FREEDOM OF SPEECH / FREEDOM OF EXPRESSION

Freedom of speech is the freedom to speak without censorship and/or limitation. The synonymous term freedom of expression is sometimes used to indicate not only freedom of verbal speech but any act of seeking, receiving and imparting information or ideas, regardless of the medium used [United Nations, 1966, 1976]. The right to freedom of speech is recognized as a human right under Article 19 of the Universal Declaration of Human Rights and recognized in international human rights law in the International Covenant on Civil and Political Rights (ICCPR). The ICCPR recognizes the right to freedom of speech as "the right to hold opinions without interference. Everyone shall have the right to freedom of expression". Furthermore freedom of speech is recognized in European, inter-American and African regional human rights law [United Nations, 1966, 1967]. Freedom of speech, or the freedom of expression, is recognized in international and regional human rights law. The right is enshrined in Article 19 of the International Covenant on Civil and Political Rights, Article 10 of the European Convention on Human Rights, Article 13 of the American Convention on Human Rights and Article 9 of the African Charter on Human and Peoples' Rights [Andrew Puddephatt & Hodder Arnold, 2005; Kumar, Ambika, 2006].

In Islamic ethics freedom of speech was first declared in the Rashidun period by the caliph Umar in the 7th century. In the Abbasid Caliphate period, freedom of speech was also declared by al-Hashimi (a cousin of Caliph al-Ma'mun) in a letter to one of the religious opponents he was attempting to convert through reason.

According to George Makdisi and Hugh Goddard, "the idea of academic freedom" in universities was "modelled on Islamic custom" as practiced in the medieval Madrasah system from the 9th century. Islamic influence was "certainly discernible in the foundation of the first deliberately-planned university" in Europe [Boisard, Marcel A., 1980].

Stephen Hawking Snub Israel Invitation !

That is what worldclass scholar with integrity should do! Snub the Israel for the cruelty done to humanity !!
And that's just the first step, the second step is of course to boycott Israel's products and goods, and the third step is to vote for embargo-sanction for Israel export goods to other countries, and the fourth step is to get into Israel and stop the oppression and shooting of innocents altogether!! Or ALL steps can be done stimutaneously.

Brave of Stephen Hawking to snub Israel

Scientists generally avoid getting embroiled in politics although they are staunch believers of the spirit of free speech and liberty. The recent news of world famous scientist Stephen Hawking’s abrupt withdrawal from attending Israel presidential conference scheduled to be held in a University in Jerusalem in mid June has taken the world scientific community by surprise.
The conference is expected to be attended by 5,000 people from around the world, including business leaders, academics, artists and former heads of state. This move by Hawking has been described by some scientist as a political endosement and it does not reflect well on an eminent scientist like Stephen Hawking 
[Comment: Don't tell me that scientists are ONLY supposed to sit in labs and be crazy with their tools and books - and ignore the world social NEWS and cruelty that occurs?! ]. 
The internet is abuzz with Stephen Hawking’s decision to turn down Israel’s invitation to the conference. It has been reported that the organiser of the conference is extremely embarrassed and hopping mad to learn that a world famous scientist has declined the invitation to endorse the justice of the Palestinian cause.
According to a poll conducted by the Guardian (UK newspaper) following the announcement of Stephen Hawkins’ decision not to attend the conference shows that public opinion has turned against Israel’s relentless land grabbing and oppression. Going by the fierce debates, comments and opinions posted in the internet social cites, it appears that more and more scientists are gradually beginning to regard Israel as a pariah state.
Israel took much pride in science and science is said to have been the key driving force for its economy, prestige and military strength. When Stephen Hawking a British boycotted the conference in support of the Palestinians it must have offended Israel.
As a member of the local scientific community, I applaud the boycott decision taken by Professor Stephen Hawking and for his stance against the illegal Israel occupation and  oppression of the Palestinian people.
Some of us may argue that Stephen Hawking’s boycott is a politically motivated one and it has nothing to do with science. Hawking’s neutral stance cannot be so easily disputed or attacked for he is an intellectual who commands international respect. Hawking may have breached the international code (statute 5 of the International Council for Science) that governs the conduct of scientists.
However, scientists are not robots they too have conscience. As a man of conscience Stephen Hawking has done his part (boycott) to draw the attention of the world especially the international scientific community to the plight of the Palestinians.
Stephen Hawking has taken an honourable and principled stand on this issue in not endorsing the legitimisation of the apartheid based policies of the Israeli government. The people of Palestine should realise that there are many hundreds of principled centered scientists around the world who are prepared to stand in solidarity with them.

