FREEDOM OF SPEECH / FREEDOM OF EXPRESSION

Freedom of speech is the freedom to speak without censorship and/or limitation. The synonymous term freedom of expression is sometimes used to indicate not only freedom of verbal speech but any act of seeking, receiving and imparting information or ideas, regardless of the medium used [United Nations, 1966, 1976]. The right to freedom of speech is recognized as a human right under Article 19 of the Universal Declaration of Human Rights and recognized in international human rights law in the International Covenant on Civil and Political Rights (ICCPR). The ICCPR recognizes the right to freedom of speech as "the right to hold opinions without interference. Everyone shall have the right to freedom of expression". Furthermore freedom of speech is recognized in European, inter-American and African regional human rights law [United Nations, 1966, 1967]. Freedom of speech, or the freedom of expression, is recognized in international and regional human rights law. The right is enshrined in Article 19 of the International Covenant on Civil and Political Rights, Article 10 of the European Convention on Human Rights, Article 13 of the American Convention on Human Rights and Article 9 of the African Charter on Human and Peoples' Rights [Andrew Puddephatt & Hodder Arnold, 2005; Kumar, Ambika, 2006].

In Islamic ethics freedom of speech was first declared in the Rashidun period by the caliph Umar in the 7th century. In the Abbasid Caliphate period, freedom of speech was also declared by al-Hashimi (a cousin of Caliph al-Ma'mun) in a letter to one of the religious opponents he was attempting to convert through reason.

According to George Makdisi and Hugh Goddard, "the idea of academic freedom" in universities was "modelled on Islamic custom" as practiced in the medieval Madrasah system from the 9th century. Islamic influence was "certainly discernible in the foundation of the first deliberately-planned university" in Europe [Boisard, Marcel A., 1980].

Cubaan bunuh untuk halang dedah jenayah polis, kata Musa





Tan Sri Musa Hassan mengesyaki cubaan membunuh R Sri Sanjeevan semalam, ada kaitan dengan rancangan Pengerusi Pasukan Khas Cegah Jenayah Malaysia (MyWatch) itu untuk mendedahkan sindiket jenayah melibatkan pegawai polis.
Bekas Ketua Polis Negara (KPN) itu membuat jangkaan demikian melalui akaun twitternya malam tadi, beberapa jam selepas Sanjeevan parah ditembak di Bahau, Negeri Sembilan.
"Saya harap polis membuat siasatan untuk mengesan suspek kerana dia (Sanjeevan) ada menerima ugutan bunuh berikutan hasratnya untuk mendedahkan pembabitkan polis dalam sindiket jenayah," katanya melalui akaun beliau, @TSMusaHassan.
Mengikut kenyataan polis semalam, mangsa berada dalam kereta BMW sebelum dihampiri dua lelaki bermotosikal di satu persimpangan di Taman Awana Indah, Bahau.
Pembonceng motosikal itu kemudian dikatakan mengeluarkan senjata api sebelum menembak Sanjeevan yang mengenai rusuk kanan mangsa.
Individu itu juga dikatakan kemudian turun dari motosikal tetapi mangsa memecut kenderaannya.
Sanjeevan dilapor stabil tetapi keadaannya kritikal selepas menjalani pembedahan di Hospital Kuala Pilah.
Sebelum kejadian itu, Sanjeevan ada menerima ancaman bunuh berikutan tweet beliau terhadap Ketua Polis Negara, Tan Sri Khalid Abu Bakar melalui akaun @KBAB51.
Turut mengetag Khalid dan Polis DiRaja Malaysia, Sanjeevan mengepos tweet yang menyatakan ada sindiket akan menembak beliau dan menyerang rumahnya untuk menakut-nakutkan keluarganya.
Sanjeevan berada di barisan depan dalam usaha mencegah jenayah dan sebelum ini mendakwa statistik polis tidak tepat.
Musa kemudian menjadi Penasihat kepada badan bukan kerajaan (NGO) itu, menjelang pilihan raya umum ke-13 (PRU13).

Ditembak ketika memandu






PASUKAN Polis Forensik memeriksa sebuah kenderaan mangsa tembak di Pandan Indah, semalam.
KUALA LUMPUR 2 Ogos - Dalam tempoh tidak sampai 10 hari selepas dua kejadian tembak yang menarik perhatian rakyat negara ini, satu lagi kes sama berlaku, kali ini melibatkan seorang pekerja kedai emas.

Dalam kejadian pukul 8.45 pagi, mangsa cedera parah selepas ditembak dua individu menaiki motosikal di Pandan Indah dekat sini.

