that would mean this mystery man could be a politician. Who can it be? I really don’t know. Try asking the Sarawakians. The yacht, named History Supreme or Baia 100 Supreme, is the creation of renowned luxury goods designer Stuart Hughes. Stuart is the creator of the famous £5million diamond-wrapped iPhone.

The cost of the 100 feet long History Supreme even eclipses that of Chelsea owner Roman Abramovich’s swanky 533 feet yacht Eclipse (cost £750million) which is the world’s biggest private yacht.

History Supreme is made of 100,000 kilograms of solid gold and platinum and took over three years to be completed. It has a deck, dining area, rails, anchor, all crafted from precious metals. The base of the vessel is wrapped with solid gold, while the main sleeping quarter sports platinum accents with walls set in meteoric stone, that boasts of a genuine Tyrannosaurus Rex bone shaved in from the raptor T – REX.

Stuart Hughes said: “I was commissioned for the “History Supreme” project by an anonymous Malaysian business man who wanted something really special.” “It was probably the most mammoth task I have undertaken so far, there was three years of planning and it was very difficult to get right.” “The project uses 100,000 kilograms of solid gold and platinum and all features including the deck,” he said. “It was probably the most mammoth task ever. I’ve covered all sorts of things in gold but this has got to be my most ambitious project yet. This will never be topped.

“The businessman just approached us and asked us whether we could do it. He wanted a plane doing as well, but the thing would never take off if we did. “So he said, ‘Can you do the yacht?’ and I said, ‘We’ll give it a crack.’ Then it was pretty much a case of can you make this gold, can you make that gold? “We just did what we were told and are delighted with the result.”

The yacht was built in Italy and completed in Malaysia two weeks ago.

Malaysian businessman buys £3billion yacht

Would you fork out £3 billion (RM14.5 billion) for a yacht? That's what one unnamed Malaysian businessman did. The Sun, a U.K. newspaper, reported that the 100-feet yacht, rather aptly named History Supreme, had 100 tons of gold incorporated into its design. And it does not stop there. The yacht is a dazzling, unrestrained display of bling - deck, dining area, rails and anchor were all fashioned from precious metals - platinum being one.

Platinum also embellishes its sleeping quarters. As an added bonus, the package also includes a statue crafted from a bone of no less than 'The King of the Dinosaurs' - the Tyrannosaurus Rex.

Started in Italy and finished in Malaysia (about two weeks ago), construction of the yacht took three years. The project was overseen by Liverpool jeweller Stuart Hughes, who was given the task by a yet unidentified Malaysian businessman. "I've covered all sorts of things in gold but this has got to be my most ambitious project yet. This will never be topped," Hughes was attributed saying in The Sun report.

This kind of crap just fuels conspiracy theories. They have picked a new leader for the IMF and her name is Christine Lagarde. She is a Jewish. Most leaders of the IMF have been Jewish. Most leaders of the Federal Reserve have been Jewish. Why do they always pick the leaders from this small group of people? It makes the Jews kind of monopoly the system. 

They had a chance to pick someone who for once wasn't Jewish but they did not. Come on! How about a Christian or Hindu (or MUSLIM) for once.

WASHINGTON - French Finance Minister Christine Lagarde has clinched the top job at the IMF, keeping the international lender in the hands of a European at a time of growing concern over a possible Greek debt default. Ms Lagarde, who starts her five-year term as managing director on July 5, will find herself immediately immersed in efforts by the IMF and European Union to head off a Greek default that could touch off an international crisis.

Minutes after her appointment, Ms Lagarde pressed Greece to move quickly to push through unpopular austerity measures that the IMF and EU say are a prerequisite for further aid. "If I have one message tonight about Greece, it is to call on the Greek political opposition to support the party that is currently in power in a spirit of national unity," she told TF1 television.

Global stocks rose and the euro rallied as financial markets grew increasingly confident Greece's parliament would approve the five-year austerity program this week, which would unleash a €12 billion aid tranche from the IMF and EU.