In welcoming Stephen Hawking’s stance on the Palestinian issue I wish to point out that atrocities are also been committed probably on a larger scale to people in countries like Myanmar, Sri Langka, etc. We should also voice out and boycott these countries.

DHAKA 28 Mac - Kerajaan Bangladesh memperhebatkan usaha mengekang blog-blog yang dipercayai menghina Islam, selepas sekumpulan aktivis Islam mengugut untuk mengadakan bantahan secara besar-besaran bagi menuntut penulis blog berfahaman ateis dihukum.
Penolong Pengarah Penguat Kuasa Telekomunikasi, Rahman Khan, semalam berkata, pihaknya telah mengarahkan dua laman web terkenal di Internet supaya membuang beratus-ratus komen menghina Islam yang ditulis oleh tujuh penulis blog.
"Penulisan mereka itu menghina Islam dan Nabi Muhammad SAW. Dua laman web tersebut, Somewhereinb log.net dan Amarblog.com akur dengan arahan pihak berkuasa dan memadamkan komen-komen kontroversi berkenaan.
"Pihak kami juga sedang memantau beberapa laman web lain dan memadam mana-mana blog yang menghina Islam bagi memastikan keharmonian negara ini terjamin," katanya. - AFP



KOMEN:
ISLAM maju dan terus maju, Islam berdaya saing, kadang-kala mengatasi agama Kristian, dan agama lain, bagi umat Islam, itu adalah biasa, sebab Islam adalah agama syumul-sempurna (‘complete’),  tetapi bagi penganut agama Kristian, mereka tak dapat terima kemasukan Islam dan penguasaan (‘dominance’) agama Islam di Negara Barat mereka. Orang Islam di Britian, Kanada, Australia, Switzerland, Perancis, dan sebagainya, semakin maju dan menempa kejayaan dan kemajuan di dlm indutri pemakanan halal, SMEs, SMIs, dan yang paling penting akhlak terpuji. Orang Barat pula, adalah sebaliknya, itulah yang membuat mereka tak senang duduk, cemburu, dengki, jadi ada diantara mereka terus ke blog dan Internet, dan menghina Islam dan umat Islam. Kerajaan ada kuasa untuk bertindak berdasarkan peruntukan undang-undang yang ada, atau mengubal undang-undang siber baru.

KUALA LUMPUR 12 Mac - Pengerusi Eksekutif National Feedlot Corporation Sdn. Bhd. (NFCorp), Datuk Seri Dr. Mohamad Salleh Ismail mengaku tidak bersalah di Mahkamah Sesyen di sini hari ini atas dua tuduhan pecah amanah melibatkan wang RM49.7 juta dan dua tuduhan melanggar Akta Syarikat 1965, tiga tahun lalu.

Mohamad Salleh, 64, kelihatan tenang semasa membuat pengakuan tersebut di hadapan Hakim S.M. Komathy Suppiah di dalam mahkamah yang penuh sesak dengan petugas media, pekerja syarikat tersebut dan ahli keluarga tertuduh termasuk isterinya, Datuk Seri Shahrizat Abdul Jalil.

Mohamad Salleh yang berpakaian kot hitam dan bertali leher coklat sebelum itu tiba di bangunan mahkamah kira-kira pukul 1.30 petang dan disusuli oleh Menteri Pembangunan Wanita, Keluarga dan Masyarakat itu bersama anak lelaki mereka, Wan Shahinur Izmir serta ahli keluarga yang lain.

Mengikut pertuduhan pertama, beliau didakwa menyalahgunakan RM9,758,140 milik NFCorp melalui empat keping cek untuk membiayai sebahagian daripada harga pembelian dua unit kondominium One Menerung, Parcel B1-1 dan B1-2, Blok B, Bangsar di sini antara 1 dan 4 Disember 2009.

Perbuatan itu didakwa dilakukan di CIMB Islamic Bank Bhd., 138, Jalan Burhanuddin Helmi, Taman Tun Dr. Ismail di sini untuk syarikat milik keluarga tertuduh, National Meat & Livestock Corporation Sdn. Bhd.

Beliau juga didakwa menyalahgunakan RM40 juta milik NFCorp dengan memindahkan wang tersebut melalui sekeping cek dari bank yang sama ke dalam akaun Malayan Banking Bhd. cawangan Solaris, Mont Kiara milik National Meat & Livestock Corporation Sdn. Bhd. bagi kegunaan syarikat itu.

Perbuatan itu didakwa dilakukan di CIMB Islamic Bank Bhd. beralamat sama antara 6 Mei dan 16 November 2009.

