FREEDOM OF SPEECH / FREEDOM OF EXPRESSION

Freedom of speech is the freedom to speak without censorship and/or limitation. The synonymous term freedom of expression is sometimes used to indicate not only freedom of verbal speech but any act of seeking, receiving and imparting information or ideas, regardless of the medium used [United Nations, 1966, 1976]. The right to freedom of speech is recognized as a human right under Article 19 of the Universal Declaration of Human Rights and recognized in international human rights law in the International Covenant on Civil and Political Rights (ICCPR). The ICCPR recognizes the right to freedom of speech as "the right to hold opinions without interference. Everyone shall have the right to freedom of expression". Furthermore freedom of speech is recognized in European, inter-American and African regional human rights law [United Nations, 1966, 1967]. Freedom of speech, or the freedom of expression, is recognized in international and regional human rights law. The right is enshrined in Article 19 of the International Covenant on Civil and Political Rights, Article 10 of the European Convention on Human Rights, Article 13 of the American Convention on Human Rights and Article 9 of the African Charter on Human and Peoples' Rights [Andrew Puddephatt & Hodder Arnold, 2005; Kumar, Ambika, 2006].

In Islamic ethics freedom of speech was first declared in the Rashidun period by the caliph Umar in the 7th century. In the Abbasid Caliphate period, freedom of speech was also declared by al-Hashimi (a cousin of Caliph al-Ma'mun) in a letter to one of the religious opponents he was attempting to convert through reason.

According to George Makdisi and Hugh Goddard, "the idea of academic freedom" in universities was "modelled on Islamic custom" as practiced in the medieval Madrasah system from the 9th century. Islamic influence was "certainly discernible in the foundation of the first deliberately-planned university" in Europe [Boisard, Marcel A., 1980].

Anggota Polis Tolak Rasuah


Komen:
Elok lah macam itu, walaupun (saguhati) nampak kecil tapi penting untuk menaikkan moral dan semangat anggota polis agar 'jujur' dalam tugas mereka. Anggota polis juga perlukan 'motivasi' dan latihan 'integriti' yang sesuai dari semasa ke semasa. Jangan ingat nak cepat 'kaya.' Lagipun wang rasuah tak berkat.

Dua polis tolak rasuah terima sagu hati

SHAH ALAM: Dua anggota polis daripada Ibu Pejabat Polis Daerah (IPD) Gombak diraikan dalam majlis Pemberian dan Penyampaian Wang Saguhati di atas kejayaan mereka menahan anggota sindiket samun kereta mewah di Lembah Klang dan menolak pemberian wang rasuah RM7,000 yang cuba disogok suspek terbabit.

Allahyarham Koperal Mustafa Othman, 45, dan Lans Korperal Abdullah Ibrahim, 51, tidak menduga lelaki yang ditahan dalam kenderaan mewah BMW pada 24 Mei lalu dekat Pasar Borong Selayang penjenayah. Suspek terbabit cuba merasuah kedua-dua anggota berkenaan menyebabkan mereka menahan suspek sebelum kegiatan lelaki terbabit terbongkar.

Penyampaian sagu hati itu dibuat di Ibu Pejabat Polis Kontinjen (IPK) Selangor disempurnakan Pengarah Jabatan Siasatan Jenayah Bukit Aman, Datuk Seri Mohd Bakri Mohd Zinin kepada Abdullah. Allahyarham Mustafa diwakili balunya, Sarjan Nazita Nokman, 44, yang juga seorang anggota polis dan bertugas di Unit Pengaduan Tatatertib Bukit Aman.

Hadir sama, Ketua Polis Selangor, Datuk Tun Hisan Tun Hamzah dan pegawai kanan polis. Nazita ketika ditemui berkata, suaminya meninggal dunia dalam kemalangan jalan raya pada 27 Mei lalu ketika pulang dari Tanjung Karang selepas mengambil anaknya. “Arwah seorang yang tegas dan berdisiplin dalam tugas,” katanya.

Suami Syok Amah ! Salah Siapa ?

Once in a while, I would like to highlight something different. In the case below, both the husband and wife are at fault. The wife, due to her busy schedule did not bother to 'beautified' herself, for her sake and for her husband, as a result, the husband go and find other source of 'beauty'. The husband is also at fault for not appreciating the wife sacrifice.

Would it be any different IF the wife had beautified herself in the first place? Maybe and maybe not... but at least she can confidently says 'I have tried to beautified myself for my husband, but he still leave me.'

KUALA LUMPUR: Remuk hati seorang isteri apabila suami yang dikahwini lebih 20 tahun lalu mengeji payudaranya sudah tidak menarik sebelum meninggalkannya untuk menjalin hubungan cinta dengan pembantu rumah warga Indonesia.

Isteri malang itu yang hanya mahu dikenali sebagai Faridah, 43, mendakwa suaminya yang berusia 45 tahun mengabaikan dia dan anak-anak sejak tiga bulan lalu hingga langsung tidak menghulurkan nafkah.

“Hati saya bertambah sakit apabila suami tanpa segan silu memberitahu niatnya untuk berkahwin dengan gadis Indonesia itu tahun depan. “Paling menyedihkan apabila bentuk fizikal saya yang tidak lagi menarik selain payudara saya yang sudah kendur dijadikan bahan sindiran untuk menghina dan mencaci saya di depan anak.

“Dia sering bersungut kononnya saya malas menjaga badan menyebabkan dia hilang selera setiap kali bersama saya. Maruah saya dihina hingga saya malu apatah lagi bila dia sengaja bercakap dengan suara tinggi hingga didengar jiran,” katanya ketika ditemui di rumahnya di Gombak.

Faridah mendakwa, suaminya juga sering membandingkan dirinya dengan amah Indonesia itu yang didakwa berkulit tegang dan gebu kerana mengamalkan pemakanan jamu selain petua awet muda. Faridah yang mendirikan rumah tangga pada 1990 berkata, keadaan kekurangan fizikal dialami banyak berpunca dari faktor genetik selain terpaksa menyusukan semua enam anaknya ketika mereka kecil. Kini anaknya berusia antara lima hingga 20 tahun.

“Akibat kesempitan hidup, saya tidak mampu membelikan susu tepung dan terpaksa memberi susu badan kepada semua anak. Ada antaranya yang menghisap susu badan sehingga berusia lima tahun. Mungkin faktor itu menyebabkan payudara saya tidak lagi menarik,” katanya.

Dia yang bergantung hidup dengan menjual kuih dan nasi lemak memberitahu kesibukannya berniaga selain menguruskan anak-anak serta rumah tangga menyebabkan keadaan dirinya sering kali tidak terurus. “Saya sedih diperlakukan seolah-olah saya tiada harga diri. Di matanya, saya cukup jijik hingga makanan yang saya hidangkan sering kali tidak dijamah,” katanya.

Kata Faridah, sebelum ini dia banyak berkorban untuk keluarga kerana menyedari pendapatan suaminya yang kecil selain perlu menanggung kos sewa rumah, persekolahan dan makan minum keluarga. “Namun apa yang saya lakukan ini langsung tidak dihargai apabila dia kemaruk bermain cinta dengan gadis Indonesia yang bekerja sebagai pembantu rumah.

“Perkara ini hanya saya sedari apabila telefon bimbit suami saya kerap berdering pada waktu malam sebelum dia dilihat gemar berbual dalam keadaan berbisik. “Rasa curiga menyebabkan saya memberanikan diri bertanya sebelum dia tanpa berselindung menyatakan hasratnya untuk berkahwin dengan gadis Indonesia itu dan meminta saya memberi persetujuan,” katanya.

Tidak mengaku terima rasuah

KUALA LUMPUR 21 Dis. – Bekas Pengurus Kanan Kebolehan Marin Sime Darby Engineering Sdn. Bhd. mengaku tidak bersalah di Mahkamah Sesyen di sini hari ini atas tuduhan menerima rasuah RM200,000 daripada seorang pemilik syarikat pembinaan kapal, dua tahun lalu.

Mazhazmi Jamaludin, 36, merupakan individu kedua yang didakwa di mahkamah sejak pendedahan mengenai kerugian RM2.1 bilion yang ditanggung oleh Sime Darby Bhd. (Sime Darby) pada Mei lalu. Dia yang tiba di mahkamah dengan ditemani isteri dan seorang lagi rakannya dilihat menitiskan air mata beberapa minit selepas duduk di galeri awam.

Pada 6 Ogos lalu, Pengurus Besar Sime Darby Holdings Bhd., Zamri Mohd. Iderus, 39, mengaku tidak bersalah di Mahkamah Sesyen Shah Alam atas dua pertuduhan menerima rasuah RM99,000 serta menggunakan maklumat harga bidaan tanpa kebenaran syarikat pada 2008.

