FREEDOM OF SPEECH / FREEDOM OF EXPRESSION

Freedom of speech is the freedom to speak without censorship and/or limitation. The synonymous term freedom of expression is sometimes used to indicate not only freedom of verbal speech but any act of seeking, receiving and imparting information or ideas, regardless of the medium used [United Nations, 1966, 1976]. The right to freedom of speech is recognized as a human right under Article 19 of the Universal Declaration of Human Rights and recognized in international human rights law in the International Covenant on Civil and Political Rights (ICCPR). The ICCPR recognizes the right to freedom of speech as "the right to hold opinions without interference. Everyone shall have the right to freedom of expression". Furthermore freedom of speech is recognized in European, inter-American and African regional human rights law [United Nations, 1966, 1967]. Freedom of speech, or the freedom of expression, is recognized in international and regional human rights law. The right is enshrined in Article 19 of the International Covenant on Civil and Political Rights, Article 10 of the European Convention on Human Rights, Article 13 of the American Convention on Human Rights and Article 9 of the African Charter on Human and Peoples' Rights [Andrew Puddephatt & Hodder Arnold, 2005; Kumar, Ambika, 2006].

In Islamic ethics freedom of speech was first declared in the Rashidun period by the caliph Umar in the 7th century. In the Abbasid Caliphate period, freedom of speech was also declared by al-Hashimi (a cousin of Caliph al-Ma'mun) in a letter to one of the religious opponents he was attempting to convert through reason.

According to George Makdisi and Hugh Goddard, "the idea of academic freedom" in universities was "modelled on Islamic custom" as practiced in the medieval Madrasah system from the 9th century. Islamic influence was "certainly discernible in the foundation of the first deliberately-planned university" in Europe [Boisard, Marcel A., 1980].

KUCHING, Dec 28 — Tongues are wagging over Sarawak federal minister Datuk Joseph Entulu Belaun’s recent marriage to a woman 34 years his junior, after photos of their wedding were posted on social media.
A number of Sarawakians across several social media platforms were generally supportive and congratulated the 61-year-old minister in the Prime Minister’s Department over his marriage last Saturday to 27-year old Jacklyne Anthony, but others found their match incredulous.
“We can only wish them a happy marriage. Maybe, they have their first baby next year,” said Facebook user Michael Moh.

Loti Kong said the age gap is no barrier to a happy married life while Eldric Wong remarked that Entulu is still strong in performing his duties as a husband.
Tiffany Myra remarked that Entulu is old enough to be Jacklyne’s “apai” (father) while Mark Kadir reckoned that the minister’s new mother-in-law could be far younger than him.
“She can call him uncle,” Kadir said in jest.
This is Entulu’s third marriage, after his earlier two ended in divorce. According to a close friend of the family who declined to be named, Entulu has two sons and a daughter from his first marriage.
According to the same friend, Entulu divorced from his second wife earlier this year. His current wife, Jacklyne is understood to work in a kindergarten and this is her first marriage.
The Selangau MP who is also Parti Rakyat Sarawak (PRS) deputy president tied the knot with Jacklyne in a garden ceremony witnessed by family members, relatives and close friends which was followed by a dinner reception at a hotel in Mukah.
Among those present at the wedding dinner were Sarawak Assistant Minister of Native Adat and Penan Affairs Datuk John Sikie, political secretary to Sarawak Chief Minister, Dr Richard Will Uban, political secretary in the Prime Minister’s Department Adriana Chumang Nyambong.
Another notable Sarawak political personality in a May-December marriage is former chief minister-turned-Governor Tun Abdul Taib Mahmud, who at 74 years old, married 30-year old Syrian Ragad Waleed Al -Kurdi, in 2010.