Bagi kedua-dua tuduhan tersebut, beliau didakwa mengikut Seksyen 409 Kanun Keseksaan yang memperuntukkan hukuman penjara sehingga 20 tahun dan sebatan dan denda.
Mohamad Salleh turut didakwa atas dua tuduhan mengikut Akta Syarikat 1965 kerana melakukan kedua-dua transaksi tersebut tanpa kebenaran mesyuarat agung NFCorp pada tarikh dan tempat yang sama.

Bagi kedua-dua tuduhan itu, pendakwaan dikemukakan mengikut Seksyen 132 akta tersebut yang memperuntukkan hukuman penjara maksimum lima tahun atau denda RM30,000.

Peguam Badrul Munir Bukhari yang hadir bagi pihak peguam utama, Datuk Seri Dr. Muhammad Shafee Abdullah mewakili Mohamad Salleh memohon jaminan RM50,000 bagi setiap tuduhan atas alasan anak guamnya telah memberikan kerjasama yang baik sepanjang siasatan.

Menurut beliau, kesemua harta dan aset milik NFCorp telah dibekukan oleh Bank Negara Malaysia menyebabkan tiada risiko untuk harta-harta itu dibawa ke tempat lain atau disalah guna oleh tertuduh.

''Anak guam saya hadir ke mahkamah hari ini dengan tujuan membersihkan namanya dan begitu juga dengan keluarga beliau yang berada di belakang (galeri awam),'' ujarnya.
Tertuduh turut diwakili oleh tiga peguam lain iaitu Datuk Ahmad Redza Abdullah, Wan Azmir Wan Majid dan W. Sheelan Samuagam.

Timbalan Pendakwa Raya, Dzulkifli Ahmad yang tidak membantah mengenai jumlah jaminan tersebut turut mencadangkan supaya tertuduh menyerahkan pasport miliknya kepada mahkamah sehingga kes selesai.
Komathy kemudian menetapkan tertuduh diikat jamin RM500,000 bagi kesemua tuduhan dengan seorang penjamin dan syarat tertuduh menyerahkan pasport kepada mahkamah.
Wan Shahinur Izmir, 32, tampil sebagai penjamin bapanya. Sebutan kes ditetapkan pada 13 April ini.

NFCorp menjadi isu hangat ekoran Laporan Ketua Audit Negara 2010 pada Oktober lalu yang menyatakan Pusat Fidlot Kebangsaan (NFC) yang mana NFCorp adalah syarikat yang mengendalikan projek ternakan lembu di bawah pusat itu telah gagal memenuhi matlamat penubuhannya.

Ia disusuli dengan dakwaan pembangkang bahawa berlaku penyelewengan dalam pengurusan dana syarikat yang dikendalikan oleh suami Shahrizat tersebut. Shahrizat semalam mengumumkan keputusannya untuk berundur daripada jawatannya sebagai menteri pada 8 April ini.

Janet Jackson and her millionaire fiancĂ© Wissam al-Mana are planning to tie the knot in the Qatari capital Doha in a lavish $20-million dollar wedding set to take place in 2013, according to media reports on Wednesday. 

An insider told the National Enquirer magazine that the ceremony will be “one of the biggest, most memorable extravaganzas in recent history.”

“They have tentatively set a late 2013 wedding date. But they are still working out the details and the exact day,” the source told the magazine.
Renowned Turkish author Adnan Oktar (aka Harun Yahya) claimed, during an interview with a Turkish network in 2010, that Janet, 46, and her late brother Michael Jackson, had converted to Islam.

“I sent that nice Janet Jack¬son a copy of my book,” Adnan said. “I also sent her late brother a copy. Her brother was a Muslim. Janet is also, in fact, a Mus¬lim. Like her brother, she keeps it hidden.” “She is a devout believ¬er…like her brother.”

The couple plan to spend $3 million to fly in their 500 wedding guests from all over the world, according to reports. Wissam reportedly plans to offer all guests a $10,000 Rolex watch apiece as a thank you for attending.

“Wissam is going to splash big when he marries Janet. It’s going to be the wedding of the century,” the unnamed insider told the the National Enquirer.

Wissam is reportedly 10 years younger than Janet and they both have been dating since summer 2010. He reportedly proposed to her last year with a 15-carat diamond ring.

Mana, 36, is an executive for al-Mana Group, a large family-controlled business entity in Qatar.

“My mother always raised us to believe that age was just a number. All of us - my sisters, my brothers - we’ll just tell you our ages because it’s all about where you are mentally and how you feel about yourself. It doesn’t matter,” Janet reportedly said once.