Mangsa, Wong Foo Yui, 34, sebelum itu memperlahankan kereta jenis Toyota Camry dipandunya ketika menghampiri petak kuning di persimpangan berhampiran sebuah bank.
Ketua Polis Daerah Ampang Jaya, Asisten Komisioner Amiruddin Jamaluddin berkata, tiba-tiba dua lelaki berjaket hitam menaiki motosikal jenis Yamaha menghampiri kenderaan mangsa lalu melepaskan tiga das tembakan.

Menurut beliau, salah satu tembakan itu mengenai bahu kanan mangsa. "Mangsa yang tergamam dan dalam kesakitan memecut kenderaannya ke Balai Polis Pandan Indah. Kedua-dua suspek yang berusia antara 20 dan 30 tahun melarikan diri," katanya ketika ditemui di tempat kejadian.

Isnin lalu, pengasas Bank Arab-Malaysia, Hussain Ahmad Najadi, 75, maut ditembak di ibu negara dipercayai oleh pembunuh upahan. Pembunuhnya melarikan diri dengan teksi.
Dua hari sebelum itu, pengerusi badan pemantau jenayah, MyWatch, R. Sri Sanjeevan juga parah ditembak dua lelaki ketika berhenti di lampu isyarat di Taman Cempaka, Bahau, Negeri Sembilan.

Dalam pada itu, menurut Amiruddin, sebaik sahaja tiba di balai polis, mangsa yang berasal dari Cheras diberi rawatan segera dan dikejarkan ke Hospital Ampang, keadaannya kini dilaporkan stabil.

Beliau meminta orang ramai yang berada di sekitar lokasi semasa kejadian, khususnya pemandu-pemandu di belakang kereta mangsa tampil memberi maklumat. "Siasatan menyeluruh dijalankan untuk mengesan kedua-dua suspek dan anggota Unit Forensik sedang melakukan siasatan bagi mengesan kelongsong peluru di tempat kejadian," ujarnya.

Arab-Malaysia Bank founder shot dead, wife injured




Arab-Malaysian Bank founder Hussain Ahmad Najadi (pic) was shot dead in a car park at Lorong Ceylon in Kuala Lumpur today, several hundred metres away from the bank headquarters.
The 75-year-old was walking towards his vehicle with his wife when a gunman approached him and fired several shots at his back, killing him on the spot in the 1.30pm incident.

Closed-circuit television cameras showed the assailant was a man wearing a long sleeve checked shirt and khaki pants.
Dang Wangi police chief Assistant Commissioner Zainuddin Ahmad confirmed the incident saying it has been classified as murder.
It is believed that three suspects were involved in the incident, using a Proton Waja taxi.
An eyewitness, who declined to reveal his name, said he was at his food stall when he saw a man walking towards the couple.
"Then I heard gunshots and saw the couple crumple. I ran to safety when I saw the gunman running towards me," he said.
The shooting comes just days after crime watchdog activist R. Sri Sanjeevan was shot in the ribs in his hometown Bahau. There has also been a spate of shootings over the past month.
AmBank Group was founded in 1975 as Arab-Malaysian Development Bank, by Hussain via his Holding company AIAK (Arab Investments for Asia Kuwait). He brought the bank public via the Kuala Lumpur Stock Exchange (KLSE) in 1981.

CAIRO: Egyptian security forces shot dead at least 70 supporters of ousted President Mohammed Morsi early on Saturday, his Muslim Brotherhood said, deepening the turmoil which has convulsed Egypt for weeks.