Datuk Seri Mahmud Abu Bekir Abdul Taib's lawyer today questioned the basis for the businessman's ex-wife, Shahnaz Majid, seeking a RM100 million muta'ah (conciliatory payment) claim.
The lawyer, Datuk Seri Zainul Rijal Abu Bakar told the Shariah High Court this was because Shahnaz was the one that had chosen to live separately for 10 years, away from Mahmud Bekir.
He said Shahnaz, as a plaintiff, could have filed for divorce once she started living separately in 1999.
"Living apart for 10 years is also 'contributory' by the plaintiff herself.
He said the plaintiff had instead waited for 10 years and only now had sought conciliatory payment.
Zainul also disputed the amount of RM100 million as claimed by Shahnaz.
"What is the justification that the RM100 million is fair and in accordance with Islamic law?
"The mechanism and method of calculation was not given specifically to the court," he said before Judge Mohammed Abdul Karim Wahab.
Shahnaz's lawyer, Akbardin Abdul Kader during trial on November 17, had said that the amount is not strange because Mahmud Bekir is worth between RM916 million and RM1.334 billion.
He said Mahmud Bekir's expenses reaches hundreds of thousands of ringgit per month.
The judge later set the trial to resume on January 28 next year to hear the response from Shahnaz's lawyer.
He also announced that the decision for this case will be presented on March 10.
On May 11, 2011, the Shariah High Court confirmed the divorce between Mahmud and Shahnaz.
The couple were married on January 9, 1992 and have a son named Raden Murya.
The RM100 million conciliatory payment suit by Shahnaz, who is the elder sister of singer Datuk Sheila Majid, has attracted attention as it is expected to expose former Sarawak chief minister Tun Abdul Taib Mahmud's wealth. – December 22, 2015.

Russia's Putin signs law allowing to overthrow human rights court verdicts





MOSCOW (Reuters) - Russian President Vladimir Putin has signed a law allowing the Constitutional Court of Russia to decide whether to fulfil or not the decisions of international human rights courts.
The law, published on Tuesday on the official government portal of legislative information, enables the Russian high court to overthrow decisions of the Strasbourg-based European Court of Human Rights (ECHR).

WASHINGTON (AP) — Boxing legend Muhammad Ali on Wednesday criticized Republican presidential front-runner Donald Trump's proposal to ban Muslims from entering the United States, calling on Muslims "to stand up to those who use Islam to advance their own personal agenda."
Ali, one of the most famous Muslims in the world, issued a statement saying, "True Muslims know that the ruthless violence of so called Islamic Jihadists goes against the very tenets of our religion."
He added, "I believe that our political leaders should use their position to bring understanding (and not create more chaos, or perplexity for their own selfish political agenda)  about the religion of Islam and clarify that these misguided murderers have perverted people's views on what Islam really is."
Ali's statement Wednesday, first reported by NBC News, did not identify Trump by name but was directed at "presidential candidates proposing to ban Muslim immigration to the United States."
"They have alienated many from learning about Islam," Ali wrote.
President Barack Obama, in a televised address to the nation Sunday night, called on Americans to reject discrimination, saying, "Muslim Americans are our friends and our neighbors, our co-workers, our sports heroes."
On Twitter early Monday, Trump asked, "What sport is he talking about, and who?" — even though Trump has met Ali several times, and even received an award named after the former heavyweight champion in 2007.
The 73-year-old Ali, who was born Cassius Clay, converted to Islam and changed his name in 1964.
Another Muslim sports icon, basketball Hall of Famer Kareem Abdul-Jabbar, weighed in Wednesday with an essay on Time.com. He described Trump as the Islamic State group's "greatest triumph," a candidate who "preys on the fears of the public, doing ISIS's job for them."
Abdul-Jabbar wrote that Trump's claims "have elevated him to the level of a James Bond super-villain. And like those villains, he is doomed to failure."
Also Wednesday, Detroit Lions running back Ameer Abdullah, who is Muslim, spoke with reporters about Trump's proposal.
"When you have someone like him say some things — he has a very large following — it's kind of disappointing from my perspective," Abdullah said. "I just encourage everyone to educate yourself before you take a stance on something that you may not really know about."

KUALA LUMPUR 6 Dis. - Selepas mencadangkan pemansuhan Jabatan Kemajuan Islam Malaysia (Jakim), kumpulan bekas penjawat awam, G25 pula mahu penubuhan sebuah jawatankuasa perunding bagi membincangkan untuk meminda atau memansuhkan beberapa undang-undang syariah.