Ms Lagarde, 55, the first woman to head the IMF, succeeds Dominique Strauss-Kahn, who resigned from the IMF in May to defend himself against charges of sexual assault against a New York hotel maid. He denies the charges. Her skills as a tough negotiator with a reputation for sealing deals under pressure will carry weight as she moves from defending France's economic interests to overseeing a global institution that must be seen as a neutral player around the world.

Usahawan Beras ditembak Mati Depan Rumah

BUTTERWORTH 18 Jun - Seorang usahawan beras terkenal di sini, maut selepas ditembak sewaktu turun dari kereta untuk membuka pintu pagar rumahnya di Taman Puyu, dekat sini, tengah malam tadi. Mangsa, Ooi Chong Tian, 58, dikatakan baru pulang ke rumahnya selepas keluar minum bersama rakan-rakannya dalam kejadian kira-kira pukul 1 pagi itu.

Sebaik sahaja mangsa sampai di depan rumah, dua lelaki yang menaiki kereta Proton Wira hitam menghentikan kenderaan mereka sebelum melepaskan dua das tembakan ke arah Chong Tian. Tembakan itu mengenai kepala dan lehernya menyebabkan mangsa rebah sebelum suspek memecut kenderaan dan meninggalkan kawasan berkenaan.

Ahli keluarga mangsa yang mendengar bunyi tembakan itu segera keluar dan mendapati mangsa terbaring di depan rumah sebelum anaknya menghantar mangsa ke Hospital Seberang Jaya untuk mendapat rawatan kecemasan. Namun begitu mangsa meninggal dunia di hospital kira-kira pukul 5 pagi akibat pendarahan teruk.

Sementara itu, Ketua Polis Daerah Seberang Perai Utara, Asisten Komisioner Zulkifli Alias ketika dihubungi hari ini mengesahkan kejadian berkenaan dan menjelaskan usaha mengesan suspek sedang dijalankan. Menurutnya, pihak polis masih menyiasat identiti suspek dan juga motif kejadian terbabit dan usaha mengumpul bukti dan maklumat mengenainya sedang dilakukan. Siasatan dijalankan mengikut Seksyen 302 Kanun Keseksaan kerana membunuh.

Gaji pegawai polis di semak hampir setiap 2 tahun sekali, allowances dan bantuan kewangan lain juga telah ditambah. Tapi ada-ada juga pegawai polis yang 'korup / rasuah'... Ini tidak termasuk mereka yang 'menyalahgunakan kuasa'... memandu dengan laju pada hari biasa (bukannya kejar penyenayah)... Gaji tinggi nak, kuasa tinggi pun nak... aku pun nak jadi polis lah mcm ni !! Ini tidak termasuk mereka yang korup ?!

6 Polis ditahan edar Dadah

KUALA LUMPUR 18 Jun - Harapkan pagar, pagar makan padi. Itulah pepatah sesuai bagi seorang pegawai dan lima anggota polis yang diamanahkan tugas untuk membanteras kegiatan pengedaran dadah. Keenam-enam mereka yang bertugas dalam cawangan narkotik di sini, sepatutnya memburu pengedar dadah tetapi sebaliknya mengambil kesempatan untuk terlibat sama dalam kegiatan mengedar dadah kepada para penagih di sekitar ibu negara. Namun, penglibatan mereka dalam aktiviti menyalahi undang-undang itu akhirnya terbongkar dan mereka kini ditahan untuk siasatan lanjut.

Pengarah Jabatan Siasatan Jenayah Narkotik Bukit Aman, Datuk Noor Rashid Ibrahim berkata, mereka yang ditahan ialah seorang pegawai berpangkat Inspektor dan lima anggota pangkat rendah terdiri daripada Koperal serta Konstabel.

"Keenam-enam mereka berusia 30-an ditahan secara berasingan kerana disyaki mengedar dadah secara kecil-kecilan. Mereka kini ditahan untuk siasatan lanjut di bawah Seksyen 3(1) Akta Dadah Berbahaya 1952 (Langkah-Langkah Pencegahan)," katanya di sini hari ini. Beliau berkata demikian pada sidang akhbar semasa mewakili Ketua Polis Negara, Tan Sri Ismail Omar merasmikan Majlis Ihtifal Peringkat Kebangsaan Pergerakan Belia India Muslim Malaysia (Gepima) Kali Ke-12 di Masjid Bukit Aman di sini hari ini.

