FREEDOM OF SPEECH / FREEDOM OF EXPRESSION

Freedom of speech is the freedom to speak without censorship and/or limitation. The synonymous term freedom of expression is sometimes used to indicate not only freedom of verbal speech but any act of seeking, receiving and imparting information or ideas, regardless of the medium used [United Nations, 1966, 1976]. The right to freedom of speech is recognized as a human right under Article 19 of the Universal Declaration of Human Rights and recognized in international human rights law in the International Covenant on Civil and Political Rights (ICCPR). The ICCPR recognizes the right to freedom of speech as "the right to hold opinions without interference. Everyone shall have the right to freedom of expression". Furthermore freedom of speech is recognized in European, inter-American and African regional human rights law [United Nations, 1966, 1967]. Freedom of speech, or the freedom of expression, is recognized in international and regional human rights law. The right is enshrined in Article 19 of the International Covenant on Civil and Political Rights, Article 10 of the European Convention on Human Rights, Article 13 of the American Convention on Human Rights and Article 9 of the African Charter on Human and Peoples' Rights [Andrew Puddephatt & Hodder Arnold, 2005; Kumar, Ambika, 2006].

In Islamic ethics freedom of speech was first declared in the Rashidun period by the caliph Umar in the 7th century. In the Abbasid Caliphate period, freedom of speech was also declared by al-Hashimi (a cousin of Caliph al-Ma'mun) in a letter to one of the religious opponents he was attempting to convert through reason.

According to George Makdisi and Hugh Goddard, "the idea of academic freedom" in universities was "modelled on Islamic custom" as practiced in the medieval Madrasah system from the 9th century. Islamic influence was "certainly discernible in the foundation of the first deliberately-planned university" in Europe [Boisard, Marcel A., 1980].

President Trump faced intensifying legal challenges on Monday over his decree sharply restricting immigration from the Muslim world, as two Democratic-leaning states signaled that they would attack the policy in court and a Muslim advocacy group filed a lawsuit calling the order an unconstitutional religious test.
The emerging legal actions are an aggressive effort by Democratic officials in the states to undercut Mr. Trump’s Executive Order, amid a chaotic debate in Congress over the propriety of the policy. WASHINGTON: US President Donald Trump on Monday fired the acting attorney general, a holdover from the Obama administration, after she ordered Justice Department attorneys not to defend his controversial executive order on immigration.

 “The acting attorney general, Sally Yates, has betrayed the Department of Justice by refusing to enforce a legal order designed to protect the citizens of the United States,” the White House said in a statement. “President Trump relieved Ms Yates of her duties and subsequently named Dana Boente, US attorney for the Eastern District of Virginia, to serve as acting attorney general until Senator Jeff Sessions is finally confirmed by the Senate.” -- AFP

Thousands gather around Washington to protest Trump travel ban

DULLES: Throngs of noisy demonstrators – and scores of lawyers – poured into Dulles International Airport outside Washington on Sunday to show support for immigrants impacted by President Donald Trump’s contentious travel restrictions.

Similar protests were taking place outside the White House and across the United States as outrage grew over Trump’s executive order, signed on Friday, that imposed sweeping restrictions on some travelers to the country. Saif Rahman, a 38-year-old Iraqi-born US citizen who lives in Virginia, had just flown into Dulles from Istanbul, via Frankfurt. 

He said two border agents were waiting as people got off the plane. About 16 people, including him, were called in for additional screening but he was let through fairly quickly. “I just hope that we can pass this difficult period while maintaining our values as a country,” Rahman said. Trump’s executive order suspended the arrival of all refugees for at least 120 days, Syrian refugees indefinitely – and bars citizens from Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen for 90 days. 

With each new international arrival at Dulles, whoops of support erupted from a crowd of up to some 400 people gathered at the exit point from US customs. People handed out flowers and food, waved greeting signs and chanted slogans, including: “No hate, no fear, immigrants are welcome here,” and “Let them in! Let them in!” It was unclear if, or how many, travelers had been detained at Dulles. 

Four congressmen said they had been refused access to the area where the travelers would be held, a move lawyers said was in contempt of a court order issued late Saturday. “The executive order is terrible, it’s bad and we are going to fight it,” Democratic Representative John Delaney told AFP. Trump should “realize the error in his ways, which is something I believe he is incapable of doing, and reverse this thing,” Delaney added. 