Pada prosiding hari ini, Mazhazmi didakwa menerima rasuah wang tunai RM200,000 daripada pemilik syarikat pembinaan kapal, MLC Shipbuildings Sdn. Bhd. (MLC), Redzuan Goh Mohammed Karian.

Suapan wang tersebut adalah sebagai upah bagi mencadangkan MLC kepada Sime Darby dalam mendapatkan kontrak pembinaan dan penjualan tiga buah kapal tunda (barge) bernilai AS$134.2 juta (RM467.9 juta). Upah tersebut juga didakwa sebagai balasan kepada tertuduh yang mengesahkan bayaran tertentu bagi pembinaan kapal-kapal tersebut.

Perbuatan itu didakwa dilakukan antara pukul 1.25 petang dan 5 petang, 31 Disember 2008 di bilik mesyuarat syarikat tersebut yang terletak di Megan Avenue 1, Blok C, 6-1, Jalan Tun Razak di sini.

Pertuduhan terhadapnya dikemukakan mengikut Seksyen 11(a) Akta Pencegahan Rasuah 1997 dan boleh dihukum di bawah Seksyen 16 akta yang sama.

Jika sabit kesalahan, tertuduh boleh dihukum penjara minimum 14 hari atau tidak melebihi 20 tahun dan denda RM10,000 atau lima kali ganda nilai suapan atau yang mana lebih tinggi.

Pendakwaan dikendalikan oleh Timbalan Pendakwa Raya dari Suruhanjaya Pencegahan Rasuah Malaysia (SPRM), Kevin Morais manakala tertuduh diwakili peguam bela, Shamsul Sulaiman. Morais mencadangkan jaminan RM20,000 dengan seorang penjamin terhadap tertuduh tetapi dibantah oleh peguam bela.

Shamsul ketika memohon jumlah jaminan tersebut dikurangkan turut meminta wang jaminan yang telah dikenakan oleh SPRM sebelum ini iaitu sebanyak RM10,000 dikembalikan kepada tertuduh agar boleh digunakan untuk membayar jamin.

Morais memohon mahkamah mengekalkan jumlah jaminan yang dicadangkan ekoran jumlah wang rasuah yang terlibat dalam kes itu adalah tinggi.

Hakim Rozilah Salleh kemudian membenarkan tertuduh diikat jamin RM20,000 setelah menyifatkan jumlah yang dicadangkan oleh pihak pendakwaan adalah munasabah.

Mahkamah turut menetapkan 7 Januari ini untuk sebutan semula kes itu bagi membolehkan pihak pendakwaan membekalkan dokumen berkaitan kepada pihak pembelaan mengikut peruntukan di bawah Seksyen 51A Kanun Tatacara Jenayah.

KUALA LUMPUR: A former senior manager of Sime Darby Engineering Sdn Bhd was charged at the Sessions Court here today for accepting bribes to secure a contract for the construction and sale of three barges. Mazhazmi Jamaludin, 36, claimed trial to the charge after it was read to him.

Mazhazmi, now a general manager in an investment holdings company, was charged with committing the offence as a senior manager in Kebolehan Marin (marine services) in Sime Darby engineering on Dec 31, 2008, between 1.25 to 5pm at the MLC Shipbuildings Sdn Bhd meeting room in Jalan Tun Razak, here.

Mazhazmi had allegedly accepted a RM200,000 bribe from the owner of MLC shipbuilding, Redzuan Goh Mohammed Karian, to secure a contract by suggesting, "MLC construction and sale of one Derrick Lay Barge construction and sale of one unit 75m (Wartsila 8000 bhp) Anchor handling truck/ supply vessel Hull number : 75084 worth US$134.2 million".

Mazhazmi allegedly also approved payment for the construction of a unit of Derrick Lay Barge Hull no MLC 12888 and two units of Anchor Handling Tug/Supply Vessels Hul number 75083 and 75084. He was charged under Section 11 of the Anti-Corruption Act 1997 and is liable to a maximum jail term of 20 years and a fine of not less than five times the value of the bribe or RM10,000, whichever is higher. Judge Rozilah Salleh set bail at RM20,000 with one surety.

Mazhazmi's counsel, Shamsul Sulaiman, told the court his client claimed he was tortured by the Malaysian Anti-Corruption Commission (MACC) during investigations. "My client was initially told he was being questioned as a witness but later was charged. He was stripped naked and blindfolded before being forced to engage in physicals acts, such as standing on one leg. He was also verbally abused and gave a statement he was told to," Shamsul said.

MACC senior deputy public prosecutor cum Assistant Director of Legal & Prosecution, Anthony Kevin Morais disagreed with Shamsul's statement. "Mazhazmi was released on police bail in June. He had six months to file a police report but he did not and only today is it brought up," he said. Mazhazmi was dressed in a pink checkered shirt was seen wiping his tears when Shansul told the court about the alleged abuse.

The court set Jan 7 for mention.

Former Immigration deputy D-G gets 56 years for graft

KUALA LUMPUR: The Sessions Court here this morning sentenced former Immigration Deputy Director-General Yusof Abu Bakar to 56 years jail and a RM620,000 fine after he was found guilty of 14 charges of accepting bribes amounting to RM121,500 for approving the extension of social visit passes for Chinese nationals.

Judge Abu Bakar Katar found Yusof guilty of the charges last Thursday after hearing submissions from deputy public prosecutor Ahmad Sazilee Abdul Khairi and Yusof's counsel Mohammed Azmi Mohd Said.

Abu Bakar, however, ordered the sentence to run concurrently. Yusof will only face six years in jail as that is the highest sentence that can be handed for his 14 charges. The judge also ordered the jail term to begin from the date of conviction, which was on Dec 16. Yusof, 56, was dressed in a dark blue blazer and looked calm when the sentence was read out.

Mohammed Azmi asked for a stay of execution from the court as they planned to file an appeal. Abu Bakar allowed the stay with the condition that they post a RM20,000 bail with two sureties as well as file the appeal by tomorrow. In mitigation on Thursday, Mohammed Azmi urged the court to impose a non-custodial sentence on his client.

He said the crime committed by Yusof had not hurt any one and he cooperated during investigations. Mohammed Azmi said Yusof stood to lose his pension and gratuities even though he had served the government for 32 years.

Yusof, according to the lawyer, had already suffered when one of his two sons died in an accident earlier this year. Furthermore, he suffers from diabetes, heart problems and high blood pressure. Ahmad Sazilee, meanwhile, asked the court to mete out the sentence to serve as an example for civil servants involved in graft.

Yusof, according to the DPP, was a PTD (Administrative and Diplomatic Officer) at JUSA grade C level when he committed the offence. Yusof was charged on Oct 14, 2008, with accepting bribes of between RM500 and RM18,000 from a sales manager between March 21 and June 25 the same year. The offences were committed in his office at Level 7 of the Immigration Department in Putrajaya; at the Federal Hotel in Jalan Bukit Bintang and at a Caltex petrol station in Jalan Pudu.

On Nov 14, 2008, Yusof, was charged with four counts of corruption in the Klang Sessions Court as well as one corruption charge at the Petaling Jaya Sessions Court. All cases were transferred to the Kuala Lumpur Sessions Court when trial started on Feb 22.

Kes Tajuddin Ramli: SPRM temui bukti baru


KUALA LUMPUR 15 Dis. - Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) menemui bukti baru berkaitan rasuah dan salahguna kuasa yang dipercayai melibatkan bekas Pengerusi Malaysia Airlines System Bhd. (MAS), Tan Sri Tajuddin Ramli.

Pengerusi Panel Penilaian Operasi (PPO) SPRM, Tan Sri Dr. Hadenan Abdul Jalil berkata, bukti-bukti baru terbabit diterima SPRM beberapa bulan lalu.

Difahamkan, antara bukti diterima suruhanjaya itu adalah beberapa dokumen yang dipercayai boleh membantu siasatan.

Menurutnya, buat masa ini, pihak SPRM masih lagi menjalankan siasatan dan keputusannya belum diketahui.

"Bukti-bukti baru itu diterima daripada pelbagai sumber dan bila siasatan telah selesai kita akan kemukakan.

"Saya ingin tegaskan di sini bahawa, SPRM tidak pernah tutup siasatan kes itu dan dakwaan yang menyatakan SPRM tidak menjalankan siasatan adalah tidak benar sama sekali," katanya kepada pemberita di sini hari ini.

Beliau dan beberapa PPO SPRM sebelum itu mengadakan mesyuarat PPO di Akademi Pencegahan Rasuah Malaysia (MACA) di Jalan Duta di sini.

Sebelum ini, Naib Presiden Pas, Salahuddin Ayub menggesa kerajaan menyiasat semula kerugian yang pernah dialami oleh MAS sebanyak RM8 bilion ketika syarikat tersebut diterajui oleh Tajuddin dalam tempoh antara 1994 hingga 2001.

Hakim Mahkamah Syariah & Rasuah !




