FREEDOM OF SPEECH / FREEDOM OF EXPRESSION

FREEDOM OF SPEECH / FREEDOM OF EXPRESSION

Freedom of speech is the freedom to speak without censorship and/or limitation. The synonymous term freedom of expression is sometimes used to indicate not only freedom of verbal speech but any act of seeking, receiving and imparting information or ideas, regardless of the medium used [United Nations, 1966, 1976]. The right to freedom of speech is recognized as a human right under Article 19 of the Universal Declaration of Human Rights and recognized in international human rights law in the International Covenant on Civil and Political Rights (ICCPR). The ICCPR recognizes the right to freedom of speech as "the right to hold opinions without interference. Everyone shall have the right to freedom of expression". Furthermore freedom of speech is recognized in European, inter-American and African regional human rights law [United Nations, 1966, 1967]. Freedom of speech, or the freedom of expression, is recognized in international and regional human rights law. The right is enshrined in Article 19 of the International Covenant on Civil and Political Rights, Article 10 of the European Convention on Human Rights, Article 13 of the American Convention on Human Rights and Article 9 of the African Charter on Human and Peoples' Rights [Andrew Puddephatt & Hodder Arnold, 2005; Kumar, Ambika, 2006].

In Islamic ethics freedom of speech was first declared in the Rashidun period by the caliph Umar in the 7th century. In the Abbasid Caliphate period, freedom of speech was also declared by al-Hashimi (a cousin of Caliph al-Ma'mun) in a letter to one of the religious opponents he was attempting to convert through reason.

According to George Makdisi and Hugh Goddard, "the idea of academic freedom" in universities was "modelled on Islamic custom" as practiced in the medieval Madrasah system from the 9th century. Islamic influence was "certainly discernible in the foundation of the first deliberately-planned university" in Europe [Boisard, Marcel A., 1980].

‘Stop sending MCO violators to jail’ !!

COMMENTS:

Police officers in their zeal to enforced the laws, sometimes simply catch everyone they see on the roads, including teenagers and young people, who naturally go out for sunshine and walk... Wrong time and wrong place, so they were caught and charge in courts?! Fine of RM1000 and imprisonment up to 6 months? (more than the MCO or restriction movement control periods of 14 to 28 days?).

AND/OR a fine of RM1000, whereas even a RM200-300 fine would be a lot for the B40 group. These police officers can simply give verbal warnings to scare them off, UNLESS its a repeat offenders or 'hardcore' offenders. I naturally do NOT believed in 'harsh' punishment for the PKP/MCO offenders.

The Human Rights NGOs should ensure that the police/ATM do not 'abused' or 'mis-used' their power! And the courts to use their discretion power to imposed a lesser sentences or DISMISSED the cases (if the so-called offenders have valid reasons - which was previously ignored by the police) !!

Guna budi bicara hukum pesalah ingkar PKP, kata ketua hakim

‘Stop sending MCO violators to jail’

KUALA LUMPUR: The judiciary has been asked to stop jailing violators of the movement control order (MCO) to avoid overcrowding in prisons, which could lead to the spread of the coronavirus.

Chief Registrar’s Office corporate communications unit director Suzarika Sahak confirmed that Federal Court Chief Registrar Ahmad Terrirudin Mohd Salleh had received a letter from the Prisons Department regarding the matter.

For now, she said the Chief Registrar’s Office had taken note of the letter.

Prisons Department director-general Datuk Seri Zulkifli Omar is said to have signed the letter, saying social distancing was “impossible” in prisons due to overcrowding.

In the letter, Zulkifli said 378 people had been sent to prison as of April 1 for violating the MCO.

“Apart from adding on to the already crowded prisons, the Prisons Department is concerned that they could become the source of Covid-19 outbreaks there as their health status is not known.

“The Prisons Department is of the opinion that it will become a major issue if there is a Covid-19 outbreak in prison as social distancing is impossible there and could spread uncontrollably, threatening the lives of prisoners and prison staff,” the department was quoted as saying by a news portal.

Zulkifli reportedly recommended that the courts mete out community service punishments under the Offenders Compulsory Attendance Act.

The MCO has been in effect since March 18 in a bid to curb the spread of Covid-19.

Under Rule 3(1) of the Prevention and Control of Infectious Diseases (Measures Within the Infected Local Areas) Regulations 2020, a person caught and convicted of violating the MCO could be fined up to RM1,000 or jailed up to six months.

When contacted, Malaysian Bar president Salim Bashir Bhaskaran said the Prisons Department had made a “valid concern and request”.