Menurut Noor Rashid, semasa tangkapan dilakukan, tiada dadah dirampas daripada keenam-enam suspek tetapi pihaknya mempunyai alasan kukuh untuk memberkas mereka. Beliau berkata, keputusan sama ada mereka akan digantung kerja dijangka diketahui selepas selesai siasatan nanti.

Tegasnya, tangkapan pegawai dan anggota terbabit membuktikan bahawa polis tidak melindungi sesiapa daripada undang-undang. Beliau turut menasihatkan semua ketua polis peringkat negeri negeri dan daerah agar memantau pegawai dan anggota di bawah jagaan mereka bagi memastikan kejadian tidak berulang.

"Tangkapan pegawai dan anggota ini adalah mesej jelas bagi menunjukkan betapa Polis Diraja Malaysia (PDRM) bersikap telus kepada masyarakat. "Kita juga minta masyarakat tidak memandang serong PDRM kerana penglibatan pegawai dan anggota polis dalam penyalahgunaan kuasa serta kegiatan jenayah adalah kecil berbanding lebih 100,000 keanggotaan dalam pasukan keselamatan itu," katanya sambil memberitahu tangkapan keenam-enam suspek adalah kes pertama membabitkan anggotanya pada tahun ini.

DR. MOHAMAD Khir Toyo ditemani isteri Zaharah Kechik berjalan keluar dari Mahkamah Tinggi Shah Alam, semalam.

SHAH ALAM 23 Dis. - Bekas Menteri Besar Selangor, Dr. Mohamad Khir Toyo telah mengemukakan rayuan terhadap hukuman penjara setahun bagi kesalahan mendapatkan untuk beliau dan isteri, Zaharah Kechik dua lot tanah dan sebuah banglo bernilai RM6.5 juta dengan harga RM3.5 juta.

Notis rayuan difailkan oleh peguamnya, M.M. Athimulan di Pejabat Pendaftar Mahkamah Tinggi di sini pada pukul 3.30 petang, kira-kira empat jam selepas hukuman penjara itu dijatuhkan oleh Hakim Datuk Wira Mohtarudin Baki.

''Ini bukan proses penghakiman terakhir buat saya kerana saya akan merayu mengenai keputusan ini kepada mahkamah yang lebih tinggi,'' katanya semasa ditanya oleh pemberita di luar mahkamah sebaik sahaja prosiding kesnya selesai.

Berhubung masa depan politiknya, Mohamad Khir berkata, beliau akan membuat kenyataan mengenai perkara tersebut selepas 9 Januari tahun depan tetapi enggan mengulas lanjut mengapa tarikh tersebut yang dipilih.

Terdahulu, selain hukuman penjara terhadap Mohamad Khir yang disabit bersalah atas tuduhan itu, Hakim Mohtarudin (kini Hakim Mahkamah Rayuan) turut mengarahkan hartanah yang terletak di Seksyen 7 di sini itu dilucutkan hak kepada kerajaan Malaysia.

Beliau bagaimanapun membenarkan penangguhan pelaksanaan hukuman dan perintah pelucutan hak itu sehingga rayuan Mohamad Khir selesai didengar serta diputuskan.

Mohamad Khir yang dilihat tunduk sepanjang prosiding ditenangkan oleh Zaharah yang bertindak menggosok-gosok bahu suaminya itu sebaik sahaja sabitan dan hukuman diputuskan.

Hakim Mohtarudin semasa membacakan penghakimannya berkata, beliau berpuas hati bahawa pihak pendakwaan berjaya membuktikan ketiga-tiga intipati dalam pertuduhan itu.