Julia Mendelson, 31, came to protest with her mother. “I had family killed in the Holocaust, and I think it’s shameful to have any ban on immigration,” she said. “When you see injustice, it’s important to stand up and do whatever possible.” Outside the White House, thousands gathered to express their anger at Trump’s move. Khadija Shakour, an American Muslim, said the order was unconstitutional. “It’s wrong, it’s hateful, it’s bigotry,” she said. “He says it’s not a Muslim ban. It is a Muslim ban, especially when you say, ‘I’m gonna look after the Christians,’” Shakour added, referring to Trump saying his plan favored Christian refugees. 

Trump’s executive order has already faced legal setbacks and lawyers around the country are massing in person and online to lend pro-bono support to those whose lives have been upended by the travel ban.
Kate Belinski, a Washington attorney who specializes in political law, was one of about 100 lawyers who showed up at Dulles to offer support. Several volunteer interpreters were also present to lend their help. Many attorneys held bright signs offering legal advice to anyone who had been detained or for their relatives. Belinski called it “unconscionable” to turn back travelers who have already undergone the laborious, and often yearslong process of getting visas. “It is completely beyond the pale, I never would fathom that this could be happening,” Belinski said. “I am concerned this could be an incremental step. It’s got to be stopped so it doesn’t go further.”--AFP

323,047 anak tak sah taraf mengikut Statistik direkodkan JPN !



KOMEN:

WOW... ramai nya anak "tidak sah taraf" ini (dalam bahasa kasar, iaitu, "anak haram").

Dan kebiasaannya, anak tidak sah taraf ini, tiada kewarganegaraan, kerana kewarganegaraan mereka ini diragui. Ini kerana anak ini biasanya terhasil akibat persebutuhan haram, daripada pasangan bukan muhrim (pasangan yang tidak berkahwin).

Perlu difahami, bahawasanya bukan sahaja orang Islam yang terjejas dlm soal ini, Orang bukan Islam juga menghadapi masalah yang sama.

Akibat persetubuhan yang haram ini, dan terhasil anak tidak sah taraf ini. Mereka tidak berjaya utk mengdaftarkan kelahiran anak mereka di JPN, dan mendapatkan "kewarganegaraan" bagi anak ini.

Ini kerana, hanya pasangan yang sah berkahwin, dan mempunyai "surat kelahiran" daripada pihak hospital sahaja akan diterima oleh JPN (utk proses pendaftaran, dan pengeluaran "sijil kelahiran" dan I/C).

Persoalannya, bagaimana pihak kerajaan menyelesaikan masalah ini, dan mengikhtiraf anak tidak sah taraf ini - dan memberikan mereka kewarganegaraan (atau status yang bersesuaian), agar mereka dapat meneruskan sisa hidup mereka, dan mendapatkan keadilan yang sewajarnya (e.g. peluang utk melanjutkan pelajaran, peluang untuk mendapatkan pekerjaan, dan peluang utk berkahwin kelak).

Statistik direkodkan JPN dari 2010 hingga 2015



KUALA LUMPUR 16 Nov. - Seramai 323,047 anak tidak sah taraf direkodkan Jabatan Pendaftaran Negara (JPN) dari tahun 2010 hingga tahun lalu (2010-2015).

Timbalan Menteri Pembangu­nan Wanita, Keluarga dan Ma­sya­rakat, Datuk Azizah Mohd. Dun berkata, daripada jumlah ter­sebut, bilangan kes kehamilan remaja belum berkahwin bagi tahun 2012 hingga 2015 pula adalah seramai 16,270 orang.

Beliau berkata, berdasarkan sta­tistik remaja hamil yang dikeluarkan Jabatan Kesihatan nege­ri dari 2012 hingga tahun lalu, Sarawak, Johor dan Selangor merupakan negeri yang mencatat bilangan tertinggi.

“Statistik remaja hamil di tiga negeri teratas ialah Sarawak (5,426 orang), Johor (2,427) dan Selangor (1,603),” katanya ketika menjawab soalan Datuk Dr. Nik Mazian Nik Mohamad (Pas-Pasir Puteh) di Dewan Rakyat­ hari ini.

Mengulas lanjut, Azi­zah berkata, pi­hak kementerian me­lalui Lem­baga Penduduk dan Pembangunan Keluarga Negara (LPPKN) telah melaksanakan pelbagai program pendidikan untuk mewujudkan kesedaran kepada golongan remaja dan ibu bapa mengenai hubungan seks luar nikah.

Beliau berkata, dasar dan Pelan Tindakan Kesihatan Reproduktif dan Sosial Kebangsaan (Pekerti) 2009 telah diperkenalkan bertujuan untuk melahirkan individu yang berpengetahuan dan mempunyai sikap positif dalam bidang kesihatan reproduktif dan sosial.