Brotherhood spokesman Gehad El-Haddad said the shooting started shortly before pre-dawn morning prayers on the fringes of a round-the-clock vigil being staged by backers of Morsi, who was toppled by the army more than three weeks ago.
“They are not shooting to wound, they are shooting to kill,” Haddad said, adding that the death toll might be much higher.
Al Jazeera’s Egypt television station reported that 120 had been killed and some 4,500 injured in the early morning violence on the fringes of a round-the-clock vigil being staged by backers of Morsi near Cairo’s Rabaa al-Adawia mosque.
Reporters at the scene said firing could still be heard hours after the troubles started.
“I have been trying to make the youth withdraw for five hours. I can’t. They are saying have paid with their blood and they do not want to retreat,” said Saad el-Hosseini, a senior Brotherhood politician.
“It is a first attempt to clear Rabaa al-Adawia,” he added.
There was no immediate comment from state authorities on what had happened.
Supporters and opponents of Morsi staged mass rival rallies across the country on Friday, bringing hundreds of thousands into the streets and laying bare deep divisions within the Arab world’s most populous country.       Well over 200 people have died in violence since the overthrow of Morsi, including at least nine on Friday, most of them Brotherhood supporters.
Army chief General Abdel Fattah al-Sisi, who played a central role in the overthrow of Morsi following huge demonstrations against his year-long rule, called for Egyptians to rally on Friday to give him a mandate to tackle “violence and terrorism”.     Hundreds of thousands heeded his call, but Muslim Brotherhood supporters also staged mass, counter-rallies, demanding the reinstatement of Morsi, who was placed under investigation on Friday for a raft of crimes, including murder.
Asked what the strategy of the Brotherhood would be after the second mass killing of its supporters this month by security forces, Haddad said:     “When there are divisions, we go to the ballot box.”      Haddad said police started firing repeated rounds of teargas sometime after 3:00 a.m. (0100 GMT) at protesters who had spilled out of the main area of the Rabaa sit-in and were on a main thoroughfare close to 6th October Bridge.
“Through the smog of the gas, the bullets started flying,” he said. In addition to “special police forces in black uniforms” firing live rounds, he said that snipers shot from the roofs of a university, buildings in the area, and a bridge.
State news agency MENA quoted an unnamed security source as saying that only teargas was used to disperse protesters. He said no firearms were used.
Haddad said the pro-Morsi supporters had used rocks to try to defend themselves. On the podium outside the Rabaa mosque, a speaker urged people to retreat from the gunfire, but “men stayed to defend themselves because women and children are inside the sit-in”, he said.
It was the second time this month there had been a mass killing near Rabaa. On July 8, 53 people died when armed men shot into a crowd after morning prayers close to a Republican Guard compound in the area.
“This is much more brutal because the Republican Guard looked like a tactical military operation. This one looks like a much more brutal aggression,” Haddad said.
Egypt’s army-installed interior minister, Mohamed Ibrahim, said on Friday that the month-old Cairo vigils by Mursi supporters would be “brought to an end, soon and in a legal manner”, state-run al Ahram news website reported.
There is deepening alarm in the West over the army’s move against Morsi. The country of 84 million people forms a bridge between the Middle East and North Africa and receives US$1.5 billion a year in mainly military aid from Washington.
The investigation into Mursi centres on accusations that he conspired with the Palestinian Islamist group Hamas to escape from jail during the 2011 uprising against veteran autocrat Hosni Mubarak, killing some prisoners and officers, kidnapping soldiers and torching buildings. --  REUTERS

Kekejaman tentera Mesir mesti ditentang habis-habisan

KUALA LUMPUR: Sekretariat Himpunan Ulama Rantau Asia (Shura) dan Majlis Perundingan Pertubuhan Islam Malaysia (Mapim) mengecam dan mengutuk dengan keras pembunuhan sekali lagi rakyat Mesir oleh tentera yang berlaku pada Jumaat, baru-baru ini.

“Tindakan terbaru oleh tentera Mesir ini tidak dapat dikompromi sama sekali,” tegas Pengerusi Shura, Abdul Ghani Samsudin dan Presiden Mapim, Mohd Azmi Abdul Hamid dalam kenyataan bersama.

Bagi mereka, ia adalah isyarat jelas bahawa demokrasi yang diperjuangkan oleh Revolusi 25 Jun 2011 sudah dirampas oleh tentera.

Menurut mereka, pada hakikatnya tentera tidak pernah memihak kepada rakyat kerana institusi tentera sejak Mesir merdeka dari sistem monarki telah menjadi komponen yang selama ini hanya memelihara kepentingan golongan elit pegawai tinggi yang menjadi budak kepada kuasa Barat terutama Amerika Syarikat untuk mencengkam dan menindas rakyat dengan zalim.

Tindakan terbaru oleh tentera Mesir ini tidak dapat dikompromi sama sekali. Ia adalah isyarat jelas bahawa demokrasi yang diperjuangkan oleh Revolusi 25 Jun 2011 sudah dirampas oleh tentera.

Pada hakikatnya tentera tidak pernah memihak kepada rakyat kerana institusi tentera sejak Mesir merdeka dari sistem monarki telah menjadi komponen yang selama ini hanya memelihara kepentingan golongan elit pegawai tinggi yang menjadi budak kepada kuasa Barat terutama Amerika Syarikat untuk mencengkam dan menindas rakyat dengan zalim.

Tentera yang bergabung dan berkospirasi dengan kehakiman, golongan liberal dan sekular serta Kristian Koptik dan kelompok mafia tamarroud adalah bertanggungjawab di atas pembunuhan ini.

Atas alasan menolak pemerintahan Ikhwan Muslimin, mereka menerima bantuan Amerika untuk mengguling Morsi dan membunuh rakyat Mesir.