Beliau menerima keterangan Pengarah Ditamas Sdn. Bhd., Datuk Shamsuddin Hayroni yang membeli hartanah untuk dijual semula kepada Mohamad Khir serta tidak pernah bersetuju dengan harga RM3.5 juta sebaliknya menawarkan harga antara RM5 dan RM5.5 juta.

Menurutnya, Shamsuddin turut dibuktikan mempunyai kepentingan dalam beberapa syarikat yang ada kaitan dengan urusan rasmi Mohamad Khir sebagai Menteri Besar dan Pengerusi Perbadanan Kemajuan Negeri Selangor (PKNS) berdasarkan tiga dokumen yang dikemukakan kepada mahkamah.

Begitu juga intipati pertuduhan bahawa Mohamad Khir mempunyai pengetahuan bahawa hartanah tersebut dibeli oleh Shamsuddin dengan harga RM6.5 juta pada tahun 2004 berdasarkan keterangan saksi-saksi pendakwaan yang konsisten serta menyokong antara satu sama lain.

Hakim Mohtarudin mendapati penjelasan Shamsuddin adalah logik dan boleh diterima bahawa beliau bersetuju menjadi saksi pendakwaan selepas pertuduhan terhadapnya ditarik balik kerana hilang keyakinan terhadap janji tiada pertuduhan terhadapnya oleh Mohamad Khir.

''Apabila kepentingan awam dan kepentingan individu bertembung, kepentingan awam perlu diberi keutamaan. Fakta menunjukkan tertuduh merancang untuk memiliki hartanah itu. Tertuduh telah menyalahgunakan jawatannya sebagai eksekutif tertinggi dalam negeri.

''Dalam kes ini, denda tidak sesuai. Hukuman penjara terhadap seorang yang memegang jawatan eksekutif tertinggi perlu diberi penekanan,'' katanya.

Ketika diberi peluang merayu, Athimulan memohon hukuman ringan iaitu hanya dikenakan denda dengan alasan transaksi dilakukan dengan kerelaan kedua-dua pihak selain ia tidak memberi kemudaratan kepada masyarakat awam.

Sementara Timbalan Pendakwa Raya, Masri Mohd. Daud pula berhujah balas bahawa hukuman denda terhadap seseorang yang mampu membayar dengan senang hati menyebabkan matlamat hukuman itu tidak tercapai.

Mohamad Khir, 45, didakwa mendapatkan untuk dirinya dan Zaharah, 45, dua lot tanah dan sebuah rumah di No. 8 & 10, Jalan Suasa 7/1L, Seksyen 7 di sini daripada Ditamas melalui Shamsuddin dengan harga RM3.5 juta.

Sedangkan hartanah tersebut dibeli oleh syarikat terbabit pada 23 Disember 2004 dengan harga RM6.5 juta.

Perbuatan itu didakwa dilakukan dalam keadaan Mohamad Khir mengetahui bahawa Shamsuddin mempunyai hubungan dengan tugas rasminya sebagai Menteri Besar Selangor pada ketika itu.

Beliau didakwa melakukan perbuatan tersebut di kediaman rasmi Menteri Besar Selangor di Jalan Permata 7/1, Seksyen 7 di sini pada 29 Mei 2007.

Selain Masri, pendakwaan dikendalikan oleh Timbalan-Timbalan Pendakwa Raya, Abdul Wahab Mohamed dan Mohd. Dusuki Mokhtar sementara Mohamad Khir turut diwakili oleh peguam, Datuk Jahaberdeen Mohamed Yunoos serta Kamarul Hisham Kamaruddin.

Sementara itu, keadaan di luar mahkamah bertukar sayu di kalangan hampir 50 penyokong Mohamad Khir yang setia menunggu sejak pukul 8 pagi sehingga prosiding itu selesai kira-kira pukul 12.30 tengah hari.

Mahkamah hukum Khir Toyo dipenjara 12 bulan

SHAH ALAM, 23 Dis: Mahkamah Tinggi Shah Alam hari ini memutuskan bekas Menteri Besar Selangor, Dr Mohamad Khir Toyo bersalah atas tuduhan rasuah empat tahun lalu.