KOMEN:

Apa sudah jadi dengan hakim mahkamah syariah kita? Hakim mahkamah syariah umpama 'ustaz' yang berjawatan tinggi... gaji pun boleh tahan... tapi sempat lagi buat rasuah?!

Antara masalahnya, mungkinkah:

1- Gaji tak cukup tinggi?

2- Tidak ada sistem 'check and balance' yang berkesan daripada pihak atasan (dan juga panel hakim)? Sistem Integriti Penjawat Awam @Hakim yang berkesan?

3- Mungkin juga tiada sistem 'maklumbalas awam' yang efektif (effective public feedback), dimana pendapat dan pandangan umum (aduan awam) dianggap sebagai 'sampah.'

Buatlah 'interview' dengan 'hakim' tersebut, dan tanyalah apakah sebenarnya yang berlaku sehingga menyebabkan keruntuhan darjat/moral yang begitu drastik? Jangan cari salah saja, dan masuk hakim tersebut ke dalam jail. Cari juga 'apakah punca sebenar' yang menyebabkan berlakunya krisis tersebut, dan apakah 'sistem integriti' yang perlu diadakan pada masa akan datang.




Bekas hakim dipenjara 19 tahun kerana rasuah

PULAU PINANG 13 Dis. – Ketua Hakim Mahkamah Tinggi Syariah dan pasangannya yang sebelum ini ditahan oleh penguat kuasa Jabatan Agama Islam Pulau Pinang (JAIPP) kerana disyaki bersekedudukan, dilepaskan oleh Mahkamah Rendah Syariah di sini dengan bon mahkamah RM3,000 setiap seorang.

Hakim Nik Bukhari Hashimy Nik Yahya menetapkan jumlah tersebut selepas pihaknya dimaklumkan oleh peguam Ahmad Munawir Abd. Aziz yang mewakili pasangan terbabit bahawa anak guamnya sudah berkahwin di luar negara.

Pada prosiding di mahkamah hari ini, peguam itu turut mengemukakan surat pengesahan pernikahan pasangan terbabit. ‘‘Justeru itu, pihak pembelaan memohon siasatan semula dilakukan sebelum sebarang tindakan lanjut diambil terhadap suspek sama ada mereka didakwa ataupun sebaliknya atas tuduhan berkenaan,’’ kata Ahmad Munawir.

Nik Bukhari menetapkan 31 Januari depan untuk sebutan semula kes tersebut bagi membolehkan tindakan susulan dibuat oleh pihak pendakwaan terhadap suspek yang berusia 40-an dan 30-an. Terdahulu, kedua-dua suspek hadir ke mahkamah pada pukul 10 pagi diiringi peguam mereka, Ahmad Munawir yang turut dibantu oleh Wan Faridulhadi Md. Yusof.

Kes tersebut kemudiannya didaftarkan oleh Bahagian Pendakwaan JAIPP. Ketua Pendakwa Syarie, Mohd. Zulkhairi Aziz mendaftarkan kes itu mengikut Seksyen 27 (a) (b) Enakmen Kesalahan Jenayah Syariah Negeri Pulau Pinang 1996 iaitu berkhalwat. Bagaimanapun pertuduhan berkenaan tidak dibacakan terhadap pasangan itu setelah pihak pembelaan mengemukakan representasi kepada Ketua Pendakwaan Syarie Pulau Pinang supaya kes tersebut disemak semula.

Tindakan tegas hakim khalwat

PULAU PINANG 9 Dis. – Jabatan Agama Islam Pulau Pinang (JAIPP) hari ini mengesahkan seorang hakim Mahkamah Tinggi Syariah di negeri ini ditahan kerana disyaki bersekedudukan dengan seorang wanita di sebuah perumahan kerajaan di sini Ahad lalu.

Pengarahnya, Sazali Hussin berkata, buat masa ini, kes membabitkan hakim tersebut yang berusia lingkungan 40-an dan berkhidmat di Mahkamah Tinggi Syariah di sini sedang giat dijalankan. “Kita bertindak atas aduan yang dibuat orang awam dan buat masa ini tidak dapat beri komen kerana ia masih dalam siasatan,” katanya kepada Utusan Malaysia ketika dihubungi di sini, hari ini.

Sebuah akhbar hari ini melaporkan, seorang Hakim Mahkamah Tinggi Syariah ditahan penguat kuasa JAIPP kerana disyaki bersekedudukan dengan seorang wanita di kuarters kerajaan di Georgetown di sini, pada Ahad lalu. Menurut laporan itu, hakim terbabit ditahan kira-kira pada pukul 2 pagi dan ketika serbuan dilakukan isteri dan anaknya tiada di rumah kerana dikatakan berada di ibu kota.

Sementara itu, Ketua Polis Pulau Pinang, Datuk Ayub Yaakob ketika dihubungi turut mengesahkan pihaknya menerima laporan mengenai penangkapan seorang hakim dan wanita kerana disyaki berkhalwat. Sementara itu, di ibu negara, Menteri di Jabatan Perdana Menteri, Datuk Seri Jamil Khir Baharom berkata, pihaknya akan mengambil tindakan terhadap hakim syariah tersebut.

Hakim syariah bersekedudukan

KUALA LUMPUR: Seorang hakim Mahkamah Tinggi Syariah ditahan penguat kuasa Jabatan Agama Islam Pulau Pinang kerana disyaki bersekedudukan dengan seorang wanita di kuarters kerajaan di Georgetown, Ahad lalu. Menurut sumber, hakim terbabit yang berusia 40-an ditangkap ketika bersama pasangannya kira-kira jam 2 pagi.

“Sewaktu kejadian, isteri dan anaknya tiada di rumah kerana dikatakan ke ibu kota. “Pasangan itu ditangkap penguat kuasa agama hasil maklumat diperoleh,” katanya ketika dihubungi, semalam.

Hakim terbabit dikatakan berkhidmat di Mahkamah Tinggi Syariah di sebuah negeri di utara Semenanjung sejak lebih setahun lalu. Sebelum ini, beliau bertugas di Jabatan Kehakiman Syariah Malaysia (JKSM), Putrajaya. Kes berkenaan bagaimanapun masih di peringkat siasatan Jabatan Agama Islam Pulau Pinang dan hakim terbabit belum didakwa, sebaliknya dia dibebaskan dengan jaminan Jabatan Agama Islam selama seminggu.

Sumber itu berkata, kes berkenaan agak sulit (??) kerana mempunyai unsur ugutan daripada tertuduh terhadap pegawai penyiasat. Namun, katanya, pihak penyiasat sudah membuat laporan polis berhubung perkara berkenaan. “Pada masa ini hakim terbabit diberi jaminan penguat kuasa. Tempoh jaminan akan berakhir Isnin depan dan pada hari berkenaan, kes dijangka disebut di mahkamah syariah.

“Beliau sebelum ini dikatakan mengugut pegawai siasatan dan penguat kuasa dengan mengancam untuk mengambil tindakan jika mereka meneruskan kes berkenaan kerana beliau mendakwa mempunyai hubungan rapat dengan pihak atasan,” katanya.

16 saksi untuk bicara kes Dr Ling

KUALA LUMPUR: Kes bekas Menteri Pengangkutan, Tun Dr Ling Liong Sik (67 tahun) yang didakwa atas tuduhan menipu Kerajaan Malaysia untuk memberi persetujuan pembelian tanah di Pulau Indah, Pelabuhan Klang bagi pembinaan projek ‘Mega Distribution Hub’ yang kini dikenali Zon Bebas Pelabuhan Klang (PKFZ) pada 2002 ditetapkan untuk perbicaraan pada 3 Mei tahun depan.

Tarikh itu ditetapkan Hakim Datuk Ahmadi Asnawi selepas kes berkenaan yang dipindahkan dari Mahkamah Sesyen Putrajaya disebut di Mahkamah Tinggi, di sini, semalam. Sekurang-kurangnya antara 15 hingga 16 saksi akan dipanggil untuk memberi keterangan dalam perbicaraan itu nanti. Dr Ling, 67, didakwa atas satu tuduhan utama dan satu tuduhan pilihan menipu Jemaah Menteri untuk memberikan persetujuan terhadap pembelian tanah di Pulau Indah bagi projek PKFZ (dahulu dikenali sebagai Mega Distribution Hub) di Pelabuhan Klang.

Bagi kedua-dua tuduhan, bekas menteri itu didakwa melakukan perbuatan itu antara 25 September 2002 dan 6 November 2002 di Tingkat 4, Pejabat Perdana Menteri, Bangunan Perdana Putra, Putrajaya. Bagi pertuduhan utama, beliau didakwa menipu berhubung pembelian tanah berdasarkan terma yang dipersetujui di antara Kuala Dimensi Sdn Bhd dengan Lembaga Pelabuhan Klang (LPK) yang antara lainnya adalah:

•Luas tanah 999.5 ekar (404.5 hektar) atau (43,538,200 kaki persegi);

•Kadar pembelian tanah sebanyak RM25 satu kaki persegi (skp) menjadikan jumlah pembelian bernilai RM1,088,456,000 dan;

•Tempoh pembayaran balik berdasarkan kaedah ‘deferred payment’ (bayaran tertangguh) selama 15 tahun dengan kadar faedah 7.5 peratus setahun (berjumlah RM720,014,600).