RASAH 28 Mac - Denda maksimum RM25. Itu hukuman yang dijatuhkan oleh Mahkamah Majistret Seremban, dekat sini hari ini ke atas tiga gadis yang terlibat dalam aksi menari tiang di sebuah pusat hiburan di Nilai pada Sabtu lalu.

Ketiga-tiga mereka masing-masing dikenakan denda tersebut setelah mengaku bersalah atas tuduhan berkelakuan kurang sopan dengan berpakaian seksi dan melakukan aksi mengghairahkan.

Faiqah Azizan, 24, Nurul Huda Abdul Rahman, 23, Nooranishah Mohamad Isa, 19, yang masing-masing memakai baju kurung dan bertudung hanya mengangguk kepala tanda mengaku selepas pertuduhan dibacakan kepada mereka di hadapan Majistret Mohamad Izwan Mohamed Noh.

Mengikut kertas pertuduhan, mereka didakwa menari di atas pentas dengan mengenakan pakaian seksi serta melakukan aksi mengghairahkan selain berkelakuan kurang sopan di tempat hiburan awam.
Perbuatan itu dilakukan di sebuah pusat hiburan di Putra Nilai, Nilai kira-kira pukul 2.20 pagi, 24 Mac lalu.

Ketiga-tiga mereka didakwa melakukan kesalahan mengikut Seksyen 21 Akta Kesalahan-Kesalahan Kecil 1955 (Akta 336) yang memperuntukkan hukuman denda tidak lebih RM25 atau penjara maksimum 14 hari.

Sebelum menjatuhkan hukuman, Mohamad Izwan menasihatkan agar tertuduh-tertuduh insaf dan tidak mengulangi perbuatan itu demi menjaga nama baik keluarga masing-masing.

Pendakwaan dikendalikan oleh Timbalan Pendakwa Raya, Kaiyisah Shukri manakala ketiga-tiga gadis tertuduh tidak diwakili peguam bela.

Utusan Malaysia sebelum ini melaporkan, sepasukan anggota Bahagian Kongsi Gelap, Judi dan Maksiat (D7), Ibu Pejabat Polis Kontinjen (IPK) negeri bersama Jabatan Hal Ehwal Agama Islam Negeri Sembilan (JHEAINS) dan Cawangan Jabatan Siasatan Jenayah Narkotik negeri memberkas 32 orang termasuk tiga gadis berkenaan atas pelbagai kesalahan.

Forbes magazine ranked the Yoovidhaya family as the fourth richest family in Thailand this year, with an estimated net worth of $5.4 billion.

But the grandson of Red Bull creator Chaleo Yoovidhya, is known for milking his family's deep pockets for all they are worth.

In October of this year, 27-year-old Vorayud Yoovidhaya was accused in the hit-and-run death of a police officer and had his father paythe officer's family $97,000 to stall the civil lawsuit.

The car involved in the accident was a Ferrari and is valued at about $1 million.

KANSAS CITY, Mo. May 4 (Reuters) - A Kansas City woman who converted from Christianity to Islam has been awarded $5 million in punitive damages by a jury who found the telecommunications giant AT&T created a "hostile work environment" after her conversion, according to a judge's order issued Friday.

Susann Bashir, a 41-year-old married mother, sued AT&T unit Southwestern Bell for what she said was a pattern of offensive and discriminatory conduct by her supervisors that began when she converted to Islam in 2005, six years after she started working for the company as a network technician.

After Bashir started wearing a religious head scarf known as a hijab, and attending Friday mosque services, her managers and co-workers called her names including "terrorist," and told her she was going to hell, said her attorney Amy Coopman.

A manager repeatedly told her to remove her hijab, insulted her for wearing it, and once physically grabbed Bashir and tried to rip the hijab off her head, according to the suit.

Bashir complained to human resources and then filed a formal complaint alleging discrimination with the Equal Employment Opportunity Commission and was subsequently fired in 2010.

After several days of hearing testimony and deliberation, a jury in Jackson County Circuit Court on Thursday ordered AT&T to pay $5 million in punitive damages on top of $120,000 in actual damages.

AT&T spokesman Marty Richter said the company would appeal.

"AT&T is a nationally recognized leader in workforce diversity and inclusion, something in which we take great pride. We disagree with the verdict and plan to appeal," Richter said.

Bashir's lawyer said the jury award was "monumental" to Bashir, but said it had little impact on AT&T, a multi-billion-dollar global corporation.

"The company has an excellent written policy," said Coopman.

"If they had just followed the policy none of this would have happened."