Dr Mohamad Khir, 46, dituduh mendapatkan untuk diri dan isterinya, Zahrah Kechik, 46, dua lot tanah dan sebuah rumah di No 8 & 10, Jalan Suasa 7/1L di sini, daripada Ditamas Sdn Bhd melalui pengarahnya, Shamsuddin Hayroni.

Hartanah yang terletak di Seksyen 7 di sini itu diperoleh dengan harga RM3.5 juta, sedangkan ia dibeli oleh Ditamas pada 23 Dis 2004 pada harga RM6.5 juta.

Perbuatan itu didakwa dilakukan dalam keadaan Dr Mohamad Khir mengetahui bahawa Shamsuddin mempunyai hubungan dengan tugas rasmi beliau sebagai Menteri Besar Selangor pada ketika itu.

Dr Mohamad Khir, yang juga Anggota Dewan Undangan Negeri Sungai Panjang, didakwa melakukan kesalahan itu di kediaman rasmi Menteri Besar Selangor di Jalan Permata 7/1, Seksyen 7 di sini pada 29 Mei 2007.

Hakim Datuk Wira Mohtarudin Baki (kini Hakim Mahkamah Rayuan) membuat keputusan itu setelah mendapati pihak pembelaan gagal menimbulkan sebarang keraguan munasabah ke atas kes tertuduh.

Ekoran itu, mahkamah menjatuhkan hukuman 12 bulan penjara berkuatkuasa hari ini, serta memerintahkan harta terbabit dilucuthak kepada kerajaan Malaysia.

Khir Toyo Bayar Ubah Suai Banglo RM6 juta

SHAH ALAM 9 Jun – Seorang pereka landskap bebas memberitahu Mahkamah Tinggi hari ini bahawa dia dibayar lebih RM6 juta secara tunai oleh Dr. Mohamad Khir Toyo pada 2006 bagi kerja-kerja pengubahsuaian banglo berkonsepkan Bali milik bekas Menteri Besar Selangor itu di Seksyen 7 di sini.

Nasir Ismail, 55, dari syarikat Lyna Ubersari Bali Landscaping & Pottery Sdn. Bhd. menyatakan, pembayaran wang pendahuluan sebanyak RM250,000 dibuat sendiri oleh Mohamad Khir kepadanya di kediaman bekas menteri besar itu antara Mac dan April 2006. Katanya, selepas mendapat bayaran, dia pergi ke pejabat pemegang harta (Jabatan Insolvensi) bagi menguruskan pasport antarabangsa ke Bali, Indonesia untuk membeli barang-barang pengubahsuaian.

‘‘Selepas itu, saya menerima lima kali bayaran yang setiap satunya berjumlah RM500,000 daripada Pengarah Ditamas Sdn. Bhd. (Ditamas), Datuk Shamsuddin Hayroni yang dilantik oleh Mohamad Khir sebagai pengurus.

‘‘Seterusnya, Mohamad Khir membayar kepada saya RM500,000 sebanyak lapan kali di kediaman rasminya,’’ ujar lelaki itu semasa menjawab soalan pada pemeriksaan utama oleh Timbalan Pendakwa Raya, Masri Mohd. Daud.

Nasir yang merupakan saksi pendakwaan ketiga menyatakan, dia memohon bayaran secara tunai kerana statusnya sebagai MUFLIS pada 1998 dan tidak mempunyai akaun bank. Dia berkata demikian pada perbicaraan terhadap Mohamad Khir, 45, yang didakwa memperoleh dua lot tanah dan sebuah rumah di No. 8 & 10, Jalan Suasa 7/1L, Seksyen 7 di sini untuk dirinya dan isteri, Datin Seri Zaharah Kechik, 45, pada 23 Disember 2004 bernilai RM6.5 juta hanya dengan harga RM3.5 juta daripada Ditamas melalui Shamsuddin.

Perbicaraan masuk hari kedua hari ini.