Antara yang dicadang untuk dimansuhkan ialah hukuman terhadap perbuatan berkhalwat yang didakwa melanggar hak kebebasan seseorang seperti termaktub di dalam Perlembagaan.
Jurucakap G25, Datuk Noor Farida Ariffin berkata, dengan berpandukan pada prinsip Perlembagaan, kumpulan tersebut menentang sebarang hukuman terhadap perbuatan khalwat jika dilakukan di rumah persendirian kerana itu adalah hak dan privasi setiap individu.
Menurutnya, perbuatan khalwat di tempat peribadi adalah dosa peribadi antara pelakunya dengan Allah kecuali jika dilakukan di kawasan awam, namun Malaysia adalah satu-satunya negara yang menjatuhkan hukuman terhadap kesalahan itu.

“Ini bertentangan dengan Islam. Apa orang buat di dalam rumah sendiri, anda tidak boleh ketuk pintu pada pukul 3 pagi dan menahan mereka, ini bertentangan dengan prinsip perundangan Islam, dosa peribadi adalah antara diri sendiri dengan Allah.

“Anda boleh masuk neraka atau tidak, atau apa sahaja tetapi bukan urusan undang-undang menghukum anda ke dalam penjara kerana melakukannya secara privasi di rumah, bukan taman awam,” tegasnya dalam sidang akhbar selepas Forum Islam Dalam Demokrasi Berparlimen di bangunan Persatuan Alumni Universiti Malaya (PAUM) hari ini.

Yang turut hadir, Penasihat G25, Tan Sri Mohd. Sheriff Mohd. Kassim dan Pengerusi Jawatankuasa Penganjur Forum, Datuk M. Redzuan Kushairi.
Noor Farida berkata, pelaksanaan undang-undang syariah menjadi masalah apabila ia melanggar Perlembagaan sehingga menjadikan dosa peribadi seseorang sebagai satu kesalahan jenayah.
“Bidang kuasa jawatankuasa perunding ini adalah untuk melihat jika sesungguhnya undang-undang itu melanggar Perlembagaan, mereka akan mencadangkan ia dimansuhkan atau dipinda,” tegasnya.

Tambahnya, G25 akan mendapatkan kerjasama dan penglibatan daripada semua NGO dalam membincangkan perkara tersebut termasuk kemungkinan memohon dana kerajaan untuk memudahkan pergerakan mereka. Sementara itu, M. Redzuan berkata, jawatankuasa tersebut akan melakukan kajian menyeluruh untuk ‘memperbetulkan’ beberapa perkara di dalam undang-undang syariah yang telah melangkaui sempadan Perlembagaan.

“Ini akan melibatkan masyarakat dan orang ramai, mereka akan mengkaji undang-undang syariah dan sivil untuk melihat di mana bahagian yang pelaksanaan syariah ini melampaui Perlembagaan,” jelasnya.

KUALA LUMPUR 5 Dis. - Kenyataan yang dibuat oleh kumpulan G25 dilihat sebagai mendedahkan keaiban sendiri selepas mempertikaikan kewujudan serta berhasrat meng­audit akuan Jabatan Kemajuan Islam Malaysia (Jakim) tanpa membuat penyelidikan terperinci dalam segala aspek berkaitan.