“Di bawah Program Pekerti, LPPKN telah mendirikan 16 buah pusat remaja kafe di 10 negeri yang bertujuan meningkatkan akses ke­pada maklumat serta perkhidmatan kesihatan reproduktif dalam kalangan remaja berumur 13 hingga 24 tahun.

“Selain itu, selaras de­ngan pelaksanaan dasar itu juga, Majlis Latihan Khidmat Negara (MLKN) bersetuju de­ngan cadangan kementerian untuk mewujudkan Program Pekerti dalam Program Latihan Khidmat Negara (PLKN) seluruh negara,” jelasnya.

How budget cuts affect public universities

KUALA LUMPUR, Jan 11 ― The austerity drive in public universities has resulted in a conundrum between providing quality education and working within a much tighter budget compared to previous years.
Under Budget 2017, public universities will see their combined operating budgets slashed by about 19 per cent, or RM1.5 billion, a bigger cut than last year’s budget, and out of the 20 public universities in Malaysia, 10 of them will be facing massive cuts ranging from over 10 per cent to over 31 per cent.
Higher Education Minister Datuk Seri Idris Jusoh has reportedly said that public universities have become too dependent on government funding, and that a decade ago, it was a fraction of what was now given.
But what do the budget cuts mean? What is the feasibility of public universities sourcing out alternative funding? Will it compromise the quality of education being offered in varsities?
Seeking funds in turbulent times
Professor Emeritus Datuk Abdul Rahman Embong believes that public universities should be allowed to continue providing education and training and serving the community as best they can, and that reducing their operating budgets will affect this.
“Reducing the budget for public universities and demanding that they raise their own funding has the effect of turning the principle of education as a public good on its head. 
“I would like to state a fundamental principle that education is a public good, and that it is the responsibility of the government who is supposed to represent the public interest to ensure it is offered to the public from the judiciously managed taxpayers’ coffers,” Abdul Rahman, who is adviser to the Malaysian Social Science Association and Principal Fellow at Universiti Kebangsaan Malaysia's (UKM) Institute of Malaysian and International Studies (IKMAS), told Malay Mail Online in an email interview.
He said that while some universities will find ways to cope with the budget cuts by collaborating with each other in terms of aspects like facilities, there will be a tight race between varsities to source out alternative means of funding.
“Some will succeed while some others will not be as lucky. It is a crowded market out there with hopeful fund-seekers while funders hold tight to their purse especially during these turbulent times,” he added.
Azmil Tayeb, a senior lecturer with the Universiti Sains Malaysia's (USM) School of Social Sciences, said that the cuts have resulted in university staff being deprived of basic work needs like office telephones and desktop computers.
“A few lucky ones get hand-me-down computers that have seen better days and in most likelihood slow and near obsolete. As the minister has clearly stated, he wants public universities to depend less on government and increase alternative sources of funding.
“That statement in itself is acceptable but the drive for alternative funding should not be done at the expense of diminishing the main function of a public university as a public good serving as the engine for social mobility for the less fortunate. Public universities should not be run as a business entity, where only the bottom line matters,” he told Malay Mail Online in an email interview.
Citing an example of an upcoming event between USM and Bournemouth University in the UK, Azmil explained how a cut in operating expenditures affects possible collaborative work between public universities and their international counterparts.
“The event will be held in Penang at the end of March and there's no allocation for it. It's a great opportunity for USM to establish an international network and expose our students to ideas from outside.
“Raising funds for this event has been very challenging as we try to scrape together contributions from both public and private sectors, which, as it stands now, is still insufficient,” Azmil, who is in charge for the event, said.
He added that USM might have to forgo many collaborative opportunities in the near future due to a lack of funding.
How cuts affect research work, education quality
According to UKM's Abdul Rahman, the financial cutbacks have made it difficult to secure government research grants which are already limited. This means that researchers would have to rely on outside funding, including those offered by international agencies

Comments: 

When there is a budget cut, this will happy the mediocre at the universities, but believe me, it will have impact on the quality of education of our young talents, namely:

1- Okay budget cut, so from now on, no more "Lawatan Sambil Belajar" ke JPA, MAMPU, INTAN, etc.. Even though the "Lawatan Sambil Belajar" seem trivial, but believe me, its an eye opener to our young, who may not even experiences the real public office settings and its operation before this - and this is a great way to promote interest and confidence, and determination to strive for excellent! - And this is gone or reduced.