Tentera yang mengguna kononnya mandat dari rakyat dalam perhimpunan anti Morsi yang didalangi oleh tentera sendiri di Tahrir Square telah dengan sengaja menyerang peserta perhimpunan pro Morsi di kawasan Universiti Al-Azhar menjelang waktu sahur pada Jumaat tersebut.

Kini angka kematian meningkat kepada lebih 100 orang dan lebih 1,000 cedera dalam insiden Jumaat itu akibat serangan tembakan rambang tentera dengan peluru hidup  ke arah peserta demonstrasi.

Jelas tentera kini terang-terangan mahu mencetuskan perang sivil dengan rakyat sendiri yang boleh mengheret Mesir ke arah situasi seperti Syria.

Ketua tentera, Fatteh Al-Sisi yang melantik dirinya sebagai Menteri Pertahanan selepas menggulingkan Morsi juga telah secara terbuka mengistiharkan akan ‘membersihkan’ Mesir dari ‘teroris’ yang ditujukan kepada Ikhwan Muslimin dan penyokong Morsi.

Dengan tindakan membunuh rakyat Mesir sendiri melalui serangan brutal ke atas peserta yang tidak mempunyai sebarang daya berhadapan dengan tentera Mesir yang dilengkapi dengan senapang, keretal kebal dan pemancut gas dan air pancut yang  beracun, bermakna peralihan kepada demokrasi yang diidamkan oleh rakyat Mesir hancur samas ekali.

Sangat jelas kelompok anti Islam didalangi oleh tentera dan kuasa luar untuk menolak kemenangan Mohammad Morsi yang terpilih secara pilihanraya yang demokratik. Ini sangat jelas membuktikan demokrasi yang dilaksanakan tentera adalah demokrasi penuh hipokrasi.

Dengan melakukan jenayah paling hina iaitu membunuh rakyat sendiri yang menuntut demokrasi di kembalikan selepas piliharan parlimen dan Presiden Mesir telah memenangkan calon-calon Ikhwan Muslimin, ternyata tentera yang menerima lebih USD1 bilion daripada US setiap tahun menjadi alat untuk membunuh demokrasi yang memihak kepada kelompok  Islam.

Kami mendesak komuniti antarabangsa jangan mendiamkan diri. Rakyat Mesir tidak boleh dibiarkan dibunuh dengan zalim dan mereka yang bertanggungjawab dibiarkan terlepas dari dihukum.

Kami menegaskan Ketua Tentera Mesir mesti dipertanggungjawabkan di atas pembunuhan kejam tersebut dan beliau perlu dibicarakan atas kesalahan jenayah membunuh dan genosid.

Kami menuntut Malaysia mengantungkan hubungan diplomatiknya dengan Mesir untuk menyampaikan mesej yang tegas bahawa tindakan tentera Mesir tidak boleh diterima sama sekali.

Kami bertegas bahawa tuntutan rakyat Mesir untuk Morsi dibebaskan dan beliau dikembalikan sebagai Presiden yang sah adalah tuntutan yang wajar disokong oleh seluruh masyarakat dunia.

Kami mengusulkan gerakan Islam sedunia bersidang segera untuk merumuskan tindakan yang berkesan untuk menghalang pertumpahan darah berterusan di Mesir

SIS boleh disiasat kerana pertikai fatwa !! [SIS under Investigation..... ].

Congratulation to JAWI. Its about time they shut the door on SIS face. Over the years, SIS has bring in more 'provocative' issues and problems, and confused young Muslim girls, rather then helped solve societal problems. Now its members are threatened with arrest for blasphemy.

*Blasphemy = Is the act of insulting or show contempt or lack of reverence for a religious deity, or the irreverence towards religious or holy persons or things, or towards something considered sacred, or inviolable. Blasphemies can also mean any irreverent or disrespectful action or remark made towards religious body or institution (e.g. JAWI).

SIS boleh disiasat kerana pertikai fatwa


KUALA LUMPUR 24 Julai - Sisters In Islam (Sis) boleh disiasat mengikut Seksyen 7 dan 9 Akta Kesalahan Jenayah Syariah (Wilayah-Wilayah Persekutuan) 1997 (Akta 559) kerana mempersoalkan fatwa yang mengharamkan wanita Islam menyertai pertandingan ratu cantik.


Pengarah Jabatan Agama Islam Wilayah Persekutuan (Jawi), Datuk Che Mat Che Ali berkata, jika didapati bersalah di bawah salah satu seksyen tersebut, pertubuhan bukan kerajaan (NGO) itu boleh dikenakan denda tidak melebihi RM3,000 atau penjara maksimum dua tahun atau kedua-duanya.