Timbalan Menteri di Jabatan Perdana Menteri, Datuk Dr. Asyraf Wajdi Dusuki menyifatkan tuduhan kumpulan tersebut tidak berasas tanpa meneliti laporan yang dikeluarkan oleh Jabatan Audit Negara.
Katanya, sehubungan itu, pihaknya bersedia sedia mengadakan pertemuan dan bermuzakarah dengan mana-mana pihak yang tidak berpuas hati dalam segala isu berkenaan agensi tersebut demi pembangunan Islam di negara ini.
“Jakim memerlukan penglibatan pelbagai pihak bagi mengadakan perbincangan secara terbuka untuk mengetahui segala kelemahan dan penambahbaikan yang perlu dilakukan oleh agensi berkenaan.
“Kami tidak mengatakan kami sempurna dan tiada cacat cela. Jika mereka ikhlas mereka harus tampil dan beritahulah masalah atau sebarang isu secara terbuka. Jangan pula kebencian kepada rakyat de­ngan melemparkan pelbagai tuduhan dan tohmahan yang akhirnya akan merosakkan institusi yang berperanan memartabatkan Islam,” katanya.
Beliau berkata demikian ketika ditemui selepas merasmikan majlis perasmian Wacana Eksekutif Indeks Syariah Malaysia di sini hari ini.
Yang turut hadir Yang Dipertua Yayasan Dakwah Islamiah (Yadim), Dr. Yusri Mohamad; Timbalan Pengarah Institut Pengurusan dan Penyelidikan Fatwa Sedunia (INFAD), Universiti Sains Islam Malaysia (USIM) Dr. Ahmad Wifaq Mokhtar dan Rektor Universiti Islam Antarabangsa Malaysia (UIAM), Datuk Seri Dr. Zaleha Kamaruddin.
Sementara itu, Asyraf Wajdi menegaskan, peruntukan yang diterima oleh Jakim telah digunakan bagi membangunkan serta memperkasa institusi Islam di negara ini.


“Kita memperuntukkan hampir RM700 juta untuk diberikan kepada imam, guru agama serta institusi pendidikan Islam setiap tahun. Jumlah tersebut sepatutnya perlu ditambah memandangkan kos sara hidup yang semakin tinggi.
“Selain itu, kita gunakan peruntukan yang telah diberikan oleh kerajaan untuk mengurus dan menjaga hal ehwal Islam dalam pelbagai aspek termasuk isu halal. Ia masih dikira tidak mencukupi kerana kita hanya mempunyai 100 pegawai untuk membuat pemantauan di seluruh negara,” katanya.

Dalam pada itu kata Asyraf Wajdi, pihaknya kini sedang giat menjalankan kajian berhubung indeks syariah di negara ini bersama beberapa universiti di negara ini. Katanya, pihaknya turut menggiatkan pelbagai usaha untuk memberi penjelasan berkaitan pendekatan, implikasi dan kesan pelaksanaannya dalam konteks pembangunan Islam.

RM53 juta ‘terbang’ ke Nigeria

Ditipu sindiket ‘Love Scam’



KUALA LUMPUR 28 Nov. - Sindiket penipuan ‘Love Scam’ yang didalangi warga Nigeria ‘menerbangkan’ wang tunai berjumlah lebih RM53 juta ke Nigeria tanpa sebarang kawalan, pada tahun ini sahaja.