Bekas menteri itu didakwa secara curang menyembunyikan fakta ke atas tanah itu iaitu kadar RM25 skp bagi tempoh bayaran balik 10 tahun atau RM25.82 skp bagi tempoh bayaran balik 15 tahun adalah termasuk kadar kupon/faedah yang boleh dikenakan untuk tempoh itu.

Penyembunyian fakta itu mendorong Jemaah Menteri bersetuju terhadap pembelian tanah itu sedangkan beliau mengetahui perbuatannya boleh menyebabkan kerajaan menanggung kerugian. Bagi tuduhan itu, beliau didakwa mengikut Seksyen 418 Kanun Keseksaan yang memperuntukkan hukuman penjara maksimum tujuh tahun atau denda atau kedua-duanya.

Dr Ling turut didakwa atas tuduhan pilihan menipu Jemaah Menteri dengan menyembunyikan fakta serupa pada waktu dan tempat yang sama. Bagi tuduhan itu, beliau didakwa mengikut Seksyen 417 kanun serupa yang memperuntukkan hukuman penjara maksimum lima tahun atau denda atau kedua-duanya.

Terdahulu pada prosiding semalam, peguam Wong Kian Kheong yang mewakili Dr Ling memohon mahkamah menetapkan tarikh bicara pada Mei bagi memberinya peluang meneliti segala dokumen yang akan diserahkan oleh pihak pendakwaan. Peguam Negara Tan Sri Abdul Gani Patail, yang mengetuai pihak pendakwaan, memberitahu mahkamah bahawa pihaknya akan menyerahkan dokumen berkaitan bulan depan, membabitkan lebih 200 dokumen. Dr Ling hadir ke mahkamah ditemani isterinya Toh Puan Ena Ling dilepaskan dengan jaminan bon peribadi RM1juta.

KUALA LUMPUR 8 Dis. - Bekas Menteri Pengangkutan, Tun Dr. Ling Liong Sik akan dibicarakan di Mahkamah Tinggi di sini mulai 3 Mei depan atas tuduhan menipu Jemaah Menteri berhubung skandal Zon Bebas Pelabuhan Klang (PKFZ) melibatkan pembelian tanah bernilai RM1.08 bilion, hampir lapan tahun lalu.

Hakim Datuk Ahmadi Asnawi menetapkan perbicaraan tersebut selama 14 hari iaitu sehingga 20 Mei depan, ketika kes itu disebut kali pertama di hadapan beliau hari ini selepas dipindahkan dari Mahkamah Sesyen Putrajaya pada 30 November lalu

Sein, Nana sah bercerai
SHAH ALAM: Bagaikan sudah terkena badi, mahligai perkahwinan juara program realiti Sehati Berdansa musim ketiga, Sein Ruffedge dan Nana menemui titik nokhtah apabila Mahkamah Tinggi Syariah, di sini, membenarkan permohonan perceraian pasangan itu dengan talak satu, semalam.

Sein, 27, atau nama sebenarnya Syed Hussein Syed Mustaffa melafazkan talak pada jam 2.46 petang, selepas mahkamah membenarkan permohonan Nana, 26, yang juga anak bekas Menteri Besar Selangor, Tan Sri Muhammad Muhd Taib untuk berpisah secara baik. Nana yang pernah menyertai rancangan realiti, Mentor musim pertama memfailkan permohonan itu mengikut Seksyen 47 Enakmen Undang-Undang Keluarga Islam Selangor 2003.

Prosiding perceraian berkenaan berlangsung di hadapan Hakim Syarie Zainor Rashid Hassin dan Nana atau nama sebenarnya, Noor Diyana Muhammad diwakili peguam syarie, Zuri Zabudin Budiman. Sein bagaimanapun tidak diwakili peguam syarie.

Terdahulu, Zuri Zabudin memberitahu, permohonan untuk bercerai itu difailkan berikutan pasangan terbabit tidak lagi mempunyai persefahaman dalam rumah tangga yang dibina sejak Julai 2006. “Pasangan ini tidak dapat lagi menjalani kehidupan sebagai suami dan isteri dan wujud perbalahan berpanjangan. Mereka masih serumah tetapi tidak tidur bersama. Pelbagai usaha sudah dijalankan tetapi tiada jalan penyelesaian,” katanya. Zainor Rashid selepas mendengar lafaz itu mensabitkan gugur talak satu kali pertama secara rajie terhadap Nana dan memerintahkan dia untuk beredah selama tiga kali suci.

Beliau juga memerintahkan supaya perceraian itu didaftarkan di Pejabat Agama Daerah Petaling dan surat nikah pasangan tersebut dibatalkan. Sein dan Nana mendirikan rumah tangga pada Julai 2006 dan hasil perkongsian hidup mereka dikurniakan dua cahayamata, Syed Tamriz Al-Qudsy, 3, dan Sharifah Inaiya Al-Qudsy, 1. Sein yang kini aktif sebagai pelakon dan pernah menjayakan drama bersiri ‘Adamaya’ bergandingan dengan Lisa Surihani. Dia juga pernah muncul sebagai pelakon undangan dalam Hotel Mania terbitan KRU Studio selain membintangi filem Sepi arahan Khabir Bhatia. Sein dan Nana adalah pasangan peserta Sehati Berdansa terbaru yang tidak dapat mempertahankan rumah tangga mereka. Sebelum ini, pasangan Asheed Def-Gab-C, Atilia, Dira Abu Zahar, Radhi OAG, Sabrina Ali dan Anne Ngasri turut menerima nasib sama. Pengacara Fahrin Ahmad yang menjalinkan hubungan dengan Linda Onn dan Scha Al Yahya ketika mengacara program ini turut berdepan kontroversi panas.

A videotape showing the moment an eight-year-old boy accidentally shot himself dead with an Uzi submachine gun is too gruesome to be shown in court, lawyers for a gun fair organiser charged with the boy's manslaughter say. Christopher Bizilj was killed when he lost control of the Uzi and shot himself in the head at a gun fair in Westfield, Massachusetts, in 2008.

The video was filmed by Christopher's father, Dr Charles Bizilj, who was standing nearby as his son fired a 9mm micro Uzi submachine gun at a pumpkin. The boy lost control of the gun as it recoiled. Edward Fleury, who owned the company that organised the event, has been charged with Christopher's manslaughter.

Edward Fleury, who is the former police chief of Pelham, Massachusetts, has pleaded not guilty and is scheduled to go on trial next week. Fleury's lawyers say the videotape is gruesome and is likely to elicit an emotional reaction from jurors and prejudice them against their client. They are asking the judge to keep the videotape out of the trial or, if not, then to bar prosecutors from playing the audio portion of the tape, which includes the father's anguished reaction to the death of his son.

One of Fleury's lawyers, Rosemary Curran Scapicchio, said the videotape was graphic and could evoke bias against her client. "I'd hate to have the jurors not be able to remain impartial after they've seen the video," Scapicchio said.

SPRM ambil kenyataan dua pegawai Yayasan Selangor
SHAH ALAM 26 Nov. - Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) semalam mengambil kenyataan dua pegawai Yayasan Selangor bagi membantu siasatan kos tidak munasabah majlis makan tengah hari sempena sambutan ulang tahun ke-40 yayasan itu yang mencecah RM300,000.

Kenyataan kedua-dua pegawai terlibat yang masing-masing dari bahagian perundangan dan sumber manusia itu diambil di ibu pejabat yayasan tersebut di Petaling Jaya. Difahamkan, SPRM turut mengambil beberapa dokumen dari pejabat kedua-dua pegawai terlibat untuk membantu siasatan.

Pengurus Besar Yayasan Selangor, Ilham Marzuki yang dihubungi Utusan Malaysia mengesahkan perkara itu. Menurut Ilham, beliau diberitahu mengenai kedatangan SPRM ke pejabat yayasan melalui telefon kerana berada di bangunan Setiausaha Kerajaan Negeri (SUK) untuk menghadiri mesyuarat Majlis Tindakan Ekonomi Selangor (MTES).

"Kami akan memberikan kerjasama sepenuhnya kepada SPRM hingga siasatan kes ini selesai," katanya. Isnin lalu, SPRM menahan seorang pegawai kanan Yayasan Selangor bagi membantu siasatan kos tidak munasabah majlis makan tengah hari itu. SPRM kemudian mendapatkan perintah tahanan reman selama seminggu terhadap pegawai kanan yang sedang menjalani arahan cuti bergaji selama sebulan itu yang akan berakhir 29 November ini.