Mohamad Khir yang didakwa melakukan perbuatan itu di kediaman rasmi Menteri Besar Selangor di Jalan Permata 7/1, Seksyen 7 di sini pada 29 Mei 2007, dibicarakan mengikut Seksyen 165 Kanun Keseksaan yang memperuntukkan hukuman penjara maksimum dua tahun atau denda atau kedua-duanya.

Ditanya mengenai bagaimana saksi itu menguruskan wang tersebut, Nasir menjawab, dia membayar kepada pembekal secara tunai dan sebahagiannya disimpan untuk bayaran upah pekerja-pekerjanya. Jelas saksi berkenaan, syarikat landskap tempat dia bekerja itu adalah milik isterinya, Nor Azlina Abdul Aziz yang turut menguruskan syarikat tersebut.

Sementara itu, ketika disoal balas oleh peguam M. Athimulan yang mewakili Mohamad Khir, saksi itu mengakui dia menyangka banglo itu milik Mohamad Khir sehinggalah melihat pelan banglo yang tertera nama pemilik sebenar, Ditamas.

‘‘Saya menyangkakan banglo itu milik Mohamad Khir dan isteri beliau kerana mereka berdua yang banyak memberikan arahan dan cadangan berkaitan pengubahsuaian banglo tersebut. Tetapi selepas mengetahui ia milik Ditamas, saya jadi keliru,’’ katanya. Nasir turut mengakui berlaku perselisihan faham dengan Mohamad Khir di peringkat akhir pengubahsuaian kediaman itu kerana dia tidak menyiapkan kerja-kerja tersebut dengan sempurna.

Katanya, dia terpaksa meninggalkan kerja-kerja tersebut kerana ada tunjuk perasaan di luar kediaman bekas menteri besar itu. Perbicaraan di hadapan Hakim Datuk Wira Mohtarudin Baki bersambung Isnin ini.

IMF Chief Charged with Sex Assault, Rape Attempt !!

NEW YORK (AFP) – IMF chief Dominique Strauss-Kahn was charged Sunday with the sexual assault and attempted rape of a New York chambermaid, a scandal which could derail his ambitions to run for the French presidency. The charges included "criminal sexual act, unlawful imprisonment, attempted rape" and "assaulting a 32-year-old girl in a hotel room," a police spokesman told reporters.

The 62-year-old IMF chief, who was expected to be formally arraigned before a New York judge later Sunday, will "plead not guilty," his lawyer William Taylor told AFP. The bombshell news comes at a crucial time for the International Monetary Fund, one of the pillars of the world's financial system, as it tries to help shore up the debt-ridden euro zone.

An IMF spokesman said the Washington-based Fund would meet in a special session later Sunday "to be briefed on developments related to the managing director."

The IMF chief was arrested, charged by New York police and held overnight in the Harlem neighborhood at a special unit for sexual harassment, after a maid at the top class Sofitel hotel alleged he had assaulted her when he got out of his shower naked.

The New York Times reported that according to one law enforcement official "investigation in the hotel room uncovered forensic evidence that would contain DNA." But Strauss-Kahn's wife, high-profile French television journalist Anne Sinclair, dismissed the allegations against her husband. "I do not believe for one second the accusations brought against my husband. I have no doubt his innocence will be established," she said in a statement to AFP.

From early Sunday a media gaggle gathered outside the police station, and there was a buzz as a young blond woman wrapped in what appeared to be a white sheet was driven into the building. It was not known immediately who she was. Strauss-Kahn, who has been widely praised for his stewardship of the IMF, is a leading member of the Socialist party and well-known on the French political scene. He is often referred to simply by his initials DSK.

He had been expected to challenge center-right French President Nicolas Sarkozy in next year's presidential race, and even though he has not yet officially declared his candidacy he had been topping the opinion polls.

News of his arrest threw the Socialist party into disarray, and could prove a boost for Sarkozy and his rightwing UMP which is also facing a challenge from the far-right National Front and its leader Marine Le Pen.
Martine Aubry, leader of the French Socialists, said the news of Strauss-Kahn's arrest was a "thunderbolt" which left her "astounded."