Menurut beliau, kesalahan di bawah Seksyen 7 melibatkan mana-mana individu atau kumpulan yang secara lisan atau bertulis telah menghina agama Islam atau menyebabkan agama Islam dipandang hina.

''Selain itu, mempersendakan, mengajuk-ajuk atau mencemuh amalan atau upacara yang berhubungan dengan agama Islam serta mempersendakan atau menyebabkan dipandang hina mana-mana undang-undang yang sedang berkuat kuasa di Wilayah Persekutuan yang berhubungan dengan agama Islam juga merupakan kesalahan di bawah Seksyen 7.

''Kesalahan di bawah Seksyen 9 adalah mana-mana individu atau kumpulan yang bertindak dengan cara menghina pihak berkuasa agama atau mengingkari, melanggar serta mempertikaikan perintah Yang di-Pertuan Agong sebagai Ketua Agama Islam, majlis atau mufti, yang dinyatakan atau diberikan melalui fatwa," katanya ketika dihubungi Utusan Malaysia di sini hari ini.

Beliau mengulas kenyataan Sis yang mempertikaikan pengeluaran fatwa di Malaysia dalam isu ratu cantik dengan menyifatkannya sebagai tidak islamik dan demokratik di laman portal berita FMT semalam.

Sis mempersoalkan bagaimana fatwa yang diwartakan pada 8 Februari 1996 di bawah Akta Pentadbiran Undang-Undang Islam (Wilayah-Wilayah Persekutuan) 1993 dan yang lain boleh menjadi undang-undang secara automatik tanpa melalui proses perundangan dan ini telah mencabuli kebebasan asasi seseorang.

Menurut Che Mat, Jawi memandang serius terhadap mana-mana pihak yang mempertikaikan fatwa atau menghina Islam dan akan mengambil tindakan ke atas mereka jika siasatan membuktikan wujudnya perbuatan tersebut.

Beliau berkata, ketegasan Jawi itu boleh dilihat melalui kertas siasatan terhadap wanita Islam yang menyertai Pertandingan Miss Malaysia World 2013 yang telah mula dibuka mengikut Seksyen 7 atas kesalahan mempersoalkan fatwa mengharamkan mereka menyertai pertandingan ratu cantik.

Jawi to query beauty contestants, SIS, organiser for insulting Islam


KUALA LUMPUR: The Federal Territory Islamic Religious Department (Jawi) has begun its investigation against several individuals for allegedly insulting Islam over the participation of four Muslim women in the Miss World Malaysia 2013 beauty pageant.


Jawi director Datuk Che Mat Che Ali in confirming the matter said the department has already questioned several individuals over the issue since  yesterday. He however, refused to divulge details on the identities and the number of people quizzed by the department, thus far.

“We have recorded statements from several individuals over the matter. However, I can’t reveal their identities.
“Besides the Muslim contestants, the department will also call anyone who questioned the gazetted fatwa, which forbids Muslim women from taking part in the beauty pageant, to assist our investigation into the case.
“Questioning the fatwa is similar to insulting Islam” he told the New Straits Times when contacted today.

On whether the department will summon Sisters In Islam (SIS) programme manager Suri Kempe to assist in the probe, Che Mat reiterated that Jawi will called anyone who had questioned the legitimacy of the edict.
He said investigation on the case was being conducted under Section 7 of the Syariah Criminal Offences (Federal Territories) Act 1997 for disrepute or insulting Islam. Those found guilty of committing the offence will be liable to face the maximum RM3,000 fine and two years’ jail or both.

“We will try to complete investigations immediately. And if there is a case, the department prosecution team would begin our legal redress after the Hari Raya Aidilfitri celebration next month,” he said.
Che Mat also said the organiser of the event would also be liable to the same amount of fine and jail sentence if it refused to adhere to the fatwa.

The four Muslim contestants were dropped from the contest after Jawi raised the matter. Federal Territories Mufti Datuk Wan Zahidi Wan Teh said the edict, which prohibits Muslim women from joining beauty pageants was issued and gazetted under the Federal Territories Islamic Administration Act in February 1996. 
One of the contestants, Wafa Johanna de Korte, told a Malay daily on Sunday that the decision to axe them was unnecessary. She claimed there are other Muslim countries like Indonesia, which allows Muslim women to participate in pageants.

Suri, on behalf of SIS, told a news portal that the procedure for legislating fatwas as “un-Islamic” and “undemocratic”.