Semalam, SPRM mengambil kenyataan Menteri Besar, Tan Sri Abdul Khalid Ibrahim bagi membantu siasatan yang sama. Bagaimanapun pihak Sekretariat Akhbar Menteri Besar hari ini memaklumkan bahawa kunjungan SPRM itu bukan bertujuan mengambil keterangan daripada Menteri Besar seperti yang dilaporkan.

Tetapi kunjungan yang diketuai Pengarah SPRM Selangor, Datuk Jaafar Mahad itu bertujuan memaklumkan kepada Menteri Besar secara rasmi berkenaan penahanan seorang pegawai kanan Yayasan Selangor sebelum ini.

Pekerja Asing Tak Beradab (di Malaysia)

Pekerja asing tak beradab

MELAKA: Cara hidup negatif pekerja industri warga asing dari Nepal, Bangladesh dan Vietnam yang menyewa rumah di Taman Ayer Keroh Height, Ayer Keroh, dekat sini, menimbulkan pelbagai masalah kepada penduduk tempatan. Selain berkongsi sehingga 20 orang dalam sebuah rumah yang dijadikan asrama, pekerja asing terbabit tidak menjaga kebersihan selain kerap membuat bising dan bergaduh.

Keadaan bertambah buruk apabila mereka melakukan perbuatan memalukan apabila mandi di luar rumah dalam keadaan separuh bogel dan pergaulan bebas antara lelaki dan wanita. Difahamkan, masalah terbabit berlarutan sejak sekian lama, namun belum diatasi sepenuhnya apabila pekerja asing terbabit ‘keras kepala’ dan enggan mematuhi peraturan pihak berkuasa tempatan mahupun menghormati adab dan budaya masyarakat tempatan.

Susulan aduan penduduk di taman itu, Yang Dipertua Majlis Perbandaran Hang Tuah Jaya (MPHTJ), Kamarudin Md Shah mengarahkan satu operasi pendatang tanpa izin dijalankan di kawasan terbabit, baru-baru ini. Operasi bermula jam 8 malam disertai seramai 69 orang anggota dari MPHTJ, Bahagian Pekerja dan Pelajar Antarabangsa (BPPA) Jabatan Ketua Menteri, Jabatan Imigresen, Ikatan Relawan Rakyat (Rela), Polis Diraja Malaysia (PDRM) dan Jabatan Kesihatan Negeri.
Ia diketuai Pengarah Penguat Kuasa MPHTJ, Mohd Sham Dali dan Penolong Pegawai Penguat Kuasa, Muhammad Munir Sharabudin bertujuan memastikan semua warga asing yang bekerja di kawasan pentadbiran pihak berkuasa tempatan (PBT) itu mempunyai permit dan pasport selain aspek kebersihan dan keselamatan penduduk terjamin.

Sepanjang operasi, sebanyak 21 rumah di Lorong Setia 1 dan 3 di taman berkenaan diserbu dan dua rumah didiami penghuni warga Vietnam, Bangladesh (sebuah) dan Nepal (18 buah).

Rumah terbabit dihuni ramai warga asing yang bekerja di kilang memproses makanan berhampiran di Taman Perindustrian Ayer Keroh. Pelbagai karenah warga asing khususnya lelaki antaranya ada yang mandi dengan hanya memakai seluar dalam di luar rumah beramai-ramai sambil membasuh pakaian tanpa mempedulikan kehadiran anggota penguat kuasa.

Selain itu, keadaan rumah terbabit amat menjijikkan dan kotor serta berbau busuk dengan pakaian bergantungan di dinding dan tingkap serta katil, tandas tersumbat, peralatan memasak berselerakan dan sampah-sarap bertaburan. Kamarudin berkata, dalam operasi itu, seramai 360 warga Nepal, 40 warga Vietnam dan 20 warga Bangladesh diperiksa dan semua mereka didapati mempunyai dokumen serta permit yang sah.

Katanya, walaupun tiada tangkapan dilakukan, pihaknya memandang serius pelbagai masalah timbul di penempatan warga asing terbabit. “Operasi seumpamanya akan diteruskan dari semasa ke semasa bagi mencegah kebanjiran pendatang tanpa izin selain mencegah pelbagai masalah berkaitan termasuk kebersihan bagi menjamin keselesaan dan kesihatan penduduk,” katanya.


KOMEN:

Operasi pihak berkuasa tempatan dan PDRM tidak sepatutnya terhad kepada pemeriksaan dokumen dan permit dan paspot pekerja asing tersebut, dalam kebanyakan kes, mereka ini mempunyai dokumen kerja yang sah... Tetapi, itu bukanlah isu dalam kebanyakan kes, isu-isu yang perlu diatasi pihak berkuasa ialah:

1- Pekerja asing perlu menghormati jiran dan tidak membuat bising terutamanya selepas 12 mlm. Contohnya, undang-undang di Republik Singapura tidak membenarkan orang ramai membuat bising dan mengganggu jiran selepas pukul 12 mlm, dan mereka yang engkar boleh didakwa di mahkamah.

2- Membuang sampah di merata tempat dan membuat kotor. Undang-undang di Malaysia juga tidak membenarkan orang ramai membuang sampah di merata tempat, dan mereka yang didapati membuat hanya putung rokok juga boleh didakwa di mahkamah, dan dihukum penjara atau denda. Kenapa tidak pekerja asing tersebut didenda sebagai pengajaran?!

3- Menduduki lebih dari 10 orang dalam satu rumah. Ini jelas melanggar kontrak sewa rumah (House Lease). Sebagai contoh, dalam kontrak sewa rumah saya, saya ada menjelaskan bahawa tidak lebih daripada 8 orang didalam rumah tersebut, kalau lebih orang, mereka perlu keluar, atau disuruh bayar mengikut kepala, dan segala kerosakan perlu di bayar gantirugi. Selain itu, tuan rumah mempunyai hak untuk datang dan memeriksa 'keadaan' rumah.
Dalam kes di atas, jelas Tuan Rumah tidak mengetahui hak mereka, atau mereka hanya tahu kira untung (tanpa mengambil kira aspek kebersihan, hormat jiran, kebisingan, dsb).

PKR, Diktator dan Kepincangan...

KUALA LUMPUR 13 Nov. - Tindakan Penasihat Parti Keadilan Rakyat (PKR), Datuk Seri Anwar Ibrahim terus berdiam diri tanpa mahu mengambil sebarang tindakan berhubung kepincangan dalam pemilihan parti itu membuktikan beliau merupakan seorang pemimpin diktator.

Bekas Timbalan Ketua Menteri I Pulau Pinang, Mohammad Fairus Khairuddin berkata, langkah berdiam diri Anwar itu sebenarnya bertujuan melindungi kepentingan 'anak emasnya' iaitu Naib Presiden PKR, Azmin Ali bagi memenangi perebutan jawatan timbalan presiden parti. Katanya, tindakan Anwar itu menyebabkan ramai pemimpin kanan PKR bertindak meninggalkan parti manakala Datuk Zaid Ibrahim meletakkan semua jawatan dalam parti dan menarik diri daripada bertanding jawatan timbalan presiden, Isnin lalu.

"Sekiranya Anwar memang benar-benar pejuang demokrasi, dia sepatutnya membatalkan proses pemilihan PKR yang menerima lebih 100 laporan kepincangan dan mengadakan pemilihan semula secara telus.

"Namun, adat seorang diktator, Anwar tidak akan melakukan apa- apa kerana semua tahu dia hanya mahukan orang kesayangannya, Azmin memenangi jawatan kedua tertinggi PKR, itu sahaja," katanya kepada Mingguan Malaysia di sini hari ini. Mohammad Fairus yang juga bekas Timbalan Pengerusi Perhubungan PKR Pulau Pinang berkata demikian bagi mengulas kenyataan bekas Timbalan Presiden PKR, Dr. Chandra Muzaffar yang menyifatkan Anwar sebagai pemimpin tidak demokratik kerana tidak dipilih secara terbuka sebagai pemimpin parti itu.

Dalam pada itu, bekas Setiausaha PKR Selangor, Mohd. Nazmi Rosli berkata, Anwar juga enggan mengesahkan kedudukannya sebagai pemimpin tertinggi PKR dengan bertanding jawatan presiden parti. Katanya, ini kerana Anwar sedar sekiranya bertanding jawatan presiden, beliau akan berhadapan dengan kritikan serta pendedahan dalam pelbagai perkara seperti kes liwat yang sedang dihadapinya di mahkamah.

"Anwar tahu permainan politik PKR sangat kotor dan dia tidak mahu mengambil risiko dimalukan oleh para pesaingnya jika beliau bertanding jawatan presiden.