“Space constraint and the internal mechanisms that inevitably expose one to be in close contact with each other will lead to a strong likelihood of infections. Any infection among inmates will be an unimaginable catastrophe in prisons,” he added.

He said the court should be proactive and take into account the circumstances surrounding the facts of the cases in sentencing.

For instance, Salim said, community services imposed on the wrongdoers would essentially serve the purpose of the punishment, which is to teach them to be responsible and obey the law.

Alternatively, he said the court could also mete out bound-over sentences for offenders who breached the MCO.

Compounding the offence is also a viable option to prevent one from being sent to prison,” he said.

Salim noted that since the breach of MCO is not an offence involving violence, the court should exercise its judicial discretion in imposing sentences that are suitable in this period of time.

Senior criminal lawyer and author Datuk Baljit Singh Sidhu said the department made the right decision in making the request as the police and court staff were exposed to unnecessary risks with the arrests.

“The MCO offences are not a serious offence and there are other ways to deal with it. It will be total chaos if Covid-19 is spread in the prison cells,” he said.

Criminal lawyer Amer Hamzah Arshad echoed the concern over the possibility of a contagion in prisons.

“Logistics-wise, would the department be able to cope with a sudden increase of inmates and in the worst case scenario, with the spreading of the virus in prisons?” he asked.

Amer said the frontliners would be overwhelmed if such a spread happened in prisons.

“We are dealing with an unprecedented situation, so whatever sentence the court wishes to mete out, it must take this into consideration too,” he added.

513 tangkapan dalam lima hari

Norzamira Che Noh
am@hmetro.com.my

COMMENTS:

1- Putting these people in JAIL will result in them having Criminal Records for life.
2- With fines up to RM1000?!  (Even if fines RM300 is considered a lot for the B40 group)!
3- AND jail 6 months?! (Even if jail 1 month is MORE than the 14 days Restriction Order)
4- Why such a "heavy" punishment, just because you saw someone outside his/her house, you got angry, and quickly caught them, and charged them under Section 7(1) ?!

5- Its TIMELY that the NGOs and general public disapproved of the usage of Section 7(1) by the authority for punishing the general public.

6- Mere verbal warning is enough for First Time Offenders and the under-aged should be considered when the authority carried out their duties!

SUGGESTIONS:

1- Fines of RM200-300 should be adequate and depending on cases, and Hardcore Offenders can be fined more.
2- Simple Reminders or verbal warning should be adequate for First Time Offenders and the under-aged individuals.

Jangan penjara remaja langgar PKP

Mohd Rafi Mamat
am@hmetro.com.my

RM2.4b drug seizure in Penang is police’s biggest haul

SOURCE:

Muhyiddin: RM2.4b drug seizure in Penang is police’s biggest haul

PUTRAJAYA, Jan 1 ― Police recent success in foiling the largest drug smuggling and trafficking attempt worth over RM2.4 billion in Penang, clearly demonstrates that the government is serious in its fight against drug abuse in the country.
The success has received the attention and praise of Home Affairs Minister Tan Sri Muhyiddin Yassin who said such activities occurred frequently in the country’s northern region, known as the Golden Triangle Area.
“That is why our authorities have succeeded in discovering the largest drug smuggler in Penang with a seizure of almost 10 tonnes which worth hundreds of millions (ringgit),” he said during an interview with Bernama recently.
Muhyiddin also considered the success of bringing those involved in drug-related activities to court as an achievement.