Nilai wang tunai yang besar itu dikutip setelah ribuan mangsa khususnya wanita diperdayakan de­ngan mudah oleh sindiket berkenaan yang menyamar sebagai lelaki berperwatakan menarik di laman-laman sosial.
Difahamkan setiap kali transaksi penghantaran wang tunai oleh sindiket adalah tidak kurang RM3,000 dan kebanyakan proses itu dilaksanakan melalui syarikat kiriman wang, Western Union.
Mengulas tentang perkara itu, Timbalan Pengarah Risikan Operasi Jabatan Siasatan Jenayah Komersial (JSJK), Senior Asisten Komisioner Roslan Abd. Wahid menga­kui, negara masih dibelenggu dengan jenayah penipuan ‘Love Scam’ yang tidak ber­kesudahan sejak sekian lama.
“Pada tahun ini sahaja, pihak kami mengesan sejumlah RM53 juta wang tunai milik mangsa keluar dari negara ini ke Nigeria dan itu menunjukkan bilangan mangsa yang terpedaya adalah begitu ramai. Kebanyakannya adalah rakyat Malaysia dan sebilangannya dari luar negara.
“Jumlah itu terlalu banyak ke­rana setiap mereka yang tertipu adalah kurang RM5,000 malah ada yang mencecah jutaan ringgit. Wang itu juga sukar untuk diperoleh kembali apabila dihantar ke Nigeria, kecuali pihak kami berjaya mengesan awal,” katanya kepada Mingguan Malaysia, di sini hari ini.
Beliau berkata demikian ketika meng­ulas tentang laporan Utusan Malaysia semalam yang mendedahkan tentang seorang jurusolek artis terkenal Hong Kong yang kerugian seba­nyak RM1.3 juta selepas terpedaya dengan sin­diket ‘Love Scam’.
Kerugian jurusolek berusia 30-an itu sekali gus menjadikan dia sebagai mangsa terbesar tahun ini mengikut rekod Polis Diraja Malaysia (PDRM).
Mengulas lanjut, Roslan turut memberitahu, setiap hari lebih da­ripada lima mangsa membuat laporan polis di seluruh negara kerana tertipu dengan sindiket ini.
“Jika empat atau lima orang wanita yang tertipu dan telah ‘me­labur’ sejumlah wang yang besar, maka tidak mustahillah lebih ba­nyak wang dihantar ke Nigeria pada setiap masa.
“Saya sendiri hairan, bagaimana ramai pihak masih belum menye­dari tentang penipuan ini kerana pelbagai pendedahan termasuk laporan demi laporan dilakukan di surat-surat khabar serta kaca tele­visyen sejak sekian lama. Risiko untuk ditipu akan muncul apabila orang ramai hanya mengambil mudah tentang kegiatan ini,” katanya.
Ditanya tentang langkah yang harus dilakukan orang ramai sekiranya mahu mengelakkan dari terjebak dalam penipuan ini, Roslan menyatakan, perkara utama ketika berhubung secara alam maya adalah melihat wajah asal mereka.
“Jika tidak bertemu atas alasan perhubungan jarak jauh, paling tidak adalah berkomunikasi menggunakan video. Lihat sendiri adalah wajah orang yang kita kenali itu sama dengan wajah pada gambar yang diletakkan di laman sosial.
“Majoriti kes penipuan ini adalah mangsa tidak mengenali suspek dan apabila ditunjukkan wajah suspek dari Afrika, mangsa terkejut dan menafikan berhubung dengan mereka. Inilah yang menyukarkan lagi pendakwaan jika adanya tangkapan,” katanya yang mahu wanita-wanita di negara ini mula memandang serius tentang jenayah ini.

1- Delete any email from individual that claims you are the lucky person to received their millions of dollars fortune.

2- Do NOT even engaged in online friends from Nigeria or any Africa country, or Latin America, who are well-known for their poverty and scam ring !

3- Video call (if you are really desperately in love). To be sure that's the 'RICH handsome prince' you talked to on Facebook.

4- BUT if he/she is really rich prince, WHY should he/she even need your "poor money" ? (It just goes to show that the rich prince, is actually poorer than you).

5- NEVER be desperately in love, or in need of money!  You are actually digging your own grave!

PUTRAJAYA 13 Nov. - Di satu sudut, terletak sebuah katil hospital bernilai RM5,000, dan di sudut yang lain terdapat pancuran mandi air panas dan sejuk, yang dilitupi langsir untuk memastikan privasi selain menutupi tandas duduk. Sebuah kipas dinding pula menghadap ke sebuah meja tulis.

Inilah sel Datuk Seri Anwar Ibrahim di Penjara Sungai Buloh, dan beliau tidak dikurung di dalamnya. Beliau dibenarkan bergerak bebas di koridor sepanjang 50 meter. Dan di luarnya pula, terletak kawasan yang boleh dikunjungi Anwar pada waktu petang.

Pihak berkuasa tidak melanggar sebarang peraturan untuk menempatkan Anwar, yang mengalami kecederaan bahu yang kronik tetapi tidak mengancam nyawa, akibat kemalangan jalan raya.
"Tetapi kita longgarkan banyak peraturan," kata seorang pegawai kanan Kementerian Kesihatan, yang memberi gambaran tentang sel Anwar.

Beliau berkata pihak berkuasa Penjara Sungai Buloh juga mengesahkan bahawa sel Anwar dicuci setiap hari bagi memastikan ia sentiasa bersih.

Pegawai itu berkata demikian bagi menjawab tuduhan para penyokong Anwar yang mendakwa pemimpin mereka dikurung di dalam sel yang kotor.