"Selain pertuduhan liwat di mahkamah, para pesaing Anwar dalam jawatan itu (sekiranya Anwar bertanding jawatan Presiden PKR) pasti akan mengaitkannya dengan Azmin, lalu semakin buruk kredibilitinya," katanya.

Hentikan pemilihan MPP PKR

PETALING JAYA 13 Nov. - Satu demi satu dakwaan mengenai ketidakadilan dalam proses pemilihan pemimpin Parti Keadilan Rakyat (PKR) terus dilontarkan oleh ahli-ahli parti itu. Hari ini, sekumpulan 300 orang yang mendakwa ahli parti itu mengadakan demonstrasi di hadapan Pejabat PKR Pusat di sini bagi mendesak supaya pemilihan Majlis Pimpinan Pusat (MPP) parti itu yang sedang berlangsung dihentikan.

Rata-rata daripada mereka mendakwa pemilihan PKR yang sedang berlangsung tidak dilakukan dengan adil, sebaliknya hanya mementingkan individu tertentu. Dalam demonstrasi aman itu, kumpulan berkenaan turut membawa beberapa kain rentang yang mengutuk pemimpin tertinggi PKR selain mahu pemilihan parti diadakan semula.

Kumpulan berkenaan yang terdiri daripada pelbagai kaum dan lapisan umur hadir menaiki tiga bas serta beberapa van sejak pukul 10 pagi. Difahamkan kumpulan itu merupakan ahli PKR dari Selayang, Hulu Selangor, Tanjung Malim, Subang dan Batu Kawan (Pulau Pinang). Perhimpunan itu bagaimanapun selesai pada pukul 12 tengah hari.

Turut kelihatan ialah Bekas Timbalan Setiausaha Agung PKR, P.S. Jenapala; Bekas Bendahari PKR Selangor, S. Kottapan dan Bekas Timbalan Ketua Cabang PKR Selayang, Datuk Mazlan Hassan. Seorang daripada wakil kumpulan itu yang juga bekas calon Ketua Cabang PKR Selayang, B. Rajendran ketika ditemui pemberita berkata, demonstrasi tersebut diadakan bagi mendesak pemilihan MPP dihentikan serta-merta.

"Sebagai ahli PKR, kami tidak boleh menerima sekiranya pemilihan MPP tetap dijalankan kerana ia tidak dilakukan dengan telus.

"Pemimpin atasan PKR perlu menyelesaikan dahulu penggantungan beberapa cabang serta masalah lain sebelum meneruskan pemilihan MPP," dakwanya yang merupakan Ketua Komuniti Kaum India Parlimen Selayang. Seorang lagi ahli PKR, Abdul Razak Mohd. Jalil berkata, pemimpin tertinggi PKR seharusnya memandang serius demonstrasi yang diadakan itu. Ini kerana, katanya, demonstrasi itu merupakan suara akar umbi yang mahukan keadilan dan ketelusan dalam pemilihan pemimpin parti.

"Sebagai wakil dari Selayang, kami mendesak supaya pemilihan MPP dihentikan sementara pemilihan cabang dilakukan semula dengan lebih adil.

"Sekarang rakan-rakan lain telah mula hilang keyakinan dengan PKR, namun mereka masih menunggu jika pemimpin tertinggi dapat melakukan sesuatu. Sekiranya tiada sebarang perubahan, mungkin mereka tidak akan bersama PKR lagi," jelasnya.

KUCHING 13 Nov. - Sarawak akan mendapatkan bantuan daripada Jabatan Kemajuan Islam Malaysia (Jakim) untuk menyiasat dan mengesahkan sama ada pemimpin Parti Keadilan Rakyat (PKR), Beginda Minda sebelum ini merupakan seorang Islam atau sebaliknya.

Menteri Muda di Pejabat Ketua Menteri (Hal Ehwal Islam), Datuk Daud Abdul Rahman berkata, Jabatan Agama Islam Sarawak (JAIS) tidak mempunyai rekod yang mengatakan Beginda atau nama Islamnya, Nor Azman Abdullah telah memeluk Islam. Jelasnya, Beginda juga tidak pernah mengaku kepada jabatan tersebut dia seorang Islam atau tidak pernah keluar daripada Islam walaupun namanya menunjukkan dia seorang Islam.

''Kita akan menyiasat perkara ini dan kerajaan negeri akan meminta bantuan Jakim yang akan bekerjasama dengan jabatan agama Islam lain di negara ini untuk membantu sama ada Beginda pernah mempunyai rekod sebagai seorang Muslim atau tidak. ''Sebaik sahaja kita mendapat laporan itu, kita akan membuat susulan mengenai perkara tersebut," katanya kepada pemberita di sini hari ini.

Top Canadian Commander to Admit Murders and Sex

Wonder why sometimes soldiers from U.S., Australia, Canada, France, Italy, to name a few, when they were sent overseas to countries such as, Afghanistan and Iraq, to fight a war and rid of terrorists, and they were mostly not successful… The reasons are pretty simple, its attitude problem, its moral problem, its vision and mission problem… They mostly don’t have these ‘attitude and moral’ virtues, to fight such a war, so its not strange if you heard them swearing, and cursing, and trashing civilians, and do some wired stuff.

I don’t know if they have learnt anything from the wars in Vietnam, Cambodian, and such.
In the case below, the Colonel (and I belived his is not the only case). Clearly show a man with very low moral, arrogant, power-hunger, and sex-maniac, but was promoted to a very high rank... congratulation!

In Islam, promotion is grant based not only on skills and experiences, but also 'good moral and attitude.' .... And in Islam, Muslim usually married the girl or girlS they like, and not indulge in 'out of sex' affairs and other sexual manic activities.

Top Canadian commander to admit murders

The lawyer for a military commander who flew Queen Elizabeth II and other dignitaries around Canada says his client will plead guilty to murder, sexual assaults and dozens of breaking and entering charges. Colonel Russell Williams was the commander of Canada's largest air force base until he was charged earlier this year with the murder of two women, the sexual assault of two others and 82 break-ins, during which he stole women's panties.

Michael Edelson, Williams' lawyer, told a judge on Thursday Williams intends to plead guilty to all the charges at his next court appearance on October 18. The case shocked the country, hurt soldiers' morale and prompted fears that the commander of Canada's most high-profile military base and the man who once flew the country's prime ministers could have been a serial killer.

In 2005, Williams was pictured with the Queen and Prince Philip on the front page of the newspaper of Canadian Forces Base Trenton after he had served as their pilot during a visit. Williams waived his right to a preliminary hearing in August and was ordered to stand trial and return to court on Thursday.

The 47-year-old is charged with the first-degree murder of Jessica Lloyd, 27, whose body was found in February, and Marie Comeau, a 38-year-old corporal under his command who was found dead in her home in November last year. Both women were asphyxiated. He is also charged with forcible confinement, breaking and entering and sexual assault after two other women were attacked during separate home invasions in the Tweed, Ontario area in September 2009.

Williams is also charged with breaking into 47 homes 82 times, beginning in 2007, including one home nine times. Most homes were burglarised repeatedly on the same street. Most of the homes Williams was accused of breaking into were in Ottawa, where Williams has a house with his wife, and in the Tweed, Ontario, area, where Williams lived while he worked at Canadian Forces Base Trenton in Trenton, Ontario. "He's just a very twisted individual; there's no two ways about it," said retired lieutenant-general Angus Watt, who once promoted Williams.

"He was able to lead an elaborate double life and was able to keep it successfully concealed. This was the act of a depraved individual and really has no reflection on the men and women of the Canadian Forces." Angela McCanny, whose Ottawa home was broken into on consecutive days in 2008, said all the women's underwear in the house were stolen.

Anne Marsan-Cook, whose Belleville home was broken into on consecutive days in 2009, said her sex toys and all her underwear were taken. She also said a chilling message was left on her computer: "Go ahead, call the police. I want to tell the judge about your really big dildos."

"I was one of the lucky ones," Marsan-Cook said on Wednesday. The Ottawa Citizen cited police sources as saying police seized 500 women's undergarments from Williams' Ottawa home. Court documents allege Williams broke into Comeau's home days before he killed her. Another alleges Williams twice returned to the home of one of his victims to steal items after he sexually assaulted her.

A Canadian court on Thursday sentenced Colonel Russell Williams to two consecutive life sentences for a spree of murders, sexual assaults and burglaries of women's homes. Ontario Superior Court Justice Robert Scott described Williams as a "sick and dangerous man".

Williams will not be eligible for parole for 25 years. Police arrested Williams in February for the disappearance and death of 27-year-old woman, last heard from the previous month. He was later charged with the November 2009 murder of a female corporal under his command at the Trenton military base, as well as in two home invasions in which women were confined and sexually assaulted, and an additional 82 counts of break-and-enter and attempted break-and-enter in Ottawa, Belleville and Tweed.