SIS: Procedure for Legislating Fatwas Un-Islamic and Undemocratic

The recent disqualification of four Miss Malaysia World 2013 beauty contest finalists on the basis that their participation is ‘sinful’ and in contravention of a 1996 fatwa banning Muslims from participating in beauty pageants, raises concerns about the over-reach of fatwas beyond their original intent.

The 1996 fatwa exists as an attempt to control the public conduct of Muslims in terms of dress and indecency, specifically Muslim women. Yet, despite the organisers’ assurance that the contestants will not be required to wear swimming costumes and instead be wearing long pants, their participation was still deemed ‘sinful’. How, where and on what basis do the religious authorities draw the line as to what is indecent dress or indecent behaviour? Do long pants now fall in the category of ‘sinful’ and indecent attire? 

There is also the issue of gender bias. If there can be a fatwa that prevents Muslim women from taking part in a beauty contest, then by the same argument should not there be a fatwa on Muslim men taking part in a body building contest? Does not the Constitution say all are equal before the law and that there can be no discrimination on the basis of gender? We are not saying the simple solution is to ban all such activities, but to raise the point of inconsistency and double-standards.

However, what is of greater concern to Sisters in Islam (SIS) is the larger question of how gazetted fatwas have the automatic force of law without going through the legislative process, and are used as a tool to undemocratically pass laws that infringe on our fundamental liberties.

After approval by the State Executive Council and the Sultan, a fatwa only needs to be gazetted to become law. It is not tabled for debate in the legislative body. Any violation of the fatwa is a criminal offence. Any effort to dispute or to give an opinion contrary to the fatwa is also a criminal offence. Such provisions have no basis in the Quran and historical practices of Islam and violate several articles in the Federal Constitution.

Constitutionally, only Parliament has the legislative authority to make laws in Malaysia at the federal level, and legislative assemblies at the state level. Those not democratically elected, sitting in a closed body, and who do not believe that others have a right to discuss, debate and question matters of religion, cannot be allowed to make law by decree that affect our fundamental liberties.

To remove this threat to parliamentary government, each fatwa should be subjected to affirmative resolution by the legislative body before it can come into effect. This is to ensure that the fatwa goes through a democratic process of debate before it becomes law, thus fulfilling the principle of shura in governance in Islam. Such open debate will also invite public participation in the making of legislation that affect fundamental liberties.

Girl Left in Car for 6 Hours Dies of Heatstroke !

Come on you got 5-6 HOURS to rethink where you send (or have not send your child). Do not be naïve or ignorance. Please go to JAIL and think about it.

That’s what happened when the mother just drive off and do not look behind to see IF the school bag is available, uniform, or that someone is sitting at the back seat, or asleep at the back seat. What or who is MORE important? The child or school meeting?

Furthermore, the mother's brain seems to be too small, like a 'prawn', so forgetful... How is it that she can be a good TEACHER?! IF she can forget about her own child, do you think that she can remember about your child IF it is under her CARE ?? 

Do not be naïve, what ‘Sudden Death’ it’s a clear case of ‘negligence.’ !! 

PITY the death little girl NOT the negligence mother!

SUBANG JAYA – A three-year-old  child was found dead at the back seat of her mother’s car on Thursday.
The child, Nawal Iris Samsudin, is believed to have died of heat exposure after being left for over five hours in the car.
During the incident, the victim’s mother, Nor Zatusy Hazwa Abdul Rahim was believed to have been rushing for a meeting at a school at 11 am.
She said she had not realised that her daughter was asleep at the back seat of her car.
She only realised that her daughter was in the car when she returned to it at 5.30 pm.
Her daugher had however died when she was found and the body was sent to the Serdang Hospital for a post-mortem.

SUBANG JAYA: A girl died from heatstroke after she was left in her mother’s car for more than six hours on Thursday.


The incident happened between 11am and 5.30pm at the compound of SMK USJ4, here, and police are investigating the mother for negligence.

Subang Jaya district police chief Assistant Commissioner Yahaya Ramli said Nawal Iris Samsudin, 3, was found dead by her mother, Norzatusy Hazwa Abdul Rahim, 32, at 5.30pm when the teacher was about to go home after work. Initial investigations found that Norzatusy Hazwa had forgotten to send Nawal Iris to the nursery before she went to work.

“Usually, the mother was the one who drove Nawal Iris to the nursery every morning. "However, for several days before the incident, the duty was undertaken by Norzatusy Hazwa's sister.

"Yesterday, Norzatusy Hazwa went to the school for a meeting after sending her sister to Subang Airport. "When she arrived at the school about 11am, Norzatusy Hazwa did not realise that she had yet to send Nawal Iris to the nursery and that the child was sleeping in the car's back seat," Yahaya said yesterday.