2- Okay budget cut, so from now on, just relax and do nothing, no more "Sporting Events". This will create a weak and less healthy graduate and citizens in the future. When I was at the universities, and participating in various sports activities, this has instill the natural spirit in me to want to wake up early in the morning and do some exercises. - But nowadays, graduates from IPT are not active in sports and do not do much exercises, this will create a weak society and weak person - And weak persons are easily prone to sickness and many diseases . Therefore easily prone to sickness in the near future.

3- Okay budget cut, so from now on, no more collaborations with international universities or institutions, as you know when we "collaboration",  we need to fork out money first, and spend, before we can see the fruits growing in the future. - And this is also gone, or reduced.

4- Okay budget cut, so from now on, no need to have too many "co-curricula" activities. No need for debate club to go outside to debate, no need to go to Kementerian Sukan for exposure, no need to have friendly matches with other institutions, no need to have Khidmat masyarakat program or Turun Padang programs. - You know the reason for the existence of the co-curricula activities is to instill the leadership quality and confidence, and the will to help others - And all this is even gone, or minimized.

Quality will definitely drop, most people who use their brains will know that !!

KUALA LUMPUR 6 Jan. - Suruhanjaya Pencegahan Ra­suah Malaysia (SPRM) ha­ri ini merampas beberapa dokumen yang disyaki mempunyai kaitan dengan Ketua Setia­usaha (KSU) Kementerian Kemajuan Luar Bandar dan Wilayah (KKLW), Datuk Mohd. Ariff Ab. Rahman yang direman bersama dua anaknya semalam.

Menurut sumber, semua dokumen terbabit dikatakan me­ngandungi maklumat penglibatan suspek dalam penyelewengan dan perbuatan rasuah.
Ujarnya, sebaik sahaja semua dokumen terbabit diteliti, beberapa individu yang terdiri daripada kontraktor dan vendor yang dipercayai memperoleh projek ketika suspek memegang jawatan itu akan dipanggil bagi membantu siasatan.


“Selain mereka, beberapa pegawai dan kakitangan kementerian itu juga dijangka dipanggil untuk memberi keterangan dalam masa terdekat.
“Dalam pada itu, SPRM juga akan menyiasat penglibatan suspek dalam beberapa projek ketika memegang jawatan sama di kementerian lain sebelum dilantik KSU di kementerian itu,” katanya di sini hari ini.

Semalam, seorang KSU berusia 59 tahun itu bersama dua anak­nya direman selama tujuh hari kerana terlibat dalam kes pe­nyalahgunaan kuasa untuk me­nerima rasuah.
Hasil siasatan lanjut, SPRM turut menemukan wang tunai dan jongkong emas bernilai RM2.6 juta di dalam tiga besi peti keselamatan di dua bank tempatan di sekitar Lembah Klang semalam.

Hasil penemuan itu menjadikan jumlah keseluruhan wang tunai dan aset yang dirampas bagi membantu siasatan SPRM setakat ini bertambah kepada RM6 juta.
Dalam pada itu, suspek terbabit juga dikatakan mempunyai lebih 10 lot tanah di Selangor yang diletakkan atas nama ahli keluarganya.

Sementara itu, Timbalan Ketua Pesuruhjaya (Operasi) SPRM, Datuk Azam Baki ketika dihubungi berkata, siasatan masih di peringkat awal dan SPRM dijangka akan merampas lebih banyak dokumen berhubung siasatan ini.
Ujar beliau, setakat ini tiada tangkapan baru yang akan dibuat namun tidak menolak sekiranya melakukan tangkapan pada masa akan datang.

Minggu lalu, pemain te­ngah Brazil, Oscar menyertai pencabar Shenhua, Shanghai SIPG dari Chelsea.

SIPG membayar yuran perpindahan 60 juta euro (RM283 juta) untuk mendapatkan perancang Brazil itu.

JOHOR BARU: The 53-year-old housewife who wrote the word "babi" on a police summons was fined RM100 in a Magistrate's court here.
Tan Yeoh Foong pleaded guilty to committing misbehaviour when the charge was read to her in Mandarin before magistrate Mohd Azlan Shah Mohd Allias on Thursday.
Tan was charged under Section 14 of the Minor Offences Act 1955, which carries a maximum fine of RM100.
She commited the offence at Jalan Tun Abdul Razak at 8.55pm on Dec 13.
Tan was represented by lawyer Chuah Shyue Chien.
It was reported that the woman was arrested after writing "babi" on police summons that was issued to her.

She had earlier disobeyed traffic rules when she blocked traffic by parking her gold Mercedes Benz at a double-lined lane and ignoring signals.