A stash of women's undergarments taken by police from Williams' Ottawa residence was linked to the burglaries near his home and job. Police also seized hundreds of photographs and videos of the sexual assaults and murders from his home computer.

Banks in Malaysia

Now this is about time, I have long wrote to the Bank Negara Malaysia, and complaint to them about the late fees charges on credit cards, and the so-called dishonor cheques fees (charges/penalties). The late fees charges is so exorbitant, which the bank can easily overcome with just a click of the mouse, yet they choose to issue penalties on its loyal customers.
Also the interest charged on credit card of 15-18 percent per annum (by Malaysian banks) are simply too high. It simply make the poor man poorer!

Half a million tipped to join class action on bank fees

Up to 500,000 people are expected to join a class action against local and foreign banks for repayment of dishonour and late fees. Official figures show the banks collected nearly $1.2 billion in such fees in the 2008 financial year. The money came from honour and dishonour fees on bank accounts, and over-limit and late fees on credit cards.

Financial Redress, a subsidiary of litigation funder IMF, is funding the litigation against 12 banks who it says have illegally charged well over $5 billion over the past six years. The case will be based on the claim that the fees are illegal because they amount to a penalty rather than a legitimate fee.

Financial Redress managing director James Middleweek says the action will try to recoup as much of that $5 billion as possible, but it depends how many people make claims. "Realistically if we got 300,000, 400,000 people to sign up over the course of the next few weeks and months we'd have a sort of 600, 700, 800 million [dollar] class action," Mr Middleweek said. Maurice Blackburn Lawyers are the solicitors running the action.

The firm's chairman Bernard Murphy says the public response has been overwhelming, with 3,000 registrations on the company's website as of last night. "We're the largest class action law firm in the country and we've never seen a response like it," he said.

Mr Murphy says the case will hinge on contract law and the fact that penalty fees are in excess of what it costs the banks to process late payments or bounced cheques. "There's a contract law provision which states that if one party breaches a contract the victim of the breach is only allowed to charge a genuine pre-estimate of the damages for that," he said.

"So the situation we have here is that a person overdraws the account in breach of the contract with the bank and the bank's entitled to charge a genuine pre-estimate of the actual cost of that.
"Now that genuine pre-estimate would be, in some cases in relation to credit cards overdrawn, several cents. In relation to cheques, maybe $2.

"They've [banks] been charging $25 to $60. So we say the charges are extravagant and exorbitant. The law says that if those charges are extravagant or exorbitant then they amount to a penalty, which is illegal. "It's a very substantial action because, for example, in 2008 alone the Reserve Bank states that these exception fees totalled $1.2 billion," he said.

"So there is an estimated claim value in the order of $5 billion."

Australian banks have anticipated the threat to their fees and last year they started winding them back. National Australia Bank was one of the first to move to scrap dishonour fees, which is estimated to have cost NAB alone about $100 million.

"We see this as a first step, a small step in rebuilding our reputation which we've called out as a strategic issue," National Australia Bank chief executive Cameron Clyne said.

"As I said today this fee generates one in two of all the complaints the bank receives so we think it's a pretty good place to start."

Consumer group Choice believes there will be strong public interest in a class action. Choice spokesman Christopher Zinn says he has joined the class action as a private individual because there is an important legal issue to be tested. "We would imagine that there is real appetite for remedy on behalf of the public," he said.

"[Over the years we've had feedback such as people] writing to the bank saying what are you doing charging us these very high fees for what are often fairly mundane breaches, [like] being a bit late paying a credit card transaction?"

The Finance Sector Union, which represents workers in the banking sector, has mixed feelings about the planned class action. The union's national secretary Leon Carter says the lawsuit will bring some welcome attention to the sector, but it is not a long-term fix.

"Our concern is that if this lawsuit is successful the banks will simply make their money up somewhere else or even worse, sack staff to recoup any costs," he said. "The only long-term solution to this problem is better regulation."

Kompaun JPJ Naik 333 Peratus

One thing comes to my mind when the JPJ/government announced the 333 percent increases in summones, compounds, and/or fines for vehicle and/or traffic offences = This will definitely make road users more careful of their speed limits and other traffic and/or vehicle offences, but at the same time, this will also encourage 'corruptions' among JPJ enforcement officers. Why would someone wants to pay RM1000 for an offence when they can pay RM200-500 cash (of corruption money) to enforcement officers?? (JPJ officers will definitely get fatter after this! Some of course!).

At the end of the day, we need to ask the JPJ/government, what is all the fuss of the ridiculously large increase in compounds/summones? Are the people not suffering enough already due to the economic crisis, high unemployment rates, and high crime rates, among others.

KUALA LUMPUR - Para pemilik kenderaan dan pengguna jalan raya perlu lebih berhati-hati selepas ini berikutan kadar kompaun maksimum kesalahan jalan raya akan dinaikkan daripada RM300 kepada RM1,000 tidak lama lagi.

Kenaikan kira-kira 333 peratus itu berikutan pindaan ke atas Akta Pengangkutan Jalan 1987 yang akan dikuatkuasakan kelak. Peruntukan itu adalah antara 51 Fasal pindaan yang terkandung di dalam Rang Undang-Undang Pengangkutan Jalan (Pindaan) 2010 yang dibentangkan untuk bacaan kali pertama oleh Timbalan Menteri Pengangkutan, Datuk Rahim Bakri di Dewan Rakyat semalam.

Antara pindaan lain yang dicadangkan termasuk menaikkan umur kelayakan memohon lesen memandu motosikal daripada 16 tahun kepada 17 tahun. Penalti bagi kesalahan melanggar umur kelayakan itu juga dinaikkan daripada tidak melebihi RM2,000 kepada tidak kurang daripada RM1,000 dan tidak lebih daripada RM5,000.

It's impossible for anyone to back former Victoria police chief Christine Nixon after revelations she had dinner at a pub on Black Saturday while hundreds of homes burned, the police union says.
Come on, even police officer has the right to a dinner, damn right, if the bushfire victims have their rights to a dinner, so too is the police chief! Thats what we call equal right to basic needs (e.g. a dinner)!


And victims of the nation's worst bushfire disaster now face an "unthinkable" situation having realised that Ms Nixon, who is now in charge of bushfire reconstruction, had left her post at 6pm the day of the tragedy, said Police Association secretary Greg Davies.
What 'unthinkable situation'... its all a media playdown, support by police officers that dislike her!


"This is a scandalous situation. There is no excuse for it," he told reporters on Wednesday.
Ms Nixon told the royal commission into the disaster on Tuesday that she had a meal and monitored the bushfires through the internet, television and radio on February 7, 2009.

What 'scandalous situation' ? This is a bit too much to say to someone who has a dinner after a long day at work!! (And nowadays, professionals monitor the bushfires through the Internet, television, and radio... professional also use what we call the GIS (Geographic Information System) to monitor effectively the situation and bring it under control. They don't need to be in the 'burning fields' to get the job done!!


But she expanded on those comments in the media, saying she went out to a bistro for dinner with friends that night and has since defended that decision. "I did say in the statement I gave to the (royal) commission that I had a meal and I didn't say, obviously, at the time that I had gone to a local hotel and had a meal with two friends," she told ABC Radio. "That's all it was, it was a very quick meal and I went back home again and received many calls and monitored the situation."


Ms Nixon was appointed head of bushfire reconstruction upon leaving her position as the state's police chief.


"It's unthinkable that the victims of this disaster now have to look at the very person who was supposed have their hand on the tiller but had their hand on the cutlery (and who) is now supposed to be responsible for rebuilding their lives," Mr Davies said.

Again the word 'unthinkable'... played by the media and others, bushfire victims have the right to a meal (dinner), so is the police chief ! Come on, grow up people!
He said Victorian Premier John Brumby should no longer have confidence in her abilities. "On the information that's available, it's impossible for anyone to back her," he said.

What 'abilities' issue?? You mean having dinner (because one is hungry) will have their 'abilities' and 'professionalism' in question?!


"This is not about a Christine Nixon witchhunt. This is about substance over style and there was very little substance on the day, quite clearly." Family First Senator Steve Fielding said Ms Nixon should be removed from the Bushfire Reconstruction and Recovery Authority immediately. "It's beyond belief that the state's top cop was more interested in going out to dinner with friends than steering the police force through this country's biggest natural disaster," he said in a statement.

Come on people... grow up! Get the facts right... And don't be a hypocrite !

KANGAR – Keruntuhan institusi keluarga di Perlis membimbangkan berikutan 502 pasangan atau kira-kira 25 peratus daripada 2,037 pasangan Islam yang mendirikan rumah tangga sepanjang tahun lepas berakhir dengan perceraian.

Pengerusi Jawatankuasa Agama Islam Perlis, Jafperi Othman berkata, bagi tempoh antara Januari sehingga pertengahan bulan ini sahaja, lebih 120 pasangan bercerai. Punca perceraian antara lain ialah disebabkan masalah nafkah dan kecurangan, katanya semasa merasmikan mesyuarat agung ke-5 Persatuan Melayu Perlis (Pemanis) di sini hari ini.