He said Norzatusy Hazwa, who teaches in the school's afternoon session, continued with classes until the day's session ended at 5.30pm.

When Norzatusy Hazwa found Nawal Iris, the girl's body was stiff and the skin was bluish.
She was then rushed to a nearby clinic, where a doctor pronounced her dead upon arrival.
Post-mortem conducted on the victim, who was the younger of two siblings, found that she had died from a heatstroke.

Yahaya said the incident, initially classified as sudden death, was now being probed under Section 33 of the Child Act 2001 (leaving a child without reasonable supervision).

A school staff member, who wished to remain anonymous, said Norzatusy Hazwa was about to open the car door when she saw Nawal Iris' body and screamed. "The situation turned chaotic for a moment.

"Norzatusy Hazwa and several other people then rushed Nawal Iris to a clinic nearby.
"When Norzatusy Hazwa was holding Nawal Iris in the car, the girl was covered in sweat and her head and body were soaked through."

The staff member said Norzatusy Hazwa's car was parked in the school's open air car park in front of the main building and that the weather was hot when the incident happened.
It is learnt that Norzatusy Hazwa was rushing to attend a meeting after sending her sister to the airport.

The staff member said Norzatusy Hazwa arrived late for the meeting, after which the latter continued with her classes.

Attempts to get comments from Nawal Iris' parents were unsuccessful.

About 30 family members and friends were at Nawal Iris' funeral at the USJ 22 cemetery here yesterday afternoon. One of the victim's uncles, who declined to be named, said the family was shocked over the incident, but accepted it as God's will.

MUM GETS 4 YEARS FOR BABY'S DEATH




KUCHING: The magistrate's court here sentenced a mother to four years' jail for causing the death of her 9-month-old child earlier this month.
Housewife Melissa Nawawi, 28, pleaded guilty to causing the death of Danish Firdaus on July 6.
In passing sentence, magistrate Zulhairil Sulaiman, after hearing her guilty plea, ordered that Melissa's jail term to start from the date of her arrest.
Zulhairil said as a mother, the accused should have been more responsible to prevent such an incident.
"I hope this sentence will serve as a lesson to her and the public in general," said Zulhairil.
After the sentence was read, Melissa cried in the witness stand and later banged her head several times against the wall as she was taken to the lock-up.
Based the facts of the case, the accused's 29-year-old sister, Dalilah, had found bruises all over Danish's face, chest and abdomen after Melissa ran away from her home in Kampung Seratau to a house in Mile 13, Jalan Kuching Serian on June 16.
Danish was later taken to Sarawak General Hospital and warded in the intensive care unit, where doctors found the child had been neglected and malnourished.
The accused had run away from her home following abuse by her husband.

GEORGE TOWN – Seorang profesor Universiti Sains Malaysia (USM) dihadapkan ke Mahkamah Sesyen di sini hari ini terhadap tiga pertuduhan membuat kenyataan palsu dalam tuntutan elaun perjalanan untuk tugasan rasminya pada 2010.
Prof Dr P. Ambigapathy, pensyarah Pusat Pengajian Bahasa, Literasi dan Terjemahan USM mengaku tidak bersalah selepas pertuduhan dibacakan di hadapan Hakim Khairul Anuar Abdul Halim.
Ambigapathy, 56, dituduh melakukan ketiga-tiga kesalahan itu di pejabat USM dengan niat memperdayakan Pembantu Tadbir Kewangan Haryatie Zainor, dengan menyerahkan dokumen iaitu kenyataan tuntutan elaun perjalanan dalam negeri yang palsu bagi bulan Februari 2010 untuk tugasan rasminya dengan nilai sebanyak RM1,242.
Kesemua tuntutan perjalanan rasmi itu dibuat dengan menggunakan kereta sendiri jenis Mercedez Benz  bernombor pendaftaran PJL 1292 sedangkan tertuduh sebenarnya menggunakan kereta jabatan jenis Proton Perdana dengan nombor pendaftaran PHJ 6116.
Bagi pertuduhan pertama, Ambigapathy didakwa pada 10 Februari 2010 telah mengemukakan tuntutan perjalanan rasminya bagi kerja lapangan dan mengumpul data  penyelidikan yang berlangsung pada 6 hingga 8 Februari 2010.
Bagi dua lagi pertuduhan, beliau didakwa pada 7 Jun 2010 telah mengemukakan tuntutan perjalanan rasminya untuk kajian penyelidikan di USM Kubang Kerian, Kelantan dan Universiti Malaysia Kelantan (UMK) pada 6 Februari 2010 dan ke Universiti Malaysia Terengganu (UMT) pada 7 Februari dan 9 Februari 2010.
Beliau didakwa mengikut Seksyen 18, Akta Suruhanjaya Pencegahan Rasuah Malaysia  (SPRM) 2009 yang memperuntukkan hukuman penjara maksimum 20 tahun atau denda tidak kurang dari lima kali ganda atau nilai butir matan yang palsu jika dapat dinilai atau berbentuk wang atau RM10,000, mengikut mana lebih tinggi.
Hakim Khairul Anuar membenarkan tertuduh diikat jamin RM8,000 dengan seorang penjamin dan  menetapkan 16 Ogos untuk sebutan semula kes.