Bagi rawatan perubatannya pula, seramai 17 pakar telah merawat Anwar, yang pada masa ini mempunyai panel perubatan enam pakar untuk memantau keadaan fizikalnya. Enam pakar itu - tiga dari Hospital Kuala Lumpur, dua dari Kementerian Kesihatan dan seorang dari sektor swasta - terkandung dalam tiga syor yang dikemukakan kepada Anwar pada 28 Ogos lepas.

Syor pertama ialah meneruskan rawatan konservatif, syor kedua melakukan pembedahan Artroskopik yang memerlukan invasif yang minimum dan syor ketiga melakukan pembedahan menggantikan sendi bahu.

Pada 28 Sept, seorang pakar pilihan Anwar telah memeriksa bekas ketua pembangkang berusia 68 tahun itu dan bersetuju dengan tiga syor yang dikemukakan itu serta memintanya membuat pilihan. Berdasarkan rekod, Anwar telah bertemu doktor di Penjara Sungai Buloh sebanyak 78 kali, doktor pakar panel di Penjara Sungai Buloh sebanyak 27 kali dan mengadakan pertemuan fisioterapi di Penjara Sungai Buloh sebanyak 12 kali.

Dari Februari hingga 28 Okt lepas, Anwar telah berjumpa dengan keluarganya di Penjara Sungai Buloh sebanyak 13 kali, di hospital (10 kali) dan di mahkamah (10 kali).

Sementara itu, isteri beliau Datuk Seri Dr Wan Azizah Ismail yang juga Presiden PKR dilaporkan telah mendesak supaya Anwar dirawat di luar negara. Tetapi pegawai berkenaan berkata Anwar tidak perlu mendapatkan rawatan di luar negara.
Menurutnya Akta Penjara 1995 tidak membenarkan banduan dirawat di kemudahan bukan kerajaan atau mendapat rawatan di luar negara kerana segala keperluan rawatan sedia wujud di negara ini.

"Kita mempunyai peralatan dan kepakaran untuk melakukan pembedahan Artroskopik atau pembedahan menggantikan sendi bahu - tidak kira mana satu yang dipilihnya.
"Kita terkenal dengan pembedahan ini. Malah, ramai orang dari seluruh rantau ini datang ke negara kita untuk melakukan kedua-dua pembedahan ini,"kata pegawai itu.

"Terutamanya pembedahan Artroskopik yang senang dilakukan dan selalu dilakukan," katanya.
Beliau berkata Anwar boleh ditempatkan di hospital selama tiga hingga empat minggu selepas pembedahan sehingga semua jahitan dikeluarkan dan tiada bahaya jangkitan.

Jika Anwar masih mahukan pakar asing merawatnya di sini, "kita akan permudahkannya. Tiada masalah,"kata pegawai itu. - BERNAMA

Medical grads quit as doctors due to poor English proficiency, says report




Some 1,000 medical graduates have stopped becoming doctors, with their poor command of English being a main factor, The Star reported.
Quoting the Malaysian Medical Association (MMA) Malacca chapter president Dr M. Nachiappan, the daily said medical graduates were also unable to cope with other job pressures.
“Despite having completed their housemanship last year, they are no longer keen to be doctors.
“The main reason was poor grasp of English. This is not good for the medical fraternity and does not augur well for the nation if stakeholders do not execute some plans to improve the standard of English,” he was quoted as saying.
Other factors include lack of interest in basic medical training, poor communication skills with patients and frustration over working conditions.
Expressing worry, Dr Nachiappan said lack of English proficiency will handicap Malaysian medical students from keeping up with their counterparts from other countries.
“There must be an urgency to improve the grasp of the language at the primary level. Otherwise, the quality of doctors will go downhill,” the Malacca Manipal Medical College deputy dean told The Star.
Medical schools were also having difficulty producing medical graduates due to poor command of English, he said.
“The quality of our students is compromised due to their inabilities to communicate in English,” the report quoted him as saying, adding that most reference books on medicine as well as lectures were delivered in English.
The Malaysian Insider had reported in June last year that employers were becoming increasingly dismayed by Malaysia's "generation Y" job seekers, due to their poor command of the English language and communication skills.
A survey by the Malaysian Employers Federation a few years ago found that 60% of them identified low English proficiency as the main problem with young recruits.
A similar survey conducted in September 2013 by online recruitment agency JobStreet.com found that 55% of participating senior managers and companies said poor command of the English language was the main reason for unemployment among undergraduates.
School leavers might have SPM (Sijil Pelajaran Malaysia) English grades of A and B, but could not even hold a conversation in English, MEF executive director Datuk Shamsudin Bardan had told The Malaysian Insider. – November 9, 2015.