Beliau memberikan contoh kes pasangan remaja yang mendaftar sebagai peserta Program Pembangunan Rakyat Termiskin (PPRT) kerana tidak dapat menyediakan pendapatan yang mencukupi untuk menampung kehidupan selepas bergelar suami isteri.

"Mereka sepatutnya bersedia dengan sumber kewangan sebelum berkahwin bagi mengelakkan diri daripada masalah selepas perkahwinan,” katanya.

Yang Dipertua Pemanis, Datuk Mohd. Zain Hamzah pula melahirkan kebimbangan dengan peningkatan gejala sosial yang melanda golongan remaja Melayu sejak kebelakangan ini. Katanya, kebanyakan mereka alpa terhadap tanggungjawab dalam bidang pendidikan dan mempertahankan susila. – Bernama

KUALA PILAH 1 Mac – Anak bekas Mufti Perlis, Fathul Bari Mat Jahya mengaku tidak bersalah ketika didakwa dalam perbicaraan di Mahkamah Rendah Syariah di sini hari ini atas tuduhan mengajar tanpa tauliah di negeri ini.

Tiga pengikut kanannya, Abdullah Sanusi Othman, 40; Nik Amirul Faiz Nik Md. Yusof, 25; dan Khairudin Daud, 55, masing-masing turut membuat pengakuan yang sama atas kesalahan bersubahat dengan pendakwah bebas itu.


Fathul Bari, 30, didakwa mengajar tanpa tauliah di Maahad Ittiba Sunnah, Kilometer 1.5, Jalan Lama Seremban-Kuala Pilah, semalam. Dakwaan terhadapnya dikemukakan oleh Pendakwa Syarie, Mohd. Al Hafid Ismail mengikut Seksyen 53(1) Enakmen Jenayah Syariah Negeri Sembilan 1992 (Pindaan 2004).


Ketiga-tiga pengikutnya pula didakwa bersubahat dengan Fathul Bari pada tarikh dan tempat yang sama mengikut Seksyen 34 Enakmen Jenayah Syariah Negeri Sembilan 1992 (Pindaan 2004) yang dibaca bersama Seksyen 37 enakmen sama.


Bagi kesemua pertuduhan tersebut, setiap tertuduh boleh didenda RM3,000 atau penjara dua tahun. Hakim Syarie, Zainal Abidin Kusemin membenarkan Fathul Bari dibebaskan dengan jaminan RM2,200 bersama dua penjamin di kalangan penjawat awam.


Beliau juga memerintahkan ketiga-tiga pengikut penceramah itu masing-masing dibebaskan dengan jaminan RM2,000 berserta seorang penjamin di kalangan penjawat awam. Zainal menetapkan 5 April ini untuk perbicaraan kes tersebut.


Terdahulu, Fathul Bari memohon jaminan dikurangkan di antara RM50 dan RM100 dengan alasan dia masih belajar di Universiti Islam Antarabangsa Malaysia (UIAM). Fathul Bari yang beralamat di Utan Kandis, Arau, Perlis merupakan lulusan Universiti Madinah dan memperoleh Ijazah Sarjana di Jordan. Dia kini mengikuti pengajian peringkat Doktor Falsafah di UIAM.


Semalam Fathul Bari bersama tiga pengikut kanannya ditahan anggota penguat kuasa Jabatan Hal Ehwal Agama Islam Negeri Sembilan (JHEAINS) ketika sedang mengajar di hadapan hampir 50 orang awam di Maahad Ittiba Sunnah.


Kesemua mereka ditahan pada pukul 11.30 pagi sebelum dibawa ke Balai Polis Kuala Pilah untuk siasatan. Beberapa buku dan peralatan yang digunakan turut dirampas dalam serbuan itu.

US university lecturer kills three, wounds three

HUNTSVILLE, Alabama: A female US lecturer has shot dead three people and wounded three others after learning she had been denied tenure at a northern Alabama university. The incident happened at the University of Alabama in Huntsville yesterday, and college spokesman Ray Garner told reporters that police had arrested one person and detained another.

"At this point we have three dead, three confirmed people who are dead,” Garner said. “We have three dead and three wounded,” he added.

Garner said two of the three people injured in the shooting remained in critical condition while a third was in stable condition at a Huntsville Hospital.

Local television WAFF, citing local authorities, said the shooter was a middle-aged female staff member who had opened fire after learning at a biology faculty meeting that she would not be granted tenure.

The television station said all three fatalities were staff members at the university. Police have not yet released the identities of the shooter and the victims. Classes on the campus were cancelled, and counseling services to the 7,500 students are being offered, according to the school’s website.

The local Huntsville Times reported that a female biology professor had been taken into custody and that her husband had been detained.

Erin Johnson, a second-year student, told the newspaper that a biology faculty meeting was underway at the math and science building, the Shelby Center, when she heard screams coming from one of the rooms.

Senator Richard Shelby, the Republican senator after whom the university centre was named released a statement offering his “thoughts and prayers” to students and faculty members, WAFF said. “I am deeply saddened to hear of this horrible tragedy,” his statement said.

The incident was just the latest in a series of school shootings to rock the United States — most of which have been carried out by students — amid the nation’s ever-prevalent debate about gun control.
The shooting comes more than two years after the southern state of Virginia was left horrified by the April 2007 massacre of 32 people at the Virginia Tech university by a student gunman, Seung-Hui Cho, who turned his gun on himself.

In 1999, two teenagers went on the rampage at Columbine school, Colorado, gunning down 13 people before killing themselves.

In the first six weeks of this year alone several shootings have already been reported around the country.

Last month, eight people were killed in the southern state of Virginia.

A man surrendered to authorities after a massive manhunt in the woods near the historic town of Appomattox, during which he opened fire at a helicopter aiding the search.

And in early January a disgruntled employee at a Missouri plant of a Swiss power company went on the rampage shooting dead three people and wounding five others. He also killed himself in the bloody shooting, believed to have been triggered by a dispute with the ABB company over his pension funds. -- AFP

A biology professor has been charged with murder over the shooting deaths of three fellow professors at a campus in south America. Authorities say Amy Bishop, an instructor and researcher at the University of Alabama Huntsville campus, opened fire during an afternoon faculty meeting, killing the three colleagues and injuring three other school employees.

Amy Bishop has been charged with one count of capital murder, which means she could face the death penalty if convicted. Amy Bishop, 42, was taken Friday night in handcuffs from a police precinct to the county jail and could be heard saying: "It didn't happen. There's no way .... they are still alive".
Police said they were also interviewing a man as "a person of interest."

University spokesman Ray Garner said the three killed were Gopi K. Podila, the chairman of the Department of Biological Sciences, and two other faculty members, Maria Ragland Davis and Adriel Johnson. Three others were wounded, two critically, in the gunfire, which Davis' husband said occurred at a meeting over a tenure issue.

The injured were identified as department members Luis Cruz-Vera, who was listed in fair condition, and Joseph Leahy, in critical condition in intensive care, and staffer Stephanie Monticello, also in critical condition in intensive care.

No students were harmed in the shooting, which is in a community known for its space and technology industries. Sammie Lee Davis said his wife, Maria Ragland Davis, was a researcher who had tenure at the university.

In a brief phone interview, he said he was told his wife was at a meeting to discuss the tenure status of another faculty member who got angry and started shooting. He said his wife had mentioned the alleged shooter before, describing the woman as "not being able to deal with reality" and "not as good as she thought she was."

Bishop, a neurobiologist who studied at Harvard University, joined the UAH biology faculty as an assistant professor in 2003.
Andrea Bennett, a student majoring in nursing, was in one of Bishop's classes on Friday morning.Bennett said nothing seemed unusual, but she described Bishop as being "very weird" and "a really big nerd."

"She's well-known on campus, but I wouldn't say she's a good teacher. I've heard a lot of complaints," Bennett said. "She's a genius, but she really just can't explain things."
Andrea Bennett, an athlete at UAH, said her coach told her team Amy Bishop had been denied tenure and that may have led to the shooting.

"She went to Harvard, so she is very smart. I can see that her getting denied tenure at UAH would be pretty upsetting," said Bennett.

Another student, Erin Johnson, told The Huntsville Times a biology faculty meeting was under way when she heard screams coming from a conference room. University police secured the building and students were cleared from it.

There was still a heavy police presence on campus Friday night, with police tape cordoning off the main entrance to the university.
The university posted a message on its website on Friday afternoon telling students the campus was closed Friday night and all students were encouraged to go home. Counsellors were available to speak with students.

The Huntsville campus has about 7,500 students in northern Alabama. The university is known for its scientific and engineering programs and often works closely with NASA.