Lecturer faces jail, fine over mileage claims

GEORGE TOWN: AUNIVERSITI Sains Malaysia lecturer claimed trial in the Sessions Court yesterday to three charges of making false claims amounting to RM1,242 three years ago.

Professor Ambigapathy Pandian, a former dean at the School of Language, Literacy and Translation in USM, was accused of committing the offence against financial administrative assistant Haryatie Zainor, 33, at the USM office between Feb 10 and June 7, 2010.

On the first charge, the 56-year-old was alleged to have knowingly given Haryatie an interstate mileage allowance claim in February 2010 for fieldwork and gathering of research data carried out between Feb 6 and 8.

He was alleged to have made the claim for using his own vehicle, a Mercedes Benz, when he had actually used the department's Proton Perdana for the 800km trip.

On the second charge, Ambigapathy was accused of knowingly giving Haryatie another interstate mileage allowance claim for February 2010 for research at USM's Kubang Kerian campus in Kelantan and Universiti Malaysia Kelantan, as well as a trip to Universiti Malaysia Terengganu (UMT) on Feb 6 and 7, 2010 respectively.

He is alleged to have made the claim on June 7, 2010, when actually the mileage claim had already been paid to him on March 23, 2010.

On the third count, he was charged with knowingly submitting to Haryatie an interstate mileage allowance claim for a trip to UMT on Feb 8, 2010 to carry out a study when in fact he had not gone there.

The offences, under Section 18 of the Malaysian Anti-Corruption Commission Act 2009 and punishable under Section 24 of the same act, carries a maximum 20 years' jail and a fine of not less than five times the amount of the claim, or RM10,000, whichever is higher.

Dressed in a yellow shirt and cream-coloured pants, Ambigapathy appeared calm when the charges were read out to him. Deputy public prosecutor Janariah Abdul Mutalib, who appeared for MACC, asked for bail to be set at RM10,000 on all three charges.

M. Athimulan, who represented Ambigapathy, asked for the amount to be lowered, stating that his client had served in USM for 30 years and that he was still lecturing as a professor at the university as well as supervising doctorate students.

Athimulan also told the court that the offences committed by his client were simple technical mistakes. Judge Khairul Anuar Abdul Halim set bail at RM8,000 in one surety and fixed Aug 16 for mention.

COMMENTS:

What is ALL this? Of ALL the corrupted politicians and corporate leaders that get away with millions of ringgit worth of tax evasion and corrupted money, SPRM has to spend a large amount of resources of manpower and pay their officials (travelling expenses, logging, meals) worth at least a few hundreds (each personnel), and multiple that by 2-5 officials who must go down and interrogate/investigate the professor concerned (plus desk staff's salaries, plus paper works costs, etc.), just for what? So that they can nab a professor in USM who is alleged to falsely claim mileage of RM1242 ?!

I just thought that the professor might have discriminate someone or make someone upset enough, so much so, that the individual concerned spent much times complying enough paper evidences to launch a compliant with SPRM. 

Lesson to be learnt is, ‘NO one is indispensable.’ Even IF you are a professor, so you need to treat your staff well – every time. Administrative staff too should not be too proud, they are dispensable as well !  Work with integrity and be happy with your salary (as per your qualification) is the teaching of all religion.   

I just thought, an INTERNAL enquiry by the Dean or Vice-Chancellor, where a stern warning be giving to the professor concerned, or worst case scenario, ‘advise’ the professor to ‘resign’ from service, or further action be taken. Court action is too much, especially for the professor who has spent almost 30 years in service for USM. Crime is crime, but still humane consideration can also be given. Also by doing that, the ‘corporate image’ of USM will also be safeguard.     

Damage has already been done, to the university’s image and professor concerned, regardless whether the professor is found guilty or not later. I am just sad that of recent, school teachers and lecturers seem to be the target of criminals and crooks. Decades back, school teachers and lecturers are the most highly respect professions. It still is, but today, it’s much more vulnerable!