ITS not about ENGLISH only actually, its about the JOB pressure that doctors need to handle, some work for more than 10 hours without sufficient REST, and the SALARY is not sufficient for the hours spent. The Medical Association and Ministry of Health need to be realistic and understand the need of doctors. You don't take care of the doctors need, and you expect them to take care of your needs ?!

KEMAMAN 31 Okt. – Sebanyak 102 saman dengan kebanyakan melibatkan kesalahan memandu melebihi had laju dikeluarkan kepada pengguna Lebuh Raya Pantai Timur 2 (LPT2) sepanjang dua jam operasi dijalankan oleh pasukan polis trafik Bukit Aman di Kilome­ter 255.2 dekat Perasing di sini hari ini.

Penemuan terbaharu itu sekali gus menunjukkan peningkatan kes kemalangan maut yang dicatatkan di lebuh raya berkenaan tidak mendatangkan rasa takut kepada pengguna.

Pegawai Penguat Kuasa dan Operasi Trafik Bukit Aman, De­puti Superintenden Mustafa Bakri Salleh berkata, kesalahan yang paling banyak dikesan adalah memandu melebihi had laju 110 kilometer sejam (km/jam).
Lebih memeranjatkan, ada di an­tara pesalah trafik terbabit dikesan memecut melebihi 165 km/jam.

Katanya, pihaknya turut menyaman pengguna berhubung kesa­lahan plat kenderaan; lesen dan cukai jalan tamat tempoh diikuti lampu brek belakang yang tidak berfungsi.  [ Nota:  kesalahan CERMIN GELAP mcm mana? ]. 

“Mereka ini seolah-olah tidak takut dengan pertambahan kemalangan maut yang telah berlaku dan te­rus memandu laju di lebuh raya ini. “Ini menunjukkan bahawa punca kemalangan maut di lebuh raya ini bukanlah disebabkan struktur fizikal jalan sebaliknya, sikap pemandu yang melanggar per­aturan,” katanya ketika menyertai operasi tersebut di sini.
Yang hadir sama, Pegawai Pe­nguat Kuasa Trafik Lebuh Raya Zon Timur, Asisten Superintenden Mohamad Ramli Khamis dan Pegawai Trafik Lebuh Raya Zon 3, Inspektor Suhaimi Mohamad.

Operasi yang bermula seawal pukul 9 pagi itu turut disertai tujuh pegawai dan 22 anggota trafik Bukit Aman.
Menurut Mustafa Bakri, pihak­nya akan terus mengadakan operasi seumpama ini dari semasa ke semasa bagi memastikan pengurangan kes kemalangan maut di lebuh raya terbabit.

“Saya mengambil kesempatan ini untuk menasihati semua pemandu agar tidak memandu laju serta berwaspada terutama ketika hari hujan, selain itu berhentilah di hentian rehat dan rawat (R&R) sekiranya mengantuk.

“Kita juga memandang serius tindakan pemandu lori yang memberhentikan kenderaan mereka di lorong kecemasan dan saya telah mengadakan perbincangan de­ngan pasukan trafik Pahang dan Terengganu untuk mengambil tindakan saman terhadap pesalah,” katanya.

Dalam perkembangan sama, Mustafa Bakri berkata, pihaknya tidak akan berkompromi terhadap kegagalan lampu belakang lori dan treler berfungsi kerana berisiko membahayakan nyawa pengguna lain terutama pada waktu malam.

[Nota:  Pemandu lori TIDAK sepatutnya memberhentikan kenderaan mereka dan berehat di lorong kecemasan utk berehat atau tidur. Mereka perlu berehat di R&R atau tempat yang disediakan. Ini penting supaya kemalangan dapat dielakkan].