[Hahahah... One man fall, is another good fortune... And what presidential election?! These days, everyone that has power and money can be president, doesn't matter IF the moral and ethics is at question?! Developed countries or trouble countries... Italy, French, Libya, to Somalia, Ethiopia, etc.]

But she would not yet comment on how the presidential race might reshape itself if Strauss-Kahn is taken out of the running. In a dramatic intervention, Strauss-Kahn had been taken off a flight from John F. Kennedy airport just minutes before take-off.

The move came after a chambermaid alleged Strauss-Kahn came out of the bathroom naked and attempted to sexually assault her, The New York Times reported, quoting New York Deputy Police Commissioner Paul Browne. According to the account from the maid, who had been employed at the Sofitel for three years, the IMF chief grabbed her, pulled her into the bedroom and onto the bed and then locked the door, the paper said. She managed to fight him off, but he dragged her down the hallway to the bathroom, where he sexually assaulted her a second time, according to The Times report.

MSNBC television said that in the bathroom, Strauss-Kahn forced the maid to perform oral sex on him and tried to remove her underwear. She broke free and fled, reporting the incident to other hotel staff and calling the 911 police emergency line.

The scandal comes at a critical moment for the 187-member IMF, which has been leading negotiations to help the debt-ridden euro zone. Strauss-Kahn, whose stint at the IMF does not officially end until September 2012, had been due to meet with German Chancellor Angela Merkel in Berlin on Sunday to discuss an aid package for debt-laden Greece. He was then to attend a meeting of EU finance ministers on Monday and Tuesday in Brussels.

It is not the first time that the silver-haired Strauss-Kahn has been tainted by scandal. In 2008, he was discovered to be having an affair with an Hungarian IMF economist, but the IMF concluded he had not exerted pressure on the woman, although it noted his inappropriate behavior.

Cuba ROGOL: Pengarah Urusan IMF didakwa

NEW YORK 15 Mei - Pengarah Urusan Dana Kewangan Antarabangsa (IMF), Dominique Strauss-Kahn awal hari ini didakwa secara rasmi 'atas tuduhan melakukan serangan seksual dan percubaan merogol'.
Beliau ditahan semalam dan disoal siasat berhubung dakwaan serangan seksual terhadap seorang pengemas bilik di sebuah hotel terkemuka di bandar raya ini, kata polis New York.

Strauss-Kahn, anggota Parti Sosialis yang dijangka mencabar Presiden Nicolas Sarkozy pada pilihan raya Presiden Perancis pada tahun depan, dibawa turun dari sebuah pesawat Air France semalam, beberapa minit sebelum penerbangan dijadual berlepas ke Paris dari Lapangan Terbang Antarabangsa John F. Kennedy.

"Kami menahannya dan menyerahkannya kepada Jabatan Polis New York City (NYPD) atas permintaan NYPD," kata seorang pegawai Lembaga Pelabuhan New York dan New Jersey. Pihak berkuasa menyiasat dakwaan seorang wanita berusia 32 tahun di Hotel Sofitel New York diserang awal semalam, kata polis.

Pegawai Lembaga Pelabuhan berkata, Strauss-Kahn, 62, dibawa turun dari pesawat 10 minit sebelum waktu berlepas, pada pukul 4.45 petang semalam (4.45 pagi ini waktu Malaysia). Menurut akhbar New York Daily News, Strauss-Kahn mendekati wanita itu dari belakang selepas dia masuk ke biliknya lalu memaksa mangsa melakukan seks oral. Wanita itu berjaya melepaskan diri sementara Strauss-Kahn bergegas meninggalkan hotel tersebut untuk menuju ke lapangan terbang, lapor akhbar tersebut.

Insiden semalam bukan kali pertama Strauss-Kahn, juga dikenali sebagai 'DSK', terlibat dengan dakwaan seksual, kerana pada 2008, beliau didakwa mengadakan hubungan sulit dengan seorang ahli ekonomi IMF rakyat Hungary. IMF menyiasat dan mendapati beliau tidak mengenakan tekanan ke atas wanita itu tetapi menyifatkan kelakuan beliau sebagai tidak wajar. - AFP