“What's troubling is the trend among children, aged between 12 and13, who are not only involved in drug abuse but sometimes in drug peddling as well,” he said.
“Malaysia is like a transit point for drug trafficking, (and) this is not good for us,” he added.
On September 10, police busted an international drug smuggling syndicate after seizing 12 tonnes of cocaine mixed with 60 tonnes of charcoal worth RM2.4 billion from three containers at the North Butterworth Container Terminal (NBCT).
The syndicate which smuggled the drug in 60 sacks of charcoal from South America was crippled in the “Ops Eagle”, conducted in Butterworth and Bayan Baru in Penang and Padang Serai, Kedah.
In a related development, the ministry intends to decriminalise drug addicts, in which, instead of punishing them under the law, those who are caught in raids will be sent to rehabilitation centres for treatment.
Muhyiddin said the proposal was currently under consideration.
On June 24, Bernama reported that drug addicts in this country are no longer seen as criminals who must be punished but are patients in need of treatment and rehabilitation.
This follows discussions between the Home Affairs Ministry and the Health Ministry which agreed to decriminalise addicts.
“To that end, we need to assist privately funded rehabilitation centres to help support the role of the National Anti-Drug Agency (AADK), so that the problem can be addressed more effectively,” he said.
In another development, Muhyiddin said his ministry also emphasised on the maritime enforcement which had seen the Malaysian Maritime Enforcement Agency (MMEA) achieving great success in capturing individuals encroaching the country’s waters.
“This matter (encroaching Malaysian waters) is not to be taken lightly and we also have overlapped territorial seas especially with Vietnam.
“But if we don’t ensure the safety of the said areas now, then we would not be able to support our claim at the tribunal when the time comes for us to do, and that would be a loss to the country,” he said.
Muhyiddin said MMEA role was important in assisting the Fisheries Department in preventing and detaining foreign boats entering the country’s waters to illegally fishing which affects local fishermen livelihoods.
“What important is that the ministry wants to see MMEA have greater assets in terms of owning larger boats as the country has expansive territorial waters... and it is not easy to guard such expansive areas, but I have some ideas on how to solve the problem,” he said.
Among those ideas are leasing the vessels or boat from providers which will not incur high cost to the government, he added. ― Bernama

Tesla must face lawsuit claiming racism at California factory

By Jonathan Stempel

By Jonathan Stempel
(Reuters) - A federal judge rejected Tesla Inc's effort to dismiss claims by two former workers that the California electric car factory where they worked was a hotbed of racial hostility, clearing the way for a possible trial.
In a decision on Monday, U.S. District Judge William Orrick in San Francisco found open questions over whether Owen Diaz and his son Demetric Di-az faced "severe and pervasive racial harassment" in 2015 and 2016 at Tesla's factory in suburban Fremont, which employs more than 10,000 people.
The plaintiffs, who are black, said they were subjected to repeated racial epithets dozens of times, as well as racist cartoons, and that supervisors engaged in or did little to stop the racism.
Orrick said Diaz could pursue claims that Tesla allowed and did not take reasonable steps to stop racial harassment.
He said punitive damages might be available if Tesla must have known about the harassment and "ratified" it, even if only lower level workers were directly involved.
"The n-word is perhaps the most offensive and inflammatory racial slur in English, a word expressive of racial hatred and bigotry," Orrick wrote. "This case will proceed to trial."
A trial is scheduled for May 11, 2020.
Tesla and its lawyers did not immediately respond to requests for comment.
The Palo Alto, California-based company has faced multiple racial harassment lawsuits, but is not the only automaker to face such claims in recent years.
In 2017, Ford Motor Co agreed to pay up to $10.1 million to settle a federal probe into alleged harassment at two Chicago plants.
Tesla has in court papers said it "did not hesitate" to address racial abuse at the Fremont factory, and there was no proof of "oppression, malice, or fraud."
Orrick also said Diaz could pursue claims against a staffing agency that assigned him to the factory, and a liaison between Tesla and that agency.
Lawrence Organ, the plaintiffs' lawyer, said his clients are seeking damages "in the millions" of dollars.
"Tesla is not sending a message that this kind of conduct in the workplace is not permitted," he said in an interview.
Owen Diaz said he worked at Tesla for 11 months as an elevator operator, while Demetric Di-az spent two months as a production associate.
Allegations included a claim that Diaz's supervisor admitted to drawing a cartoon of "a black face person with a bone in his hair" and captioned "booo," supposedly short for "jigaboo."
"You people can't take a joke," Diaz said the supervisor told him.
The case is Di-az et al v Tesla Inc et al, U.S. District Court, Northern District of California, No. 17-06748.

Pink Legacy bakal dilelong RM209.2 juta

AS$30 juta (RM125.5 juta) hingga AS$50 juta.

KUALA LUMPUR, Dec 9 — Datuk Seri S. Vell Paari said his decision to file an originating summons in the High Court against his father, Tun S. Samy Vellu, was to protect the latter who is allegedly suffering from dementia.
In a statement to Malay Mail, the former MIC secretary-general said the legal action to ascertain the former minister’s mental condition was needed due to Samy Vellu’s allegedly “poor recall and registration of events” that suggested his declining mental state.
“The application has been necessitated by two events, essentially by an action filed against my father, Tun Samy and myself by one, Meeriam Rosaline a/p Edward Paul.
“Secondly, my father was diagnosed in 2017, as suffering from dementia, due to Alzheimer’s disease. Nonetheless, I have been holding off filing the application until now,” he said.