Court reverses three-month ban on The Edge




UALA LUMPUR, Sept 21 — The Edge Communications Sdn Bhd today successfully contested Putrajaya’s three-month suspension of its two publications, after the High Court here quashed the Home Ministry order issued over reports on 1Malaysia Development Bhd (1MDB).
High Court Judge Datuk Asmabi Mohamad ruled that the Home Ministry acted irrationally and illegally by issuing the suspension order, also ruling that the latter had breached procedural fairness when issuing a show-cause letter.
Asmabi ruled that the ministry's suspension order be quashed and said damages will be awarded to The Edge after assessment.
"The conclusion, on totality of evidence before the court and relevant law and as discussed earlier, I am satisfied that the decision of the respondent in this case had suffered or is tainted with illegality," she said when delivering her decision at the Kuala Lumpur High Court.
Asmabi said the Home Ministry's suspension was made ultra vires or beyond the powers granted under Section 7(1) of the Printing Presses Publications Act (PPPA).
Asmabi had listed down the facts of the case, highlighting that the Home Ministry had issued a show-cause letter on June 29 to the publisher and made a "blanket allegation" without specifying the articles that were alleged to be undesirable publications.
She pointed out that The Edge was put in a "difficult position" as it had published 300 articles since 2009 on 1MDB and could not give a specific response to the general claim in the show-cause letter, noting that the ministry failed to respond to the publisher's request to specify the articles.
"Bearing in mind that what is being affected here is quite a large thing such as revenue, livelihood of personnel under the applicant, the respondents should have been more careful in preparing a show-cause letter in a better manner to notify the applicant which are the relevant articles said to be undesirable or had infringed provisions or guidelines," the judge said, later saying that natural justice was breached as The Edge was not given an opportunity to be heard in relation to Section 7(1).
Asmabi pointed out that the relevant guidelines and Section 7(1) was not mentioned in the show-cause letter, but that the ministry had used this provision to issue the suspension order against The Edge by claiming the latter had violated Section 7(1) and had published undesirable publications.
She said that Section 7(1) only grants powers to the Home Minister to gazette orders against publications, and is not an offence provision that allows action to be taken against The Edge when no gazette was made in this case.
Among other things, Asmabi said that Home Minister Datuk Seri Dr Ahmad Zahid Hamidi was himself "in doubt" on whether The Edge had published its articles by relying on allegedly unverified information on online news portals, especially Sarawak Report.
Asmabi noted the July 23 notice to the suspension order was issued just a day after the Home Ministry gave a three-hour notice for a meeting lasting 30 minutes with The Edge's representative, where the ministry's officials asked the publisher for the source of its articles.
Before delivering her decision, Asmabi had said: "The decision is also made solely based on facts presented before me unaffected by any surrounding circumstances around 1MDB."
Asmabi ordered costs of RM15,000 to be paid to The Edge Communications, who was represented by its lead counsel Darryl Goon today.
Alice Loke, the lead counsel acting for the Home Minister and the Home Ministry's secretary-general, told Malay Mail Online that she will have to seek instructions on whether an appeal will be filed.
The Home Ministry had in July suspended the printing permits of The Edge Financial Daily and The Edge Weekly for three months over their reports on 1MDB.
The three-month printing suspension was set to end on October 27.
The suspension order came three weeks after Home Minister Ahmad Zahid announced on July 1 that a show-cause letter had been issued to The Edge for publishing what the government deemed to be unverified news on debt-laden 1MDB.

COMMENTS:

1- How can the Home Minister simply used Section 7 of the Printing Presses Publications Act ? OR uses it "Ultra Vires" that is beyond the power granted ?  

2- Which part of the article is "undesirable", the minister/ministry need to be more specific ?

3- The Edge was not given the opportunity to be heard in relations to Section 7(1) ?  Which is clearly against Natural Justice. 

4- Home Ministry needs to be fair in its zeal to "content" the mass media and general public. Scare tactics is the thing of the past. New civilized approaches need to be implemented.

5- The judge is very fair in this case!  Judges should not be scare by bad politicians! This is the modern civilized world. We practice democracy and no one is above the law!
